M. Brunet's book fits in with the signs of the times. No person who pretends to be intelligent about constitutional matters can neglect it. It would be difficult to imagine anything more illuminating than a comparison of the Constitution of the United States drawn up in 1787, the fundamental law of the Australian Commonwealth adopted in 1900, and the new German Reichsverfassung of 1919, which vibrates with the tramp of the proletariat. In the attempt of the Germans to combine the strength of Hamilton's government with the democratic control so vaunted by Jefferson we have an experiment that ought to stir our deepest interest. In the provisions for social, not to say socialistic, enterprise, both the Australian and the German constitutions ofi'er noteworthy contrasts to our own fundamental law. It will not escape the close observer that the Germans have not created a Supreme court, on the model of our own, endowed with power to set aside acts of the executive and legislative branches of the government. The relations established by the Germans between the federal government and the states, ingenious compromises all must admit, ought to be studied in connection with Mr. Roosevelt's New Nationalism - not as an echo of a dead past but as a prophecy of the future. Book excerpt: Excerpt from The North German Confederation Immediately upon the close of the deliberations of the Reichs tag, which covered a period of two months, the constitution as amended was adopted by the assembly of envoys, whereupon it was submitted by the governments to the legislatures of their several states and approved by the latter in the form prescribed for constitutional amendments in each state. The constitution thus adopted should have been promulgated either by the associated governments or by the governments and the Reichs tag jointly. It was, as Binding points out, an anomaly that a national constitution should be promulgated by state govern ments. Strangely, however, neither the manner of promulga tion nor the question when the new constitution should go into effect, had received any attention from what we may be justified in calling the new federal authorities. This omission was supplied by the state governments which promulgated the constitution, through the insertion of an identical provision that on the 1st of July, 1867, it should go into effect in the promulgating state. Ratification by state legislatures and promulgation on state authority are facts to which Seydel appeals as proof that the constitution is not a federal law but an identical law of the several states. Binding holds that the state patents issued by the state governments are incorrect in form, but that in principle they rest on the authority of the associated governments and of the Reichstag. Article 9 begins: Every mem ber of the Federal Council has the right to appear in the Imperial Diet (reichstag), and has to be heard there on his demand at any time to represent the views of his govern ment. And again in contrast with Article 9, the preamble to the Constitution of the North German Federation, which latter was the predecessor of the present German Empire, enumerates the nineteen North German princes and the sen ates of the three free cities, and declares that they make an eternal union. This preamble sounds as if the princes and the senates were the parties to the transaction, and are now the members of the union. The question arises now, How can we unite these seem ingly contradictory passages where in one of them the mem ber states, in another the governments of the states, and in a third the sovereigns of the states seem to be considered the members of the empire? My standpoint-is this. It is impossible to deny that Article 6 calls the member states the members of the empire. But Prof. Laband is right in saying that the princes are the legitimate representatives of their respective states, and that they therefore together with the three senates may be considered the members of the empire and it is in this sense that the preamble to the Constitution of the North German Federation treats the princes and senates as the members of the empire. And finally it means the same thing whether one says either that the allied princes and sen ates, or that the allied governments are the members of the empire, and that for the reason that the term allied govern ments is so wide that it is applicable to the executives of all the German member states, of the twenty-two monarchies among them as well as of the three republics, and of the absolute monarchies as well as of the constitutional ones. In various writings on German life and institutions, now covering a period of just twenty-five years, I have touched upon isolated aspects of the subject of municipal government. Now, for the first time, I have the satisfaction of dealing with the subject systematically, and so of giving to it, as I trust, a treatment worthier of its importance. The actual work of writing has been spread over four years. The book, as its title explains, is concerned solely with questions of urban administration, yet without the limitation which the use of the word "municipal" might seem to suggest. The larger German cities and towns correspond for all practical purposes to the municipalities of the United Kingdom, as the smaller German towns correspond to our urban districts; hence it has appeared to me justifiable to consider convenience rather than strict historical and technical accuracy in the use of the terms "municipality" and "municipal," and to follow common wont in applying these terms to urban organisations, institutions, and activities generally, irrespective of the question of incorporation as understood in this country. On the subject of sources, a special remark needs to be made. This is not a book written from books, though German literature has, of course, been freely used. Book excerpt: Excerpt from Federal and Unified Constitutions: A Collection of Constitutional Documents for the Use of Students German Reich may profitably be compared with its predecessor, the constitution of the North German Con federation of 1867, which served the German Empire from 1871 to the revolution of November, 1918. Certain extracts from the speeches of the statesmen con cerned in the setting-up of the new constitutions have been included in order to shew something of the ideas that moved them. Considerations of space have severely limited such selections, but students who are desirous of extending their reading in this direction, may be referred to Elliot's Debates on the Federal Constitution, Alexander Hamilton's arguments in the Federalist, and Messrs. Egerton and Grant's Canadian Confederation, which con tain much valuable material of a similar kind in relation to the United States and the Dominion of Canada. He sponsible government in the British Empire is so closely bound up with federation that no apology is necessary for the inclusion of extracts concerning it.
