Although the concept of sovereignty has been progressively weakened, it still presents the major theoretical difficulty in this area. There is currently no source of international law that would give a legal body like a court the authority to recognize the division of an oppressive or illegitimate state into separate legal entities. This book accordingly argues for a global system of justice based on a domestic model of compulsory law. It considers some of the technical, procedural and evidentiary issues that would arise in instituting such a regime, and develops the conceptual framework essential for the provision of legal remedies for gross violations of our fundamental human rights.

The first is more famous, but the second was most essential because, without federalism, there could have been no United States of America. Through the course of its history, the country has moved through a series of phases, some of which put more power into the hands of the federal government, and some rested more power in the states. Sometimes this rebalancing led to armed conflict. The Civil War, of course, almost split the nation permanently apart. And sometimes it led to political battles. By the end of the 1960s, however, the country seemed to have settled into a quiet agreement that inequality was a prime national concern, that the federal government had the responsibility for addressing it through its own policies, and that the states would serve as administrative agents of that policy. But as that agreement seemed set, federalism drifted from national debate, just as the states began using their administrative role to push in very different directions. A pioneering ethnologist who penetrated occupations dominated by men, she was the first woman to hold an endowed chair at Harvard’s Peabody Museum of American Archaeology and Ethnology--during a time the institution did not admit female students. She helped write the Dawes General Allotment Act of 1887 that reshaped American Indian policy, and became one of the first women to serve as a federal Indian agent, working with the Omahas, the Winnebagos, and finally the Nez Perces. Charged with supervising the daunting task of resurveying, verifying, and assigning nearly 757,000 acres of the Nez Perce Reservation, Fletcher also had to preserve land for transportation routes and restrain white farmers and stockmen who were claiming prime properties. She sought to “give the best lands to the best Indians,” but was challenged by the Idaho terrain, the complex ancestries of the Nez Perces, and her own misperceptions about Native life. A commanding presence, Fletcher worked from a specialized tent that served as home and office, traveling with copies of laws, rolls of maps, and blank plats. She spent four summers on the project, completing close to 2,000 allotments. This book is a collection of letters and diaries Fletcher wrote during this work. Her writing illuminates her relations with the key players in the allotment, as well as her internal conflicts over dividing the reservation. Taken together, these documents offer insight into how federal policy was applied, resisted, and amended in this early application of the Dawes General Allotment Act.

In her examination of the impact of New Deal social and labor policies on the organization and character of American citizenship, Suzanne Mettler offers an incisive analysis of the formation and implementation of the pillars of the modern welfare state: the Social Security Act, including Old Age and Survivors' Insurance, Old Age Assistance, Unemployment Insurance, and Aid to Dependent Children (later known simply as "welfare"), as well as the Fair Labor Standards Act, which guaranteed the minimum wage. Using complexity theory and panarchy, a specific arrangement of interacting complex adaptive systems together with a ‘resilience assessment’, the EU’s foreign policy is shown to be undermining the aims of the premier African institution, the AU, created to provide unity and security on the continent: the EU pursues these objectives in its own image rather than honouring African values. This book raises awareness of these issues, as well as to widen the application of the theoretical framework in international relations and politics, which is becoming increasingly important in a complex world. This border has been historically contested and largely porous. Dividing Hispaniola is a study of Dominican dictator Rafael Trujillo’s scheme, during the mid-twentieth century, to create and reinforce a buffer zone on this border through the establishment of state institutions and an ideological campaign against what was considered an encroaching black, inferior, and bellicose Haitian state. The success of this program relied on convincing Dominicans that regardless of their actual color, whiteness was synonymous with Dominican cultural identity. Paulino examines the campaign against Haiti as the construct of a fractured urban intellectual minority, bolstered by international politics and U.S. imperialism. This minority included a diverse set of individuals and institutions that employed anti-Haitian rhetoric for their own benefit (i.e., sugar manufacturers and border officials.) Yet, in reality, these same actors had no interest in establishing an impermeable border. Paulino further demonstrates that Dominican attitudes of admiration and solidarity toward Haitians as well as extensive intermixture around the border region were commonplace. In sum his study argues against the notion that anti-Haitianism was part of a persistent and innate Dominican ethos.
