Queda mucho trabajo por hacer a pesar de esos grandes avances. Los antecedentes históricos de la legislación española de competencia y los textos positivos demuestran que no se puede identificar un modelo de política jurídica y económica de la competencia exclusivo y excluyente para la aplicación de la Ley de 2007 vigente en España. La política de la competencia puede situarse en el marco de la política económica general del Estado, y se debe reflexionar sobre los límites de esa inclusión. Es necesario avanzar en un enfoque integrado y pluralista para reforzar mutuamente las instituciones sociales, y para ello las bases de información para la toma de decisiones sobre la valoración de las instituciones no deben ser angostas y limitadas. Más de un siglo de aplicación del Derecho de la Competencia en los Estados Unidos ha demostrado las dificultades existentes para proporcionar una base de información analítica sólida que permita resolver las diferencias entre los diversos modelos de aplicación del Derecho de la Competencia. Las discusiones han llegado a un punto que reclama un análisis sosegado de los enfoques confrontados sobre la naturaleza de la actividad empresarial, las características de los mercados y el papel en todo este entramado del Estado. El Derecho de la Competencia vuelve a tomar un perfil que debe abonar un importante espacio para la reflexión política y científica a la que invitamos al lector de este trabajo.
