Il analyse aussi la manière dont elle a donné une définition extensive de ses attributions, ce qui lui a permis, en marge des pouvoirs qui lui étaient consentis par le constituant et législateur spécial, de s?imposer, dans le paysage juridictionnel belge, comme une véritable juridiction constitutionnelle. Une attention toute particulière est portée sur sa jurisprudence en matière de répartition des compétences. À cet égard, l?auteur constate que, sans la Cour, le système mis en œuvre par le constituant et le législateur spécial n?aurait guère été viable. En effet, sur le plan de la répartition des compétences matérielles, elle a radicalement remis en cause le dogme de l?exclusivité alors qu?elle en a fait une stricte application dans le champ des compétences territoriales. Enfin, l?auteur envisage quelques réformes qu?il conviendrait d?apporter aux pouvoirs de la Cour afin qu?elle puisse totalement assumer son rôle de vestale de la Constitution et de premier rempart de la démocratie.
