Book excerpt: Traditionally, differences in states' refugee protection contributions have been attributed to the variation in countries' structural pull-factors such as their geographic location. However, policy choices, such as Germany's decision to open its borders for Syrian refugees in 2015, can also have a significant impact on the number of arrivals and constitute a puzzle that traditional approaches struggle to explain. This paper demonstrates that viewing refugee burden-sharing through the lens of public goods theory can provide significant insights about refugee protection dynamics in the EU, in particular in the context of a sudden mass influx of migrants that threatens internal security. By highlighting how free-riding and burden-shifting dynamics can undermine the provision of collective goods during a refugee crisis, a public goods approach can advance our understanding of why countries sometimes accept disproportionate responsibilities for forced migrants and how the effectiveness of EU refugee burden-sharing instruments can, and should, be strengthened.

Book excerpt: This article shows that the refugee burdens among Western states are also very unequally distributed and that this constitutes a problem not only for individual states, but also for the EU as whole. It argues that despite many obstacles, the development of regional or international burden sharing regimes is indeed desirable. Attempts to explain or justify steps towards such a system do not have to rely solely on notions of solidarity but can be justified by more traditional interest-based motivations. However, it suggests that the EU's main burden-sharing initiatives which rely largely on policy harmonisation will not achieve the Union's objectives in this area. It will be argued that market-based burden-sharing mechanisms need to be explored further and that such market driven policies when combined with policy harmonisation and quota-based initiatives are likely to contribute to a more equitable, efficient and effective refugee burden-sharing system.

In the contemporary world, we see two major opposing trends. The first involves nationalistic and populistic movements. Transnational solidarity has been under pressure for a decade because of, among others, global economic and migration crises, leading to populistic and authoritarian leadership in some European countries, the United States and Brazil. Countries withdraw from international commitments on climate, trade and refugees and the European Union struggles with Brexit. The second trend, partly a reaction to the first, is a strengthened transnational grass-root community – a cosmopolitan movement – which protests primarily against climate change. Based on interdisciplinary reflections on the concept of transnational solidarity, its challenges and opportunities are analysed, drawing on Europe as a focal case study for a broader, global perspective.

Governments of both North and South are withdrawing from the international legal duty to provide potentially indefinite protection to any and all refugees who arrive at their borders. The challenge is to reconceive refugee protection in a way that is reconcilable with the legitimate concerns of modern states, yet which does not sacrifice the critical right of at-risk people to seek asylum. The essays in Reconceiving International Refugee Law offer a response to the concerns of many states that refugee protection has become no more than a `back door' route to permanent immigration, and that its costs are not fairly apportioned among states. Drawing on the research of leading migration scholars from around the world, and vetted through dialogue with senior officials and non-governmental experts, this volume explores the potential for a shift to a robust and empowering system of temporary asylum, supported by a pragmatic system of guarantees to share both the costs and human responsibilities of refugee protection.

Book excerpt: Refugee Protection and Solidarity looks to define the duties that EU member states have towards each other in the field of refugee protection, employing analytical tools of normative political theory to bring moral clarity to a highly divisive debate on both principles and political feasibility. There is a discrepancy between the commitment to solidarity enshrined in EU law and the reality of asylum provision in the EU. The events related to the EU 'migration crisis' of 2015/16 have exposed this discrepancy and questioned the nascent notion of EU solidarity at its core. The book argues that the debate on distributive justice in the EU fails to consider refugee protection as a field in which distributive duties apply in ways similar to other domains such as social policy, as well as exploring what justifications states invoke to justify non-compliance with their duties. Eleonora Milazzo contends that, as currently framed, the debate on the ethics of refugee protection fails to account for the nature and effect of associational ties among states in relation to asylum provision, which is important for the assessment of responsibility shirking.

Book excerpt: This book fills a significant lacuna in our understanding of the refugee crisis by analyzing the dynamics that lie behind fifteen years of asylum policies in the European Union. It sheds light on why cooperation has led to reinforced refugee protection on paper but has failed to provide it in practice. Offering innovative empirical, theoretical and methodological research on this crucial topic, it argues that the different asylum systems and priorities of the various Member States explain the EU's lack of initiative in responding to this humanitarian emergency. The author demonstrates that the strong regulators of North-Western Europe have used their powerful bargaining positions to shape EU asylum policies decisively, which has allowed them to impose their will on Member States in South-Eastern Europe. These latter countries, having barely made a mark on EU policies, are now facing significant difficulties in implementing them. The EU will only identify potential solutions to the crisis, the author concludes, when it takes these disparities into account and establishes a functioning common refugee policy. This novel work will appeal to students and scholars of politics, immigration and asylum in the EU.
