In this context, one of the central questions confronting contemporary state and their citizens is how recognition of socio-cultural ‘differences’ can be integrated into a universal conception of citizenship that aims to secure equality for all. Equality policies have become a central aspect of contemporary European public policy. The ‘equality/difference’ debate has been a central concern of recent feminist theory. The need to recognize diversity amongst women, and to work with the concept of ‘intersectionality’ has become widespread amongst political theory. Meanwhile European states have each been negotiating the demands of ethnicity, disability, sexuality, religion, age and gender in ways shaped by their own institutional and cultural histories. This book was previously published as a special issue of Critical Review of International Social & Political Philosophy (CRISPP).

This has resulted from the interaction of union organizing efforts and the statutory union recognition provisions of the Employment Relations Act 1999. Drawing on the Australian context, the book explores how nation features as a productive, if somewhat ambivalent, discursive resource in contemporary Muslim and Aboriginal struggles to be recognised. In demanding recognition, minorities enter into the business of ‘making the nation’ by positing alternative conceptions of national identity, culture and belonging that are more attentive to their differences and claims. This dynamic is engaged as an expression of ‘postcolonial citizenship’. Postcolonial citizenship is imagined in terms of the ways in which minority groups actualise multicultural realities through rewriting ideas of national community. It underlines the critical importance of revising the power relations that deem some groups ‘more national’ and others less so – and which, in Western multicultural societies, are typically tied to notions of the ‘West’ and its ‘others’. This book is an important conceptual, theoretical and political intervention that brings postcolonialism and multiculturalism into dialogue on the increasingly potent issues of nation and national identity. Book excerpt: This book examines how the Convention on the Recognition and Enforcement of Foreign Arbitral Awards, commonly known as The New York Convention, has been understood and applied in [insert number] jurisdictions, including virtually all that are leading international arbitration centers. It begins with a general report surveying and synthesizing national responses to a large number of critical issues in the Convention’s interpretation and application. It is followed by national reports, all of which are organized in accordance with a common questionnaire raising these critical issues. Following introductory remarks, each report addresses the following aspects of the Convention which include its basic implementation within the national legal system; enforcement by local courts of agreements to arbitrate (including grounds for withholding enforcement), recognition and enforcement of foreign awards by local courts under the Convention (including grounds for denying recognition and enforcement), and essential procedural issues in the courts’ conduct of recognition and enforcement. Each report concludes with an overall assessment of the Convention’s interpretation and application on national territory and recommendations, if any, for reform. The New York Convention was intended to enhance the workings of the international arbitral system, primarily by ensuring that arbitral awards are readily recognizable and enforceable in States other than the State in which they are rendered, subject of course to certain safeguards reflected by the Convention’s limited grounds for denying recognition or enforcement. It secondarily binds signatory states to enforce the arbitration agreements on the basis of which awards under the Convention will be rendered. Despite its exceptionally wide adoption and its broad coverage, the New York Convention depends for its efficacy on the conduct of national actors, and national courts in particular. Depending on the view of international law prevailing in a given State, the Convention may require statutory implementation at the national level. Beyond that, the Convention requires of national courts an apt understanding of the principles and policies that underlie the Convention’s various provisions. Through its in-depth coverage of the understandings of the Convention that prevail across national legal systems, the book gives practitioners and scholars a much-improved appreciation of the New York Convention “on the ground.”

Book excerpt: Since the late 1970s human remains in museum collections have been subject to claims and controversies, such as demands for repatriation by indigenous groups who suffered under colonization. These requests have been strongly contested by scientists who research the material and consider it unique evidence. This book charts the influences at play on the contestation over human remains and examines the construction of this problem from a cultural perspective. It shows that claims on dead bodies are not confined to once colonized groups. A group of British Pagans, Honouring the Ancient Dead, formed to make claims on skeletons from the British Isles, and ancient human remains, bog bodies and Egyptian mummies, which have not been requested by any group, have become the focus of campaigns initiated by members of the profession, at times removed from display in the name of respect. By drawing on empirical research including extensive interviews with the claims-making groups, ethnographic work, document, media, and policy analysis, Contesting Human Remains in Museum Collections demonstrates that strong internal influences do in fact exist. The only book to examine the construction of contestation over human remains from a sociological perspective, it advances an emerging area of academic research, setting the terms of debate, synthesizing disparate ideas, and making sense of a broader cultural focus on dead bodies in the contemporary period.

What motivates states to act the way they do? Contesting Revisionism focuses on a particular kind of motivation inclining a state to challenge the existing norms, rules, and institutions of international order: revisionism. The authors offer a critique of the existing discourse on revisionism and investigate the origin and evolution of the foreign policy orientations of revisionist states in the past. Furthermore, they introduce an ensemble of indicators to discern and compare the extent of revisionist tendencies on the part of contemporary China and the United States. Questioning the facile assumption that past episodes will repeat in the future, they argue that "hard" revisionism relying on war and conquest is less viable and likely in today's world. Instead, "soft" revisionism seeking to promote institutional change is more relevant and likely. Focusing on contemporary Sino-American relations, they conclude that much of the current discourse based on power transition theory is problematic. A dominant power is not inevitably committed to the defense of international order, nor does a rising power always have a revisionist agenda to challenge this order. The transformation of international order does not necessarily require a power transition between China and the US., nor does a possible power transition necessarily augur war. After developing the concept of revisionism both theoretically and empirically, they conclude with a series of policy recommendations for enhancing international stability and diminishing tension in Sino-American relations.
