Book excerpt: This book explores the persistence of the governance gap with respect to the human rights-impacting conduct of transnational extractive corporations operating in zones of weak governance. The authors launch their account with a fascinating case study of Talisman Energy’s experience in Sudan, informed by their own experience as members of the 1999 Canadian Assessment Mission to Sudan (Harker Mission). Drawing on new governance, reflexive law and responsive law theories, the authors assess legal and other non-binding governance mechanisms that have emerged since that time, including the UN Guiding Principles on Business and Human Rights. They conclude that such mechanisms are incapable of systematically preventing human rights violating behaviour by transnational corporations, or of assuring accountability of these actors or recompense for victims of such violations. The authors contend that home state regulation, while not a silver bullet, has a crucial role to play in regulating such conduct. They pick up where UN Special Representative John Ruggie’s Guiding Principles on Business and Human Rights left off, and propose an innovative, robust and adaptable template for strengthening the regulatory framework of home states. Their model draws insights from the theoretical literature, leverages existing public, private, transnational, national, ‘soft’ and hard regulatory tools, and harnesses the specific strengths of state-based governance. This book will be of interest to academics, policy makers, students, civil society and business leaders.

Book excerpt: The book touches upon how the Atmaan Beja have survived over the last hundred years on their scarce resources by using mixed strategies: of herding and cultivation, of moving between urban and rural settings in order to supplement these activities with wage-labouring, and also of involving themselves in commercial enterprises. Such diversifying approaches to subsistence are frequent among pastoralists. It is characteristic of the Beja and other people in the arid regions of Africa that their subsistence requires continuous involvement in several mutually supplementing activities. When they are not able to invest the needed amount of labour, or if the time schedule for the different activities is put out of sequence, the consequences can be devastating. The process whereby "traditional" Atmaan life has become gradually more difficult to live, culminating in the 1984-86 disaster, is linked to changes in their position in relation to the Sudanese economy as a whole, and to Sudan's place in international trade. But it is also kinked to the general desiccation of the African Sahel.

Since that time, the Comprehensive Peace Agreement of 2005 provided for the self-determination referendum of 2011 that resulted in the independence of the new Republic of South Sudan. The half-full glass of dreams of social and economic development supported by oil revenue has been replaced by a glass half empty with new varieties of political dysfunction in which both nations have grave problems in security and economic stability in a generally troubled regional “neighborhood.”

Book excerpt: Since gaining independence in 1956, Sudan has endured a troubled history, including the longest civil war in African history in Southern Sudan and more recent conflicts such as the humanitarian crisis in Darfur. This book explores this history of ensuing conflict, examining why Sudan failed to sustain a successful modern post-colonial state. The book goes on to consider in detail the various attempts to end Sudan’s conflicts and initiate political and economic reconstruction, including the failure which followed the Addis Ababa agreement of 1982 and the more recent efforts following the Nivasha agreement of 2005 which ended the civil war in the south. It critically examines how reconstruction has been envisioned and the role of the various major players in the process: including donors, NGOs, ex-combatants and the central state authority. It argues that reconstruction can only be successful if it takes into account the fundamental and irreversible transformations of society engendered by war and conflict, which in the case of Sudan includes the massive rural to urban population flows experienced during the years of warfare. It compares possible future scenarios for Sudan, and considers how the obstacles to successful post-conflict reconstruction might best be overcome.
