Book Synopsis Ambiguous Justice by : Vanessa Ann Gunther
Download or read book Ambiguous Justice written by Vanessa Ann Gunther and published by American Indian Studies. This book was released on 2006 with total page 212 pages. Available in PDF, EPUB and Kindle. Book excerpt: The legal system of Southern California has been used by Anglo populations as a social and demographic tool to control Native Americans. Following the Mexican-American War and the 1849 Gold Rush, as California property values increased and transportation corridors were established, Native Americans remained a sharply declining presence in many communities, and were likely to be charged with crimes. The sentences they received were lighter than those given to Anglo offenders, indicating that the legal system was used as a means of harassment. Many believed that the Indians of Southern California would fade from history because of their inability to adapt to a changing world. While many aspects of their traditional culture have been irreparably lost, the people of southern California are, nevertheless, attempting to recreate the cultures that were challenged by the influx of Europeans and later Americans to their lands.

Book Synopsis Judging Statutes by : Robert A. Katzmann
Download or read book Judging Statutes written by Robert A. Katzmann and published by Oxford University Press. This book was released on 2014-08-14 with total page 256 pages. Available in PDF, EPUB and Kindle. Book excerpt: In an ideal world, the laws of Congress--known as federal statutes--would always be clearly worded and easily understood by the judges tasked with interpreting them. But many laws feature ambiguous or even contradictory wording. How, then, should judges divine their meaning? Should they stick only to the text? To what degree, if any, should they consult aids beyond the statutes themselves? Are the purposes of lawmakers in writing law relevant? Some judges, such as Supreme Court Justice Antonin Scalia, believe courts should look to the language of the statute and virtually nothing else. Chief Judge Robert A. Katzmann of the U.S. Court of Appeals for the Second Circuit respectfully disagrees. In Judging Statutes, Katzmann, who is a trained political scientist as well as a judge, argues that our constitutional system charges Congress with enacting laws; therefore, how Congress makes its purposes known through both the laws themselves and reliable accompanying materials should be respected. He looks at how the American government works, including how laws come to be and how various agencies construe legislation. He then explains the judicial process of interpreting and applying these laws through the demonstration of two interpretative approaches, purposivism (focusing on the purpose of a law) and textualism (focusing solely on the text of the written law). Katzmann draws from his experience to show how this process plays out in the real world, and concludes with some suggestions to promote understanding between the courts and Congress. When courts interpret the laws of Congress, they should be mindful of how Congress actually functions, how lawmakers signal the meaning of statutes, and what those legislators expect of courts construing their laws. The legislative record behind a law is in truth part of its foundation, and therefore merits consideration.
Book Synopsis A Bird In Your Hand by : Jeffrey Alan John
Download or read book A Bird In Your Hand written by Jeffrey Alan John and published by . This book was released on 2018-07-12 with total page 236 pages. Available in PDF, EPUB and Kindle. Book excerpt: A Bird in Your Hand is a true tale of crime, punishment, and justice in mid-20th century Ohio. Two young men set out on a joy ride across the state, looking for fun and romance, but instead they're caught up in the murder of a police officer. The story, spanning 40 years, weaves together the many aspects of their case and its aftermath. Author Frank Johnson, son of the trial's presiding judge, reveals the personal side of making life-or-death decisions. Author Jeff John, an educator and journalist, uses meticulous detail to bring court documents, interviews, and research to life. This little-known case of ambiguous justice connects in big ways to our changing legal system and the rights of the accused, from the Miranda Rights decision to the controversial Ohio governor's prisoner work program still in place today.

Book Synopsis Ambiguous Antidotes by : Hilaire Kallendorf
Download or read book Ambiguous Antidotes written by Hilaire Kallendorf and published by University of Toronto Press. This book was released on 2017-10-31 with total page 361 pages. Available in PDF, EPUB and Kindle. Book excerpt: Chastity and lust, charity and greed, humility and pride, are but some of the virtues and vices that have been in tension since Prudentius’ Psychomachia, written in the fifth century. While there has been widespread agreement within a given culture about what exactly constitutes a virtue or a vice, are these categories so consistent after all? In Ambiguous Antidotes, Hilaire Kallendorf explores the receptions of Virtues in the realm of moral philosophy and the artistic production it influenced during the Spanish Golden Age. Using the Derridian notion of pharmakon, a powerful substance that can serve as poison and cure, Kallendorf’s original and pioneering insight into five key Virtues (justice, fortitude, chastity, charity, and prudence) reveals an intriguing but messy relationship. Rather than being seen as unambiguously good antidotes, the Virtues are instead contested spaces where competing sets of values jostled for primacy and hegemony. Employing an arsenal of tools drawn from literary theory and cultural studies, Ambiguous Antidotes confirms that you can in fact have too much of a good thing.
