Available in PDF, EPUB and Kindle. Book excerpt: The Common Fisheries Policy (CFP) is one of the more controversial of the EU's policies, and is widely blamed both for the poor state of Europe's fish stocks and the woes of its fishermen. Under the CFP, the EU is responsible for a wide range of issues. The EU manages fisheries in the waters of Member States and the fishing activities of Member States' fleets. It negotiates agreements permitting vessels from EU States to fish in the waters of other States, and acts as a member (in place of Member States) in regional fisheries management organizations responsible for fishery management beyond national waters. It regulates the marketing of fish, and lays down the rules governing trade in fishery products. The Common Fisheries Policy thus forms a key part of global fisheries law and policy and is an important factor in protection of the marine environment. This book examines all the varied issues in detail, providing a comprehensive overview of the CFP. It looks at the law relating to the Policy, considering the legislation, treaties and judgments of the European Court of Justice in this area. The policy issues crucial to understanding the law on the CFP and its operation in practice are also explored.

In this way Lequesne uses the Common Fisheries Policy to provide a varied illustration of European policy in action. The scholarship is based on high quality primary research, carefully conducted and articulated. The result is a fascinating insight into the fisheries sector which reveals broader characteristics of the EU.

The meeting s primary concerns were the future of relations between the ACP and the EU, and preparing ACP countries for Economic Partnership Agreement negotiations. The first paper, The Future of European Union-ACP Fisheries Relations, looks at the increasingly complex ACP/EU relationship. The second, WTO Fisheries Subsidies Negotiations: Implications for Fisheries Access Arrangements and Sustainable Management, outlines a possible fisheries framework agreement. The third paper, Elements of an ACP-EU Framework Agreement on Fisheries Arrangements, looks at the WTO fisheries subsidies negotiations, considers the impact they will have on developing countries and suggests risk-mitigation strategies."

This book was released on 2019 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: This report provides an ex post and an ex ante evaluation of the Fisheries Partnership Agreement (FPA) between the European Union (EU) and Greenland1. The initial FPA ran until 31 December 2012 and is tacitly renewed for six-year periods. The current Protocol to the EU/Greenland FPA runs from 1 January 2016 to 31 December 2020. The Greenland-EU FPA/Protocol is a 'mixed agreement', which permits EU vessels to fish in Greenlandic waters for cod, pelagic and demersal redfish, Greenland halibut, shrimp, grenadier and capelin. Small amounts of bycatch (grenadier and other species) are permitted. The agreement is unique amongst the EU's fisheries agreements in that it is the only one in northern waters for which financial compensation is paid for access (other northern agreements being based on transfers/exchanges of quota), and the only agreement based on financial compensation with a relatively developed country (with implications for its ability and capacity to manage resources effectively and its sectoral support needs). Indicative annual fishing opportunities total 42 726 tonnes, with Greenland offering and the EU accepting a part of total Greenlandic quotas for individual species each year based on scientific advice and the needs of both the EU and Greenlandic private sectors. The EU also transfers part of the agreed quota to Norway and the Faroe Islands, in exchange for access by EU vessels to the waters of those third countries. The Protocol provides annually for EUR 13 168 978 from the EU budget as financial compensation for access (calculated based on reference prices for each species) including a financial reserve of EUR 1 700 000 for additional quantities of species, with actual financial compensation for access being based on the quota agreed for the EU. In addition, EU ship-owners pay authorisation fees based on prices set in the Protocol for the quota allocated. EUR 2 931 000 are also provided from the EU budget to support Greenlandic sectoral fisheries policy. The methodology for this evaluation included a review of literature and data, and consultations (some face to face, and some remotely) with stakeholders in Greenland and in the EU. The scope of the ex post evaluation covers the FPA and the Protocol, performance over the first full three calendar years (2016 to 2018), and assessment against standard evaluation criteria. The scope of the ex ante evaluation includes the needs of both parties, defining objectives, learning lessons from the past, and an assessment of future options. Planning for the future and potential appropriations and allocation of human resources are also considered.

Book excerpt: With the growing scarcity of fish resources, instruments of fisheries management become crucial. This publication suggests a legal approach to this isssue, and focuses on six case studies: Indonesia, Kenya, Namibia, Brazil, Mexico and the EU. The case studies are preceded by an analysis of the international law requirements concerning fisheries management, with a focus on fisheries in Exclusive Economic Zones. The final part of the book summarises the case studies and develops a proposal for a 'legal clinic' for fisheries management.

Available in PDF, EPUB and Kindle. Book excerpt: Marine living resources are currently under severe threat from unsustainable use. International law urges a precautionary approach in the use of remaining fish stocks, necessitating rational domestic management of coastal fisheries and requiring foreign nations accessing these stocks to cooperate to this end. The manner in which bilateral fishing relations between the EU and various West African states have historically played out, however, has not followed this route. This book is a legal study of these relations from an inter-disciplinary and contextual perspective with particular reference to sustainability questions using three broad conceptual lenses: common resource management, integration towards sustainable development and the colonial legacy to interrogate the extent to which these interactions operated as legal instruments of sustainability.

