Legal relations of the people were governed by a disorganized amalgam of norms, including provincial and local customs (coutumes), elements of Roman law and canon law, royal edicts and ordinances, and judicial decisions. All these sources of law coexisted with little apparent internal coherence. The multiplicity of laws and the fragmentation of jurisdiction were defining features of the monarchical era. Legal historians have focused on popular custom and its metamorphosis into customary law, which covered a broad spectrum of what we call today private law. This book sets forth the evolution of law in late medieval and early modern France, from the thirteenth through the end of the eighteenth century, with particular emphasis on the royal campaigns to record and reform customs in the sixteenth century. The codification of customs in the name of the king solidified the legislative authority of the crown, which was an essential element of the absolute monarchy. The achievements of legal humanism brought custom and Roman law together to lay the foundation for a unified French law. The Civil Code of 1804 was the culmination of these centuries of work. Juristic, political, and constitutional approaches to the early modern state allow an understanding of French history in a continuum.

What are the boundaries between private and public property? Over the course of a decade, the French Revolution grappled with these questions. Punctuated by false starts, contingencies, and unexpected results, this process laid the foundations of the Napoleonic Code and modern notions of property. As Rafe Blaufarb demonstrates in this ambitious work, the French Revolution remade the system of property-holding that had existed in France before 1789. The revolutionary changes aimed at two fundamental goals: the removal of formal public power from the sphere of property and the excision of property from the realm of sovereignty. The revolutionaries accomplished these two aims by abolishing privately-owned forms of power, such as jurisdictional lordship and venal public office, and by dismantling the Crown domain, thus making the state purely sovereign. Feudalism is normally associated with eighteenth-century France only in its more bizarre survivals, as in The Marriage of Figaro, when his seigneur claims the rights to spend the first night with the bride. If feudalism menat no more in the eighteenth century than a few quaint customs that could tickle an audence at the Comedie Francaise, why did French writers attack it so furiously? The author suggests that contemporary writers saw remnants of the feudal regime as important less in themselves, than as symbols of an attitude of mind which the 'enlightened' among them would no longer tolerate. Instead of representing the ideas of the eighteenth century through the eyes of a few outstanding writers, Dr Mackrell has tried to reconstitute the intellectual climate of the ancien regime from the works of largely unknown historians, jurists, economists and others. In this way he illuminates the rich texture of eighteenth-century French thought, without which the ideas of Voltaire, Montesquieu and even Rousseau lose much of their meaning. This study breathes life into the fierce controversies that shook the Age of Reason long before the outbreak of Revolution.
