Book excerpt: Many national legal frameworks still do not include laws and measures specifically intended to tackle climate change in the agriculture sectors. However, national laws and institutional frameworks are necessary for good governance and can operate to support the implementation of national policy and international commitments, including on climate change. Indeed, Target 16.3 of the Sustainable Development Goals calls for the promotion of the rule of law, and the assurance of equal access to justice for all. This is both an important stand-alone goal and an enabling goal for the realization of the transformative 2030 Agenda for Sustainable Development. Furthermore, the Food and Agriculture Organization of the United Nations (FAO) sees appropriately designed, informed and responsive national legal and institutional frameworks as key to supporting the implementation of countries’ commitments under the 2015 Paris Agreement, as well as their Nationally Determined Contribution in the food, agriculture and natural resources sectors. Climate change presents multiple challenges and it cannot be addressed effectively in silos. Attention must be paid not only to specific agriculture sectors, but also to governance areas that are interconnected with agriculture, such as public spending and investment, social protection and rural development. Efforts should be coordinated with the engagement of civil society, including the legal profession, vulnerable groups and the private sector.This Study addresses the principal expressions of the food and agriculture sector (crops and livestock agriculture, forestry and fisheries), looking at the critical cross-cutting issues and their integration into agriculture law. It provides a comprehensive overview of the legal and institutional issues to consider when working towards preparing the agriculture sector for the challenges of climate change.

It compares eight years of coalition government under Scottish Labour and the Scottish Liberal Democrats with four years of Scottish National Party minority government. It outlines the relative effect of each government on Scottish politics and public policy in various contexts, including: high expectations for ‘new politics' that were never fully realised; the influence of, and reactions from, the media and public; the role of political parties; the Scottish Government's relations with the UK Government, EU institutions, local government, quasi-governmental and non-governmental actors; and, the finance available to fund policy initiatives. The aim is to provide a comprehensive and detailed analysis of Scotland's place in the UK. This paper, the first of a series to be published in 2013 and 2014, examines the UK's constitutional set-up and the legal implications of independence. The UK Government is convinced that the current devolution offers the best for Scotland: the Scottish Parliament and Government are empowered to take decisions on a range of domestic policy areas - such as health, education, policing - while Scotland continues to benefit from decisions made for the UK as a whole - defence and security, foreign representation, economic affairs. Independence is very different to devolution. Based on independent expert opinion (published as Annex A), the paper concludes that if there were to be a vote in favour of leaving the UK, Scotland would become an entirely new state whilst the remainder of the UK would continue as before, retaining the rights and obligations of the UK as it currently stands. Any separation would have to be negotiated between both governments. Legal and practical implications of independence, both at home and abroad, are addressed. An independent Scotland would have to apply to and/or negotiate to become a member of whichever international organisations it wished to join, including the EU and NATO. Scotland would also have to work through its positions on thousands of international treaties to which the UK is currently party.

This work presents primary evidence from over 900 documents, interviews, and participant observations, and provides the first descriptive history of local food movement national policy achievements in the US, from 1976 to 2013, and in the UK, from 1991 to 2013, together with reviews of both the American and British local food movements. It provides a US-UK comparative context, significantly updating earlier comparisons of American, British and European farm and rural policies. The comparative perspective shows that, over time, more effective strategies for national policy change required social-movement building strategies, such as collaborative policy coalitions, capacity-building for smaller organizations, and policy entrepreneurship for joining together separate rural, farming, food, and health interests. In contrast, narrowly-defined single issue campaigns often undermined long-term policy change, even if short-term wins emerged. By profiling interviews of American and English movement leaders, policymakers, and funders, the book demonstrates that democratic participation in food policy is best supported when funders incentivize groups to work together and overcome their differences.
