Oliveira traces how existing commercial networks adapted to changes in the Atlantic slave trade during the first half of the nineteenth century. Slave Trade and Abolition reveals how women known as donas (a term adapted from the title granted to noble and royal women in the Iberian Peninsula) were often important cultural brokers. Acting as intermediaries between foreign and local people, they held high socioeconomic status and even competed with the male merchants who controlled the trade. Oliveira provides rich evidence to explore the many ways this Luso-African community influenced its society. In doing so, she reveals an unexpectedly nuanced economy with regard to the dynamics of gender and authority.

Book excerpt: Why did it take so long to end slavery in the United States, and what did it mean that the nation existed eighty-eight years as a “house divided against itself,” as Abraham Lincoln put it? The decline of slavery throughout the Atlantic world was a protracted affair, says Patrick Rael, but no other nation endured anything like the United States. Here the process took from 1777, when Vermont wrote slavery out of its state constitution, to 1865, when the Thirteenth Amendment abolished slavery nationwide. Rael immerses readers in the mix of social, geographic, economic, and political factors that shaped this unique American experience. He not only takes a far longer view of slavery's demise than do those who date it to the rise of abolitionism in 1831, he also places it in a broader Atlantic context. We see how slavery ended variously by consent or force across time and place and how views on slavery evolved differently between the centers of European power and their colonial peripheries—some of which would become power centers themselves. Rael shows how African Americans played the central role in ending slavery in the United States. Fueled by new Revolutionary ideals of self-rule and universal equality—and on their own or alongside abolitionists—both slaves and free blacks slowly turned American opinion against the slave interests in the South. Secession followed, and then began the national bloodbath that would demand slavery's complete destruction.

Yet, as this book shows, the slave trade and abolition resound in international criminal law in multiple ways. Its central focus lies in a close examination of the often-controversial litigation, in the first part of the nineteenth century, arising from British efforts to capture slave ships, much of it before Mixed Commissions. With archival-based research into this litigation, it explores the legal construction of so-called ‘recaptives’ (slaves found on board captured slave ships). The book argues that, notwithstanding its promise of freedom, the law actually constructed recaptives restrictively. In particular, it focused on questions of intervention rather than recaptives’ rights. At the same time it shows how a critical reading of the archive reveals that recaptives contributed to litigation in important, but hitherto largely unrecognized, ways. The book is, however, not simply a contribution to the history of international law. Efforts to deliver justice through international criminal law continue to face considerable challenges and raise testing questions about the construction – and alternative construction – of victims. By inscribing the recaptive in international criminal legal history, the book offers an original contribution to these contentious issues and a reflection on critical international criminal legal history writing and its accompanying methodological and political choices.
