Book excerpt: Excerpt from The North German Confederation Immediately upon the close of the deliberations of the Reichs tag, which covered a period of two months, the constitution as amended was adopted by the assembly of envoys, whereupon it was submitted by the governments to the legislatures of their several states and approved by the latter in the form prescribed for constitutional amendments in each state. The constitution thus adopted should have been promulgated either by the associated governments or by the governments and the Reichs tag jointly. It was, as Binding points out, an anomaly that a national constitution should be promulgated by state govern ments. Strangely, however, neither the manner of promulga tion nor the question when the new constitution should go into effect, had received any attention from what we may be justified in calling the new federal authorities. This omission was supplied by the state governments which promulgated the constitution, through the insertion of an identical provision that on the 1st of July, 1867, it should go into effect in the promulgating state. Ratification by state legislatures and promulgation on state authority are facts to which Seydel appeals as proof that the constitution is not a federal law but an identical law of the several states. Binding holds that the state patents issued by the state governments are incorrect in form, but that in principle they rest on the authority of the associated governments and of the Reichstag. Article 9 begins: Every mem ber of the Federal Council has the right to appear in the Imperial Diet (reichstag), and has to be heard there on his demand at any time to represent the views of his govern ment. And again in contrast with Article 9, the preamble to the Constitution of the North German Federation, which latter was the predecessor of the present German Empire, enumerates the nineteen North German princes and the sen ates of the three free cities, and declares that they make an eternal union. This preamble sounds as if the princes and the senates were the parties to the transaction, and are now the members of the union. The question arises now, How can we unite these seem ingly contradictory passages where in one of them the mem ber states, in another the governments of the states, and in a third the sovereigns of the states seem to be considered the members of the empire? My standpoint-is this. It is impossible to deny that Article 6 calls the member states the members of the empire. But Prof. Laband is right in saying that the princes are the legitimate representatives of their respective states, and that they therefore together with the three senates may be considered the members of the empire and it is in this sense that the preamble to the Constitution of the North German Federation treats the princes and senates as the members of the empire. And finally it means the same thing whether one says either that the allied princes and sen ates, or that the allied governments are the members of the empire, and that for the reason that the term allied govern ments is so wide that it is applicable to the executives of all the German member states, of the twenty-two monarchies among them as well as of the three republics, and of the absolute monarchies as well as of the constitutional ones. Book excerpt: Excerpt from A Short History of Germany and Her Colonies After all, however, even these powerful Frankish conquerors had but imperfect success in Germany When they were present with their formidable armies, they could command obedience when engaged, as they often were, in distant parts of the vast Frankish territory, they could not trust to the fulfilment of the fair. Promises they had exacted. One of the chief causes of their ill - success was the continued independence of the Saxons. Ever since they had acquired the northern half of Thuringia, this warlike race had been extending its power. They were still heathens, cherishing bitter hatred towards the Franks, whom they regarded as the enemies both of their liberties and of their religion and their hatred found expression, not only in expeditions into Frankish territory, but in help willingly rendered to every German confederation which wished to throw off the Frankish yoke. Hardly any rebellion against the dukes of the Franks, or against King Pippin, took place in Germany without the Saxons coming forward to aid the rebels. This was perfectly understood by the Frankish rulers, who tried again and again to put an end to the evil by subduing the Saxons They could not, however, attain their Object. An occasional victory was gained, and some border tribes were from time to time compelled to pay tribute, but the mass of the Saxons remained unconquered. This was partly due to the fact that the Saxons had not, like the other German confederations, a duke who, when beaten, could be held responsible for the engagements forced upon him as the representative of his subjects. A Saxon chief who made peace with the Franks could undertake nothing for the whole people. As a conquering race, they were firmly compact; conquered, they were in the hands of the victor a rope of sand.
