Available in PDF, EPUB and Kindle. Book excerpt: Exploring the little-known history behind the legal doctrine of prior appropriation--"first in time is first in right"--used to apportion water resources in the western United States, this book focuses on the important case of Wyoming v. Colorado (1922). U.S. Supreme Court Associate Justice Willis Van Devanter, a former Chief Justice of Wyoming, ruled in that state's favor, finding that prior appropriation applied across state lines--a controversial opinion influenced by cronyism. The dicta in the case, that the U.S. Government has no interest in state water allocation law, drove the balkanization of interstate water systems and resulted in the Colorado River Interstate Compact between Wyoming, Colorado, Utah, New Mexico, Arizona, Nevada and California. The exhaustive research that has gone into this book has uncovered the secret that Associate Justice Van Devanter had waited eleven years to publish his opinion in this important, but politically self-serving, case, at last finding a moment when his senior colleagues were sufficiently absent or incapacitated to either concur or dissent. Without the knowledge of his "brethren," save his "loyal friend" Taft, and without recusal, Van Devanter unilaterally delivered his sole opinion to the Clerk for publication on the last day of the Supreme Court's October 1921 Term.

Available in PDF, EPUB and Kindle. Book excerpt: Western Water A to Z is the first ever field guide to Western water. Reinventing this twentieth-century genre for a twenty-first-century audience, Robert R. Crifasi answers questions about rivers, water projects, the culture of water, the ecosystems water projects have created or destroyed, and the reliance of cities, farms, and industries on this critical resource. Organized as a collection of terms, the book addresses the most salient water issues and provides helpful background information regarding their origins and implications. Photographs serve a vital role in the cultural dialogue on water and stand as an equal partner to the text. Each subject is covered in about one page and is accompanied by one or two striking images from famous photographers like Margaret Bourke-White, Carleton E. Watkins, Arthur Rothstein, William Henry Jackson, and Dorothea Lang as well as Crifasi’s own work. Water often finds itself at the center of our cultural discourse in art, cinema, and literature, which play essential roles in shaping our understanding and experience of Western water. Crifasi also engages personalities that are nearly synonymous with Western water—John Wesley Powell, Elwood Mead, and Floyd Dominy, among others—to show how their lives intertwined with and often influenced the course of water development across the region. Travelers, adventurers, students, and anyone interested in water will find Western Water A to Z a handy and entertaining reference guide.

Available in PDF, EPUB and Kindle. Book excerpt: The American West faces many challenges, but none is more important than the challenge of managing its water. This book examines the role that water transfers can play in allocating the region's scarce water resources. It focuses on the variety of third parties, including Native Americans, Hispanic communities, rural communities, and the environment, that can sometimes be harmed when water is moved. The committee presents recommendations to guide states, tribes, and federal agencies toward better regulation. Seven in-depth case studies are presented: Nevada's Carson-Truckee basin, the Colorado Front Range, northern New Mexico, Washington's Yakima River basin, central Arizona, and the Central and Imperial valleys in California. Water Transfers in the West presents background and current information on factors that have encouraged water transfers, typical types of transfers, and their potential negative effects. The book highlights the benefits that water transfers can bring but notes the need for more third-party representation in the processes used to evaluate planned transfers.

Available in PDF, EPUB and Kindle. Book excerpt: Building water resilience is the single biggest challenge in a changing global climate. The United States faces a water crisis as critical as the energy crisis that once dominated headlines. Like the energy crisis, a solution can be found. Pat Mulroy, for many years general manager of the Southern Nevada Water Authority, the lead negotiator on the Colorado River for the State of Nevada, and a Brookings fellow, has gathered a number of practitioners and scholars to show us why we face a crisis caused by climate change and what we can do to alleviate it. While the focus recently has been on California, with its water restrictions and drought, many other parts of the United States are also suffering from current and potential water shortages that will only be exacerbated by climate change. The Water Problem takes us to Miami and the problem of rising oceans fouling freshwater reservoirs; Kansas and Nebraska, where intensive farming is draining age-old aquifers; and to the Southwest United States, where growing populations are creating enormous stresses on the already strained Colorado River. Mulroy and her contributors explore not just the problems, but also what we can do now to put in place measures to deal with a very real crisis.

Book excerpt: The question of whether the earth's climate is changing in some significant human-induced way remains a matter of much debate. But the fact that climate is variable over time is well known. These two elements of climatic uncertainty affect water resources planning and management in the American West. Managing Water Resources in the West Under Conditions of Climate Uncertainty examines the scientific basis for predictions of climate change, the implications of climate uncertainty for water resources management, and the management options available for responding to climate variability and potential climate change.
