The Committee has concerns about the structure and content of the BBC reply to those questions. In particular it is not clear why the BBC Trust takes different views on transparency of employee costs and on transparency of talent (presenters or actors etc) costs, and why grouping of payments in bands for one but not the other presents data protection or breach of confidence issues. The Committee also questions why viewing figures for BBC3 are given in three-minute reach figures rather than the standard 15-minute reach used throughout the annual report, and why the BBC3 figures excluding repeats of BB1 programmes were not provided. On Freesat, a joint venture to provide a national satellite-based free-to-view digital service, the failure to disclose the contribution of the licence-fee payer is held to be unreasonable. The Committee would like greater clarity about who speaks for the BBC: the Trust or Executive. Future responses should make clear where accountability lies for particular issues, and the BBC should take a more constructive approach to responding to Parliamentary scrutiny.

Among the recommendations are: that BBC guidance needs a clearer delineation of responsibilities for risk management; that the main themes of risk management are not aligned with corporate objectives; that the BBC should update its assessments of the risks of working in hostile environments, as the abduction of journalist Alan Johnson showed; by failing to comply with its own Broadcasting Code, the BBC was fined by Ofcom over the a live phone-in competition on Blue Peter, and illustrates that some programme makers are ignoring the BBC's own editorial guidelines, exposing the corporation to reputational risk; the BBC has not related its risk to corporate objectives or assigned all risks to named owners; that BBC managers at all levels are not sufficiently engaged in the management of risk; there is still no fully satisfactory regime under which the BBC is accountable to Parliament for the value for money with which it spends licence fee payers money.

Worldwide has proved successful in recent years in exploiting new commercial opportunities, made possible by a loosening of the rules that govern the limits to its operations. However, there a balance to be drawn between Worldwide generating a return for the BBC, and limiting Worldwide's operations in order to ensure it upholds the BBC's reputation and does not damage its commercial competitors. Worldwide's minority stakes in overseas production companies, its controversial acquisition of Lonely Planet, and its growing portfolio of magazines, suggest that the balance has been tipped too far in favour of Worldwide's unrestricted expansion, jeopardising the reputation of the BBC and having an adverse impact on its commercial competitors. It is in the interests of the UK's creative economy as a whole that BBC Worldwide's activities are reined back. The BBC Trust should reinstate the rule that all BBC commercial activity must have a clear link with core BBC programming.

Book excerpt: In March 2006, the Government published its White Paper on the BBC ("A public service for all: the BBC in the digital age", Cm. 6763 (ISBN 9780101676328)) which set out the framework for the BBC's role as a public service broadcaster over the next ten years. Given the concerns that have been raised over the future sustainability of the current public service broadcasting system, the Committee's report examines a range of issues including: the prospects for maintaining plurality in public service broadcasting in the digital age; the practicality of continuing to impose public service obligations on commercial broadcasters; the viability of existing funding models for ITV, Channel 4 and Five; and the case for public funding of broadcasters in addition to the BBC. Amongst its findings, although the Committee notes its overall confidence in the viability of most types of public service content, it recognises that some content is already coming under pressure and that this is likely to increase over time. The report argues that the BBC should not be left as the only supplier of public service content in any area of programming, as the maintenance of plurality is an important public policy objective. Public funding, using licence fee income or general taxation, should be made available to all broadcasters on a contestable basis, to bring the benefits of competition to the provision of public service content that the market might not otherwise provide, such as UK­produced children's programming or regional programming.

It also examines press standards in the UK, particularly considering Madeleine McCann's disappearance, the suicides in and around Bridgend in 2008 and phone hacking and blagging. The Committee does not consider that it would be right to legislate on privacy. The Press Complaints Commission (PCC) should amend its Code to include a requirement that journalists notify the subject of their articles prior to publication, subject to a "public interest" test. The report also assesses the damage so called 'libel tourism' has caused to the UK's reputation as a country which protects free speech and freedom of expression. In cases where the UK is not the primary domicile or place of business of the claimant or defendant, the claimant should face additional hurdles before being allowed to bring a case. There is an urgent need to control defamation litigation costs more effectively. Competitive and commercial factors led to an inexcusable lowering of press standards in the gathering and publishing of 'news' about the McCann case, and self-regulation signally failed. The PCC should be renamed the Press Complaints and Standards Commission, reflecting its role as a regulator, not just a complaints handling service. The regulator should have the power to fine its members where it believes that the departure from the Code of Practice is serious enough to warrant a financial penalty.

The Committee has undertaken pre-legislative scrutiny of the bill but this was undermined by the incomplete nature of the legislation. The Committee also felt that the Government must prioritise the revision of Planning policy guidelines (PPGs) 15 & 16 to ensure that the new guidance on planning policy can be implemented at the same time as the Bill. Further serious issues of concern included the accuracy of current cost estimates & impact assessment and sufficient staffing with the necessary skills, in particular conservation officers. The Committee was also not convinced that Heritage Partnership Agreements (HPAs), a new system of management agreements for owners of large estates, were a robust business option. Nor could any evidence be found that either DCMS or English Heritage had considered any amendments to the legislation which would improve the operation or effectiveness of the enforcement powers for local authorities.

But this report addresses the growing public concern at the Internet's dark side: the easy availability of hardcore pornography, which people may find offensive, the uploading by ordinary people of film of real fights, bullying or alleged rape, or the setting up of websites encouraging others to follow extreme diets, or self-harm, or even commit suicide. In particular, there is increasing anxiety among parents about the use of social networking sites and chatrooms for grooming and sexual predation. The Committee welcomes the Government-commissioned report by Dr Tanya Byron on the risks posed by the Internet to children, and agrees that a UK Council for Child Internet Safety should be established. Sites which host user-generated content-typically photos and videos uploaded by members of the public-have taken some steps to set minimum standards for that content. The Committee recommends that proactive review of content should be standard practice for such sites, and calls for provision of high profile facilities for reporting abuse or unwelcome behaviour directly to law enforcement and support organisations. There is a distinct issue about labelling of video games to indicate the nature of their content. Two systems currently exist side by side: the industry awards its own ratings, and the British Board of Film Classification awards classifications to a small number of games which feature content unsuitable for children. The dual system is confusing, and BBFC should have responsibility for rating games with content appropriate for adults or teenagers.

Book excerpt: The European Commission white paper on sport, published on 11 July 2007, was referred to the Culture, Media and Sport Committee for an opinion by the European Scrutiny Committee. The white paper consists of three policy discussions, on the social value of sport, the economic value of sport, and the organisation of sport. Various action points emerge from the discussions, and with the white paper these form the Action Plan Pierre de Coubertin (included as an appendix to this report). There is a lack of competence for sport under existing EU treaties, though not under the Reform, or Lisbon, treaty. The report examines the content of the white paper and sport and EU law in detail. The Committee believes that sport has distinctive characteristics that need to be taken into account in the application of EU law. Much of the white paper is useful in exploring scope for using existing networks and programmes to support participation in sport. But the Committee does not believe there is any justification or necessity for the Commission to take a more active role in driving the development of policy on sport, and notes the alarm created by the lack of a clear statement on the autonomy of sports organisations. Governing bodies of sport should have the freedom to decide for themselves how their sport is run.