Book excerpt: The objective of this evaluation study is to provide DG MARE with an overall analysis of the SFPAs features, content, implementation, results and impacts. The results of the evaluation are expected to help the Commission to understand what has worked well, be considered of added value or a success story and, for what has not worked well, why and what could have been a suitable alternative option. More specifically, the terms of reference of the assignment required the evaluation to assess: • the fit for purpose and added value of the SFPAs based on the governance framework, the socio-economic and environmental benefits and impacts that they create in the EU and in third countries. In that context it evaluates the effectiveness of SFPAs, notably the extent to which the objectives of i) the Regulation (EU) No 1380/2013 on the CFP, ii) the Communication on the external dimension of the CFP and the following 2012 Council conclusions, iii) the agreements and their implementing protocols, are met; - the extent to which the expected objectives and results fulfil the needs and expectations of EU in its different dimensions, including the EU fleet and the fisheries industry as well as local population, the partner countries, including on the distribution of the EU financial compensation between the access to the resource component and the sectoral support component; - the overall global, regional and type of agreement coherence of the current SFPAs network, in terms of policy orientations as well as in terms of concrete implementation and the overall coherence with other EU relevant policies , including the impact of SFPAs on EU Outermost Regions neighbouring SFPAs countries, and with the policies and intervention of other international organisations involved in fisheries; - the contribution of the SFPAs to development and reinforcement of the technical and scientific capacity of partner countries and their impact on the local fisheries sectors, on food security, trade relations with the EU; assess the SFPAs' contribution towards combating IUU fishing in third countries; - the sectoral support component including the programming process, the main types of activities carried out, their results, impacts, and effectiveness within the sector and in related policy areas, - the perception in terms of appreciation of SFPAs and their actions; - the relevance of SFPAs and their sectoral support with respect to the EU needs and objectives.

Book excerpt: The Contribution of International Fisheries Law to Human Development: An Analysis of Multilateral and ACP-EU Fisheries Instruments examines whether and how legal fisheries instruments encompass a normative consensus on human development. Focusing on both multilateral (treaties and soft-law) as well as the ACP-EU bilateral fisheries instruments, Nienke van der Burgt provides a detailed analysis as to whether these different types of legal instruments reflect the principles of equity, poverty eradication and participation, which have been identified as key indicators of human development. Moreover, specific attention is paid to whether explicit reference is made to the small-scale fisheries sector and to the role of women. Concluding that despite increasing evidence of the potential and significant contribution of fisheries towards human development, legal fisheries instruments seem to be struggling with the incorporation of a human development centred approach, The Contribution of International Fisheries Law to Human Development, is essential reading for all those involved in the fields of international environmental law and sustainable human development.

Book excerpt: The Economic Partnership Agreements between the European Union and the Africa, Caribbean, and Pacific (ACP) countries have drastically restructured Europe’s trade architecture towards the third world. This volume examines the consequences of EPAs for development in sub-Saharan Africa (SSA). Starting from the observation that the establishment of free trade as such will substantially impact upon economic development, the different contributions focus on the potential contribution of non-traditional aspects of EPAs. More specifically, the authors analyze the role of Aid for Trade schemes, regulatory integration issues and broader foreign policy considerations. How can these non-market access aspects stimulate development in Africa, and how have they been addressed in the EPAs? In short, this brings us to the question whether the ‘light version EPAs’ as they currently stand are a missed chance or a blessing in disguise?

Book excerpt: Examining fisheries, Brexit, the Trade and Cooperation Agreement (TCA) and its consequences for the Fishing Industry in the UK and the EU, this book explores key issues within the complex topic of fisheries after Brexit. Assessing the new fishing relationship between the UK and the EU, which will continue to develop over the next decade, it provides an important study of the state of fisheries post-Brexit. Taking a cross-cutting economic, legal and policy approach, the book outlines the social and economic impacts of Brexit on the UK and EU fishing industries. It critically analyses the provisions relevant to fisheries in the TCA, reflects on the bilateral fishing negotiations between the EU, UK and Norway, providing inferences as to what the "new and special relationship" might be in fisheries. It then focuses on the 2020 Fisheries Act and explores internal divergences in the nations of the UK because of devolution. Taking an international approach, the work offers an exploration of cooperation in fisheries enforcement, international and regional obligations in marine conservation, and the new horizons for the UK in international fisheries organizations and arrangements now it is no longer a member of the EU. It offers an overview of expert opinion on fisheries post-Brexit, highlighting lessons learned and future developments for fisheries in a post-Brexit world. Having finally signed the Trade and Cooperation Agreement on 31 December 2020 after tense negotiations, the United Kingdom and European Union have found themselves in a new fisheries relationship. This book maps the complex social, economic, legal and policy issues of fisheries in a post-Brexit world and will be of interest to stakeholders and scholars.
