Vor dem Hintergrund der spatestens seit der Berliner Rede des deutschen AuBenministers Fischer vom 12. Mai 2000 mit unerwarteter Vehemenz losgebrochenen Debatte urn die Finalitat des europaischen Integrationsprozesses und die Notwendigkeit einer europaischen Verfassung muBte zudem jedwede Initiative der Union im Bereich der Grundrechte eine besondere Bedeutung erlangen, da sie aIs erster Schritt in Richtung einer solchen europaischen Verfas sung interpretiert werden konnte. Dem Vertragsdokument, das noch von allen Mitgliedsstaaten außer Spanien ratifiziert werden muss, kommt aus unterschiedlichen Gründen eine beachtliche Bedeutung zu. Zum einen wird es alle Einzelverträge der EU, die in den letzten 50 Jahren geschlossen worden sind, ersetzen und ein eigenständiges Verfassungsdokument darstellen. Darüber hinaus soll es die Leistungsfähigkeit des politischen Systems der EU sicherstellen und die Handlungsfähigkeit der EU, beispielsweise durch eine neue Definition der qualifizierten Mehrheit für Entscheidungen im Ministerrat, auch mit 25 Mitgliedern gewährleisten. Das politische System der EU weist bis dato weitestgehend die Strukturen des demokratietheoretischen Modells der Konsensdemokratie auf, wie in Kapitel 3 gezeigt werden soll. Institutionelle Veränderungen, wie die neue Definition der qualifizierten Mehrheit, die Abschaffung der turnusmäßigen Ratspräsidentschaft oder die Reduzierung der Mitglieder der Kommission, geben Anlass zur Frage, ob das politische System der EU auch angesichts solcher Anpassungsprozesse nach wie vor Strukturen des Modells der Konsensdemokratie aufweist. Oder hat der institutionelle Wandel auch dazu geführt, dass nun eher die Mehrheitsdemokratie als Referenzmodell zum politischen System der EU herangezogen werden sollte? Diese Frage soll Gegenstand dieser Hausarbeit sein. In Kapitel 2 soll zunächst der Unterschied zwischen den demokratietheoretischen Modellen der Konsens- und Mehrheitsdemokratie in Anlehnung an Lijphart (1999) dargestellt werden. Darauf aufbauend soll in Kapitel 3 gezeigt werden, dass das politische System der EU auf dem Stand von Nizza die zentralen Prämissen der Konsensdemokratie aufweist. Dies soll anhand von 10 Kriterien zur Operationalisierung des Begriffs der Konsensdemokratie geschehen, die Lijphart (1999) in seinem Buch Patterns of Democracy vorschlägt. Drei wesentliche Reformaspekte der EU-Verfassung, nämlich die neue Definition der qualifizierten Mehrheit, die Abschaffung der turnusmäßigen Ratspräsidentschaft und die Reduzierung der Mitglieder der Kommission, sollen in Kapitel 4 aufgezeigt und komparativ zum bisherigen Stand von Nizza dargestellt werden. Institutionelle Veränderungen sollen hier deutlich gemacht werden. In Kapitel 5 soll schließlich bewertet werden, ob die EU durch die aufgezeigten institutionellen Anpassungen sich dem mehrheitsdemokratischen Modell angenähert hat.
