Book excerpt: Alternative Dispute Resolution (ADR) has been an option for taxpayers and their advisers involved in enquiries or disputes with HMRC for a number of years, and it is now becoming increasingly popular as an alternative to taking a case to the First or Upper Tax Tribunal where there is a significant backlog in terms of cases being heard. The real attraction of ADR and a significant benefit to taxpayers, whether individuals or corporates, is that the process is completely confidential - in comparison to the potential embarrassment of tribunals where details are in the public domain. This book contains expert guidance on a variety of topics centred on Alternative Dispute Resolution, from how to complete the ADR form and guidance for the ADR meeting on the day, to what the Litigation Settlement Strategy is and an outline of the tribunal processes. It is a practical step by step guide with technical tax commentary, illustrated with real-life case studies and analysis of strategies employed in resolving these disputes. Readers will benefit from the practical experience of the author Jesminara Rahman, who has over 25 years experience in dealing with tax disputes and how to use ADR as a tool to reach a resolution with HMRC, and who had a leading role in implementing ADR within HMRC as a national service. Jesminara Rahman is the Director of Tax Resolute Ltd. Her experience includes 15 years as an HMRC Inspector of Taxes and Tax Dispute Resolution expert.

Book excerpt: This is the first of a new series giving practitioners some guidance on specialist areas or complex areas of taxation where there is a need for some further understanding due recent changes in legislation or court decisions. Family investment companies (“FIC”) started to be used as an estate planning vehicle following the changes to the tax treatment of trusts that took place in 2006. Since then the structure has become increasingly popular, especially as corporation tax rates have been reducing. As a result they are now widely used, but the term family investment company is applied to many different types of structures, used for a wide variety of purposes. This title explores what makes a company a FIC, to consider how a company works and the potential ways to make them more bespoke, the different types of shares available, their features and when they may be appropriate. It also covers the key tax issues for funding a FIC, winding one up, privacy, reporting and asset protection features. It includes lots of examples based on real cases, and where relevant complex areas are illustrated by flowcharts and/or diagrams.

Book excerpt: This title provides practitioners and students with a concise and clear introduction to international tax law and how it is applied, particularly in relation to the taxation of private investment income. It is a valuable resource for advisers who deal with cross-border tax issues infrequently or are encountering it for the first time. The book covers the background to international tax law and the interaction with national tax law set by individual countries. The amount of cross-border investment by individuals and businesses continues to increase as the world gets smaller. The growth of the digital economy and various world events such as Brexit have increased this trend and as a result tax-payers and their advisers are encountering double taxation issues for the first time. The author examines how the right to tax different types of cross-border flows of income (such as business, property, employment and investment income) and of different types of capital gains is shared between the state where those profits originated (the "source state") and the state where the individual or company receiving them is based (the "residence state"). This is considered both under the OECD Model Treaty that acts as the basis of most double tax treaties and also under EU tax law, which at times overrides and is more favourable to the taxpayer than a double tax treaty. Cross-border inheritance and gift tax treaties are also considered, and how they share out taxing rights between source and residence states. This is followed by an introduction to different kinds of entities used in offshore tax planning, which also describes some of the possibilities of structuring transactions using those entities. It includes warning sections for practitioners to help them avoid getting their fingers burnt: firstly an introduction to anti-avoidance rules under domestic law and tax treaties; secondly a section on international exchange of financial and tax information as well as cooperation on cross-border enforcement of tax debts to warn the reader to assume full transparency of all their transactions for tax purposes rather than rely on the "not found out rule", as was often possible in the past. Finally, in cases where this advice has not been followed, there is a section on regularising under-declared assets.Key areas of commentary including the introductory section, are followed by a short set of revision questions and answers so that readers can self-test whether they have grasped the key points.

Book excerpt: The fourth edition of the leading company law textbook, provides the most authoritative and comprehensive commentary on Irish company law following the commencement of the Companies Act 2014. The Companies Act 2014 makes the most far-reaching and fundamental changes to Irish company law in two generations, putting forward a radically different approach whereby the private company limited by shares will become the new model company. The structure of the fourth edition of this highly regarded title mirrors this new Act. The Act commences on 1 June 2015 and introduces significant changes for companies operating in Ireland. This work has been expanded and revised to account for these legislative changes and important case law. As chairperson of the Company Law Review Group, whose recommendations greatly informed the new Act and as a leading practitioner of company law, Tom Courtney has a unique insight to the new legislation, its purpose and interpretation. The fourth edition is virtually a complete re-write and at approximately 2,900 pages it is some 400 pages longer than the last edition. Fully updated to take account of the dozens of judgments from the Irish and UK courts that have been delivered since the previous edition as well as the new statutory provisions, the fourth edition of The Law of Companies is a 'must have' for all practitioners, students and users of Irish company law.

As well as mediators, this work will be indispensable for practitioners and scholars across a wide range of fields, including social work and law. It draws on a wide cross-disciplinary theoretical literature and on the author's extensive and continuing practice experience. It encompasses developments in policy, research and practice in the UK and beyond. Roberts presents mediation as an aid to joint decision-making in the context of a range of family disputes, notably those involving children. Mediation is seen as a process of intervention distinct from legal, social work and therapeutic practice, drawing on a distinctive body of knowledge across disciplinary fields including anthropology, psychology and negotiation theory. Incorporating empirical evidence, the book emphasizes the value of mediation in mitigating the harmful effects of family breakdown and conflict. First published in 1988 as a pioneering work, this third edition has been fully updated to incorporate legal and policy developments in the UK and in Europe, new sociological and philosophical perspectives on respect, justice and conflict, and international research and practice innovations.

Available in PDF, EPUB and Kindle. Book excerpt: Despite recent advances in important aspects of the lives of girls and women, pervasive challenges remain. These challenges reflect widespread deprivations and constraints and include epidemic levels of gender-based violence and discriminatory laws and norms that prevent women from owning property, being educated, and making meaningful decisions about their own lives--such as whether and when to marry or have children. These often violate their most basic rights and are magnified and multiplied by poverty and lack of education. This groundbreaking book distills vast data and hundreds of studies to shed new light on deprivations and constraints facing the voice and agency of women and girls worldwide, and on the associated costs for individuals, families, communities, and global development. The volume presents major new findings about the patterns of constraints and overlapping deprivations and focuses on several areas key to women s empowerment: freedom from violence, sexual and reproductive health and rights, ownership of land and housing, and voice and collective action. It highlights promising reforms and interventions from around the world and lays out an urgent agenda for governments, civil society, development agencies, and other stakeholders, including a call for greater investment in data and knowledge to benchmark progress.
