Available in PDF, EPUB and Kindle. Book excerpt: There has been much discussion in the last ten years about the need to reform the law governing company charge registration, with many bodies including the Department of Trade and Industry and Law Commissions considering the case for reform of this area in the context of a wider scheme of personal property security reform. This has culminated in the coming into force of Part 25 of the Companies Act 2006, which is concerned with company charge registration. This major book features the work of international experts on personal property security law. It focuses on the reform of UK company charge law and argues that the Companies Act 2006 did not go far enough in reforming the law. It addresses the question as to whether the UK should follow the lead of other jurisdictions that have adopted US Article 9 type personal property security schemes. As well as considering current UK law the book also addresses the changes proposed by the Law Commissions and, despite current government inaction, considers whether these reform proposals should be adopted. The book contains major international comparisons and, in particular, looks at law reform in the USA, Canada, Australia, New Zealand, Singapore and Europe. This comparative treatment gives the reader a full perspective on this difficult and constantly developing area of law.

Book excerpt: Understanding Property Law provides a background to an area of law which is notoriously inaccessible. Standing back from their subject, the authors of this book elucidate how the practices of the past have shaped the development and form of the modern law. In doing so they stress the role of lawyers in the transactions - such as sale, gift and inheritance - in which their clients become involved. This focus upon the work which lawyers do in their offices provides a necessary complement to the emphasis on legislation and adjudication found in most textbooks. This edition has been extensively revised and updated to incorporate recent legislative developments including the Land Registration Act 2002.

Available in PDF, EPUB and Kindle. Book excerpt: In the 1870s Millicent Garrett Fawcett had her purse snatched by a young thief in London. When he appeared in court to testify, she heard the young man charged with 'stealing from the person of Millicent Fawcett a purse containing £1 18s 6d the property of Henry Fawcett.' Long after the episode she recalled: 'I felt as if I had been charged with theft myself.' The English common law which deprived married women of the right to own and control property had far-reaching consequences for the status of women not only in other areas of law and in family life but also in education, and employment, and public life. To win reform of the married women's property law, feminism as an organized movement appeared in the 1850s, and the final success of the campaigns for reform in 1882 was one of the greatest achievements of the Victorian women's movement. Dr Holcombe explores the story of the reform campaign in the context of its time, giving particular attention to the many important men and women who worked for reform and to the debates on the subject which contributed greatly to the formulation of a philosophy of feminism.

Book excerpt: This new edition of Property Law builds upon the highly successful earlier editions, providing a modern and comprehensive text. Full consideration is given to the important proposals of the Law Commission relating to the reform of registration of title. It also encompasses the most recent statutes, including the Contracts (Rights of Third Parties) Act 1999, and case law. Amongst the most important new cases covered are Central London Commercial Estates Ltd v Kato Kagaku Ltd (adverse possession); Bruton v London and Quadrant Housing Trust (leases) and Royal Bank of Scotland plc v Etridge (no 2) (mortgages). Property Law provides full coverage of basic property principles, permitting land law principles to be situated within this broader context. Particular attention is given to the role of possession, for both land and chattels. Trusts and equity are explained so far as these are relevant to property issues. The approach adopted thus ensures that the book is suitable for courses which deal with property law in this way, as well as for more traditional land law courses. Land law topics are widely covered, but with an emphasis on issues central to most courses on this subject. The book goes well beyond a description of the rules, however, seeking rather to get to the heart of the analyses used by the courts and to provide an understanding of their effect within a mature and complex area of law. There is a full discussion of key cases and the ways in which they articulate the fundamental principles of property law, enabling students to obtain a firm grasp of the subject and to apply these principles to particular problems and examples. Property Law can be used by itself or together with the author's Property Law: Cases and Materials.

Bringing together expert contributors from around the world, the book identifies and discusses the inadequacies and lacunas in current intellectual property law, and how it is practiced and applied in Nigeria. The book argues that the revision and reform of Nigeria’s intellectual property law will be vital for the country’s development and national interests, whilst also recognising that Nigeria’s legal provisions must sit within a broader global context. Divided into three parts, the book discusses patents, trademarks, and copyright in the context of broad overarching themes affecting all aspects of intellectual property law. Honouring Professor Adebambo Adewopo SAN, the pioneering thinker in Nigerian intellectual property law, this book will be an important resource for researchers working on African Law.

Available in PDF, EPUB and Kindle. Book excerpt: Considers how research in psychology offers new perspectives on property law, and suggests avenues of reform Property law governs the acquisition, use and transfer of resources. It resolves competing claims to property, provides legal rules for transactions, affords protection to property from interference by the state, and determines remedies for injury to property rights. In seeking to accomplish these goals, the law of property is concerned with human cognition and behavior. How do we allocate property, both initially and over time, and what factors determine the perceived fairness of those distributions? What social and psychological forces underlie determinations that certain uses of property are reasonable? What remedies do property owners prefer? The Psychology of Property Law explains how assumptions about human judgement, decision-making and behavior have shaped different property rules and examines to what extent these assumptions are supported by the research. Employing key findings from psychology, the book considers whether property law’s goals could be achieved more successfully with different rules. In addition, the book highlights property laws and conflicts that offer productive areas for further behaviorally-informed research. The book critically addresses several topics from property law for which psychology has a great deal to contribute. These include ownership and possession, legal protections for residential and personal property, takings of property by the state, redistribution through property law, real estate transactions, discrimination in housing and land use, and remedies for injury to property.
