The summer of 2020 witnessed the birth of Advocates of Silenced Turkey’s first internship opportunity geared towards college students around the world. We were fueled by a desire to involve youth in academic studies of injustice by allowing them the opportunity to apply their skills outside of their courses. Coming from all walks of life, our first interns utilized their academic abilities to shed light on the rampant human rights abuses facing women and their children in Turkey following the orchestrated coup attempt in 2016 which consolidated the regime’s power. Through collaborative efforts, the interns each produced a paper outlining the story of a family navigating the Turkish legal system. In this booklet you will find six reports whose individual stories are weaved together through the connective tissue of systematic government persecution and injustice.

Only a small percentage dare to challenge their mistreatment in court. Facing domestic police and judges who often refuse to recognize discrimination, a small minority of activists have exhausted their domestic appeals and then turned to their last hope: the European Court of Human Rights (ECtHR). The ECtHR, located in Strasbourg, France, is widely regarded as the most effective international human rights court in existence. Russian citizens whose rights have been violated at home have brought tens of thousands of cases to the ECtHR over the past two decades. But only one of these cases resulted in a finding of gender discrimination by the ECtHR-and that case was brought by a man. By comparison, the Court has found gender discrimination more frequently in decisions on Turkish cases. Courting Gender Justice explores the obstacles that confront citizens, activists, and lawyers who try to bring gender discrimination cases to court. To shed light on the factors that make rare victories possible in discrimination cases, the book draws comparisons among forms of discrimination faced by women and LGBT people in Russia and Turkey. Book excerpt: This book evaluates the effectiveness of current international human rights law, and in particular the recent Istanbul Convention, in eradicating so-called honour killings in Turkey. So-called ‘honour killings’ have become an issue of concern for the international community. In Turkey, in particular, the practice still exists despite the adoption of the relevant human rights instruments. The book argues that the improvement of the status of women in Turkey in accordance with gender equality as well as the application of the principle of state due diligence, both requirements of the Istanbul Convention and international human rights law, are fundamental means towards eradicating the killing of women in the name of ‘honour’. Using feminist approaches, in particular the intersectionality approach, the study looks at the application of such standards as well as the current obstacles. Through such a lens, the study discusses the strengths and weaknesses of the Turkish Constitution, Turkish Civil Code, Turkish Penal Code and Law to Protect Family and Prevent Violence Against Women and questions the judicial approach to the implementation of the women’s right to life. It identifies the lacunae in the Turkish legislation that allow inadequate legal protection for women and the inconsistency of the judicial approach to the definition of the so-called honour killings in the judgements. The study then recommends some concrete amendments to the relevant legal provisions in order to better reflect the international framework and the feminist approaches. The book will be a valuable resource for academics, researchers and policy-makers in the areas of international human rights law and feminist legal theory.

This report documents the experiences of women in Istanbul, Ankara, Izmir, Van, Trabzon, and Diyarbakır who endured violence and sought help from the state. Women we interviewed described brutal and long-lasting violence by husbands, in-laws, and other family members. Human Rights Watch documented women and girls as young as fourteen being raped, stabbed, kicked in the abdomen when pregnant, beaten with hammers, sticks, branches, and hoses to the point of broken bones and fractured skulls, locked up with dogs or other animals, starved, shot with a stun gun, injected with poison, pushed off a rooftop, and subjected to severe psychological violence. Despite some impressive law reforms to address violence against women in Turkey, including the availability of civil protection orders, there are gaps in law and even greater failings in implementation, making the protection system unpredictable at best. Domestic violence shelters in Turkey, far too few to meet the demand, exclude certain categories of women, and in some cases have poor conditions and inadequate security. The Turkish government should amend the family protection law to fill the gaps and should systematically and proactively improve its implementation. Failing to do so constitutes not just a violation of Turkish law, but also violations of international and regional human rights law.

Book excerpt: To trace women's experience of and the feminist struggle against domestic violence by male spouses (the major form of gender-based violence addressed by second-wave feminism in Turkey) from the late 1980s till today, we conducted an 18-month research project titled "Domestic Violence and the Struggle against It," supported by TÜBİTAK (The Scientific and Technological Research Council of Turkey). The project had two legs. First, based on in-depth interviews and focus group discussions, our research aimed at analyzing the mechanisms of empowerment, support, and awareness-raising developed by women's organizations at both the national and the local level, and to discuss the factors that contribute to the success, as well as the challenges and limitations of this organizing. Between February 2006 and June 2007, we interviewed more than 150 feminist activists from close to 50 organizations in 27 cities. Second, we conducted a nationwide representative survey in spring 2007. Based on face-to-face interviews with 1,800 ever-married women from a total of 56 provinces, this survey was the second nationwide study on domestic violence (first being a 1993 survey). The questionnaire for the survey was developed after a year of in-depth interviews with activists in women's or-activists specializing in this field. Besides this participatory process of survey preparation, an indispensable component of the feminist methodology we tried to adopt was approaching the women to be interviewed for the survey as "subjects" in the debate on domestic violence. This required a move away from a focus on women's "experience" of violence towards a questionnaire design that would help bring out their views on the background, legitimacy, prevention, and penalization of spousal violence. As we discuss in greater detail in the coming pages, the survey ended up having three parts: 1) what women think about domestic violence by their spouses (background and legitimacy), 2) women's experience of domestic violence by their spouse, and 3) women's views on prevention and penalization (with a particular emphasis on the role of the state).
