Book excerpt: Eingeordnete Freiheit compares Origen's notion of freedom of choice with the concepts of contemporary philosophers. The first chapter deals with the philosophical problem of freedom of choice throughout the history of Greek philosophy. In the second chapter Origen's writing on this topic is assembled, translated, analyzed and commented upon. The comparison between Origen and his contemporaries leads in chapter three to the conclusion that Origen's concept of freedom differs especially from the philosophical perspective, since human freedom does not stand in opposition to the inevitable pattern of the pronoia or heimarmene but to Gods care for every individual. Chapter four shows that the notion of oikonomia in Christian theology is based on the concept of providence in Origen.

Available in PDF, EPUB and Kindle. Book excerpt: A new translation of Kant's 1797 The Metaphysics of Morals into modern American English with the original German manuscript in the back for reference. This is Volume XII in the Complete Works of Immanuel Kant published by Newcomb Livraria Press This is not to be confused with his early 1785 work Groundwork for the Metaphysics of Morals, which is a different book. In keeping with the grounded, practical themes of his later works, the metaphysician of Prussia’s Die Metaphysik der Sitten focuses on law, government regulation and virtue. Law is the inevitable end of Reason, and as such, is rooted in a priori principles native to the soul but not external experience, in other words, metaphysical. The imperative of virtue relies on inner compulsion, while the imperative of legality relies on an external compulsion. In his lifelong rage against the Empiricism of David Hume, Kant here builds a positive framework devoid of polemics. Kant’s “Doctrine of Right” would inspire Hegel’s 1820 Philosophy of Right, where he would develop a more robust legal theory and a more restrictive social contract.

Book excerpt: The articles in this book display the originality and creativity of Eros and Eris, and their important role in the history of our culture, particularly in the history of philosophy and its role in today's systematic philosophy. Although these contributions to a hermeneutical phenomenology in this compilation are organized in a linear-chronological order (treating Homer, Hesiod, Plato, Aristotle, Augustine, Bonaventure, Thomas Aquinas, Cusanus, Kant, Hegel, Schelling, Nietzsche, Husserl, Heidegger and Levinas), they all carry out their own hermeneutical movement in the history of philosphy on the basis of a commitment with out life, here and now, and a thematic, professional interest. Among the contributors are: R. Bernasconi, J. Colette, J.F. Courtine, L. Dupré, Kl. Düsing, J. Greisch, J. Kockelmans, P.-J. Labarrière and G. Jarczyk, E. Levinas, Al. Lingis, J.-L. Marion, O. Book excerpt: "Value" is arguably one of the key concepts of the globalized world. In this world, to be is to be or have a value, while all thinking and implementing has the form of valuing and evaluating. Thanks to their operative expediency, both the concept of value and thinking through values appear as sufficient and such as not to need any interrogation as to their provenance and implications. The essays of this volume, on the other hand, provide insights precisely in these aspects by presenting, on the one hand, classical philosophical sources on value, and, on the other, readings that show how the concept of value shapes our manner of thinking in pivotal issues and domains of economics, culture and knowledge.

Book excerpt: The book is dedicated to the theoretical problems concerning ratio legis. In the contexts of legal interpretation and legal reasoning, the two most important intellectual tools employed by lawyers, ratio legis would seem to offer an extremely powerful argument. Declaring the ratio legis of a statute can lead to a u-turn argumentation throughout the lifespan of the statute itself – in parliament, or in practice during court sessions, when it is tested against the constitution. Though the ratio legis argument is widely used, much about it warrants further investigation. On the general philosophical map there are many overlapping areas that concern different approaches to human rationality and to the problems of practical reasoning. Particular problems with ratio legis arise in connection with different perspectives on legal philosophy and theory, especially in terms of the methods that lawyers use for legal interpretation and argumentation. These problems can be further subdivided into particular aspects of activities undertaken by lawyers and officials who use the ratio legis in their work, and the underlying theories. In short, this book examines what ratio legis is, what it could be, and its practical implications.

Book excerpt: Immanuel Kant's legal philosophy and theory have played an enormous role in the development of law since the eighteenth century. Although this influence can be seen primarily in German law and in the law of nations which have traditionally been oriented toward German legal development, today Kant's philosophy has experienced a Renaissance in the Anglo-American legal world. This anthology collects what the editors believe to be the very best of articles on Kant's legal theory, with an emphasis on his Metaphysics of Morals of 1797. In particular the articles relate to: 1) the nature of law and justice, 2) private law, 3) public law, 4) criminal law, 5) international law, and 6) cosmopolitan law.

However, arguments on why and how best to organise a plurality of states in a multilevel political order have first been discussed by philosophers and continue to inspire contemporary reasoning on international and supranational relations not only in political philosophy. This book offers a unique overview of the philosophical foundations of federalism from both a historical and a systematic perspective. The analyses proposed by renowned scholars from the US and from several European countries cover classic writers such as Hobbes and the authors of the Federalist Papers, Kant and Rawls, and range from anthropological justifications of federal orders to contemporary problems of EU constitutionalism, the principle of subsidiarity and the jurisdiction of the European Court of Human Rights (ECHR). The book is of relevance to anyone interested in philosophical justifications of federalism.
