Book excerpt: Excerpt from A Selection of Cases and Other Authorities on Civil Procedure in Actions at Law This collection of cases and other authorities is intended primarily for the use of students who are beginning the study of the law. About five years ago, when the editor began his work as a teacher of law in the Harvard Law School, he decided to enlarge the course on Pleading in that school into a course on Civil Procedure. It seemed that it would make the subject easier for the student to understand if he were shown how an action is carried through the courts, and if he were taught Pleading in its proper relation to the other steps in an action. In the selection and arrangement of the material, the editor has had in mind the needs of the first-year student who, though familiar in a general way with parts of the substantive law, has no knowledge of procedure except as he may have derived from the daily newspapers some notions of legal forensics. The cases cited in the footnotes are not for the most part merely cumulative. They are intended to suggest variations of the problems presented in the principal cases, and are adapted for use as hypothetical cases in the class-room. The names and arguments of counsel have been omitted. Other omissions are duly indicated. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from The Practice Special Actions Courts of Record: State of New York, Under the Code of Civil Procedure and Statues, With Forms The aim of this work is to supplement the Special Proceedings which has been so favorably received by the Bar. As stated in the preface to that work, very many legal proceedings once termed special have, under the Code of Civil Procedure, become Actions. These actions are, so far as they are treated by the second part of the Code, special in the sense that the ordinary rules of practice are not applicable to them, and that to a greater or less extent specific rules are enacted relative to their conduct. Hence this work treats of special actions, including those treated by Mr. Crary in his work on Special Proceedings, together with all others which are defined and provided for by sections 1496 to 1990 of the present Code. Book excerpt: Civil Procedure: Cases and Problems, Fifth Edition covers all topics in the first-year canon of civil procedure, and some topics in advanced litigation classes (e.g., class actions, appeals). The casebook is organized with the reality and complexities of civil litigation in mind, and follows the litigation sequence, from pleading through preclusion. Each chapter takes a practical as well as analytical approach, through (a) a series of Supreme Court and lower court opinions, (b) notes preceding and following those opinions intended to explain the underlying doctrines and principles behind them, and (c) problems intended to assess and refine students understanding of doctrines and their rationales. Ultimately, this casebook demands that students read carefully and at a detailed level, analyze critically, and apply the law from the perspective of the theories underlying the various doctrines. It provides an effective vehicle through which to teach legal analysis and to gently nudge students forward and deeper into the materials.

Book excerpt: Reprint of a title from the Judicial Administration Series published by the National Conference of Judicial Councils. Originally published: New York: Published by the Law Center of New York University for the National Conference of Judicial Councils, 1952. xvi, 534 pp. Written near the end of Millar's career, the present study is a brilliant summary of his life's work. It discusses antecedents of the Anglo-American system, the evolution of procedure and American and English civil procedure in the nineteenth century. Other chapters discuss the development of specific areas, such as introduction of the cause, mode of trial and voluntary dismissal. "In a society which so often confuses quantity with quality - or at least tends to regard quantity as a necessary ingredient of quality - it is not surprising that American legal texts labeled "great" have generally been multi-volumed ones. While the number of volumes certainly does not detract from the worth of a Williston on Contracts or a Wigmore on Evidence, their sheer size has made them more easily recognizable, in our society, as classics. On the other hand, the single volume American law books receiving the label of greatness would make a sparse list indeed. To this elite list must now be added Professor Millar's Civil Procedure of the Trial Court in Historical Perspective." --Philip P. Kurland, Harvard Law Review 66 (1952-1953) 1542 Robert Wyness Millar [1876-1959], a professor at Northwestern University Law School, was a leading authority on civil procedure and its history. Miller 1937 Millar was the author of The Old Regime and the New in Civil Procedure (1937) and, with co-author Arthur Engelmann, A History of Continental Civil Procedure (1927).

Sophisticated, yet straightforward, the text strikes an important balance by providing clear exposition while requiring work to achieve deeper insights. An opening chapter gives an overview of the entire process, using real pleadings and discovery materials in the landmark N.Y. Times v. Sullivan case. The innovative “Anatomy of a Litigation” case study chapter systematically leads students from pleadings to verdict, using leading cases to deepen the connection between the classroom and the courtroom. Civil Procedure: Theory and Practice covers the full range of topics, including in-depth treatment of personal and subject-matter jurisdiction, joinder, preclusion, and alternative dispute resolution.

Book excerpt: Excerpt from Practice and Pleading in Actions in the Courts of Record in the State of New York, Under the Code of Procedure, and Other Statutes, When Applicable: With an Appendix of Forms The author has, on the other hand, omitted from the present edition his former brief notice of independent special proceedings, and also the concluding chapter as to the retrospective effect of the Code. The latter subject has become practically obsolete; the former is, in fact, foreign to the plan of the work. That plan remains substantially the same as before. The progress of a suit in the higher courts of the state is traced, from its origin and preliminaries, down to its final determination; practical directions being given for its conduct and management, in each step which may be necessary or advisable during that progress. The provisions of the Code, of the Revised or General Statutes, and of the Rules of the Courts, which bear upon each particular division of the general subject, are, on the present occasion, cited in the body of the work, instead of being subjoined at its close. An appendix of forms is added, as heretofore, and each volume closes with an index of the subjects considered in it. The first embraces all matters connected, directly or indirectly, with the commencement and progress of a suit, down to the preparation and service of the complaint, inclusive; the second, all subsequent stages of procedure, in that suit, down to its close. Spaulding, and new co-author Myriam Gilles (the #5 most cited civil procedure scholar in the country) is the ideal casebook for the modern Civil Procedure course. With lightly-edited cases, both canonical and contemporary, and engaging hypothetical problems, the Seventh Edition of Civil Procedure: Cases and Problems promotes student understanding of modern procedure, the adversary system and alternatives, the relationship between substance and procedure, and systemic problems in access to justice. This casebook pioneered the “due process approach” to the study of procedure and is designed to create an inclusive learning environment, emphasizing the formative role of public interest litigation in modern procedural law and the voices of women and people of color in shaping the field in both practice and scholarship. It is the only major casebook on the market written by co-authors who together have received more than a dozen awards for excellence in teaching. New to the Seventh Edition: Shorter notes and materials after principal cases Updated cases and materials on personal and subject matter jurisdiction, plausibility pleading, affirmative defenses, the new proportionality requirement in discovery, and more Revised and expanded treatment of arbitration and ADR Revised and expanded treatment of MDL Revised and streamlined treatment of class action doctrine Revised and streamlined treatment of preclusion Professors and students will benefit from: Lightly-edited cases paired with thoughtful notes and questions. Concise examination of scholarship and empirical data bearing on various procedural rules Close attention to the underlying social and economic contexts in which the rules function with emphasis on the consequences for vulnerable populations Meaningful discussion of oft-marginalized topics, including: Alternative Dispute Resolution, Discovery (including e-discovery), Aggregate Litigation, Remedies, Adversary Ethics, and Trial Practice. Hypothetical problems presented in each chapter and revisited in later chapters to support in-class exercises and awareness of how phases of litigation influence each other. A casebook designed to create an inclusive classroom experience
