Download or read book The Social Security (Miscellaneous Amendments) (No. 4) Regulations 2008 (S. I. 2008 No. 2424) written by Great Britain. Social Security Advisory Committee and published by The Stationery Office. This book was released on 2008 with total page 88 pages. Available in PDF, EPUB and Kindle. Book excerpt: The proposed regulations would reduce the time for claiming Pension Credit and Housing Benefit/Council Tax Benefit for those who have attained the qualifying age for Pension Credit, from 12 to 3 months, and reduce the period for which claims to Housing Benefit and Council Tax Benefit (HB/CTB) for customers of working age may be backdated, from 52 weeks to 3 months. The regulations also proposed to extend the period for which Pension Credit customers may retain entitlement whilst temporarily absent from Great Britain from 4 to 13 weeks. The Department for Work and Pensions aims to save £260 million by these changes, and to make the administration of the benefits more efficient. The Committee broadly welcomes the changes to the rules on temporary absence abroad, but is not convinced of the case to generate savings by reducing entitlement to HB and CTB and Pension Credit for some of the Department's most vulnerable and excluded customers. The changes will increase indebtedness and evictions, and the Committee believes the economic cost of increased possession proceedings (including the costs of re-housing and other services) have not been factored into the Department's calculations.

Book Synopsis The Anatomy of Administrative Law by : Joanna Bell
Download or read book The Anatomy of Administrative Law written by Joanna Bell and published by Bloomsbury Publishing. This book was released on 2020-05-28 with total page 334 pages. Available in PDF, EPUB and Kindle. Book excerpt: Winner of the 2022 Inner Temple New Authors Book Prize. This book seeks to further our understanding of the nature of administrative law doctrine and adjudication. It has three main aims. The first is to improve understanding of administrative law's 'anatomy' by pulling the subject apart and exploring the nature of the legal structures at play in adjudication. In doing so, the book emphasises three main ways in which administrative law's anatomy is both complex and diverse, namely: - administrative law doctrine interacts with a broad array of legislative frameworks; - administrative law adjudication seeks to accommodate a variety of legal values; and, - administrative law is concerned with legal relationships of different kinds. The second aim is to illustrate the importance of recognising the complexity and variety of administrative law's anatomy in three particular doctrinal contexts: procedural review, legitimate expectations and standing. The third and final aim is to raise an important but under-explored question: is it plausible and useful to attempt to make sense of administrative law doctrine by reference to a singular organising concept or principle? The overarching message of the book is one of cynicism. The complexity and variety of administrative law's legal structures probably means that attempts to explain the field 'monistically', while they may capture important themes, will be unhelpfully reductionist. Ambitious and thought-provoking, this is an important new statement on administrative law.

Book excerpt: This comprehensive volume assesses the relationship between legal rights and disability and the effect of law, legal process and third party professional intervention on the lives of people with disabilities. Stressing the crucial role played by disabled people themselves in fulfilling the promise of the worldwide rights movement, the chapters examine this relationship across a variety of themes, stressing the legal elements of each issue, and the extent to which law can assist in strengthening individual rights in that area. The contributors, who are all either academics or other professional experts in their field, write in a jargon free accessible style. The volume will be of interest to lawyers, human rights activists, health care professionals and to disabled people generally. The main areas covered in the volume are: * new perspectives on working in partnership with disabled people; * the changing attitudes to the rights of people with disabilities across the globe; * improvements to the rights of disabled people through legal process, using national and international law; * an examination of the rights and entitlement of disabled people to community care, housing, employment, education, and special services for children; * disabled people and mental health law; * messages from disability research for law, practice and reform implications for research.
