Book excerpt: Employment termination in breach of contract is normally remedied by anticipated earnings from the lost job, mitigated by any amounts that the victim actually earned, or could with reasonable effort have earned, from alternative employment. Traditionally neither consequential nor punitive damages are available. The assumption is that most people who lose jobs unlawfully manage quickly to find alternative employment and suffer no long-lasting harm. Recent economic and epidemiological research explodes this assumption. Workers who lose jobs experience health problems (stroke, heart disease, depression, tobacco use), increased mortality, and continuing economic losses, long after the period of unemployment. Moreover, that period of unemployment after job loss lasts much longer than it used to. The Restatement should not freeze existing remedies, but should permit common law remedies to evolve to resemble statutory remedies under the Civil Rights Act of 1991, for example by expanding the covenant of good faith and fair dealing.

Book excerpt: The question of what remedies are available in the event of the termination of the contract of employment of an employee without recourse to the terms of the contract of employment between the employer and employee is one that is on the front burner of litigation on labour matters. It is no news that of all matters adjudicated by the courts on labour relations; at least ninety percent of these matters are based on unlawful termination of the contract of employment. In view of this, the aim of this project is to determine what remedies are available in the event of an unlawful dismissal or termination of the contract of employment of an employee. To this end, an examination of the modes of termination and the position of the employee both under common law and statutory law has been undertaken. Furthermore, an examination of the remedies available to the injured party taking into consideration the judicial decisions in the courts both Nigerian and foreign. Also, the effects of international labour conventions on termination of employments were looked at and the applicability of these conventions to Nigeria were examined. Is the court bound to bring its decisions within the purview of what is known as International best practices? Finally, the position of the National Industrial Court and its attitude to cases of unfair dismissals is examined. Is the attitude of the NIC towards termination of employment and the remedies available to the injured party different from that of the regular courts? What factors come into play when the NIC awards compensation to the injured party when his contract is wrongfully terminated? In conclusion, it is noted that despite all the remedies available to the employee, the remedy mostly ordered by the court is an award of damages. The courts are always loath to order reinstatement of the employee except in cases involving statutory employers because "You cannot force a willing employee on an unwilling employer". Thus, most times, the remedy of damages is the only remedy available to the employee.

Other scholars defend at-will employment and criticize the just cause standard. This Article does not take sides in this debate; but instead, attempts to bridge the gap between the two by proposing a compromise statute, which I call the Employment Termination Equity Act (ETEA). Under ETEA, employers would remain free to terminate without having the difficult burden of proving just cause. However, certain enumerated reasons for termination would be unlawful. In determining which termination decisions should warrant protection, my goal was two-fold: (1) to make unlawful egregious termination decisions that have previously been unremedied despite the many exceptions to at-will employment and (2) to provide some overlap protection with current employment statutes by using a procedural process that will be more easily accessible by employees. Yet, in the spirit of true compromise, ETEA will provide fewer types of remedies than other employment statutes or common law claims, and will force plaintiffs to choose between suit under this proposed termination statute and other statutory remedies. As with any compromise, lines had to be drawn and line-drawing never satisfies everyone. My goal in this article is to convince the reader to view my line drawing optimistically - as a necessary means of bridging the gap between at-will employment and just cause.
