Available in PDF, EPUB and Kindle. Book excerpt: EU member nations must decide whether to ratify the Nice Treaty. This report, written to inform these decisions, is highly critical of the Treaty but argues that it should be passed since it is 'repairable' and rejecting it would delay Eastern enlargement. It proposes two 'emergency repairs' to the Treaty. The authors marshal the best available empirical evidence and analytic techniques to show that the Treaty fails to meet its goal of adjusting EU decision-making to the realities of a Union with 27& members. Far from maintaining the EU's ability to act after enlargement, the authors argue that the Nice reforms reduce EU27 decision-making efficiency below what it would have been with no reform. Unless the Treaty is mended, future integration will be guided by intergovernmental initiatives in which large members play a large role due to their economic dominance. The Treaty also fails to resolve the ECB's 'numbers problem' - enlargement without reform would also damage the ECB's decision-making capacity. The Treaty does include an 'enabling clause' to help solve this problem: the report analyses the possible solutions and proposes specific reforms.

Book excerpt: Immediately after the rejection of the Constitutional Treaty in France and in the Netherlands, I was tempted not to comply with a contract according to which I was expected to write on the Eu- pean Constitution within a very close deadline. “What is the sense of it now?” I tried to argue. “I cannot be obliged by a contract wi- out an object”. I was wrong at that time and we would be equally wrong now, should we read the Irish vote on the Lisbon Treaty and the Lisbon Treaty itself as the dead end for European constitutionalism. Let us never forget that the text rejected in May 2005 was not the founding act of such constitutionalism. To the contrary, it was nothing more than a remarkable passage in a long history of constitutional dev- opments that have been occurring since the early years of the Eu- pean Community. All of us know that the Court of Justice spoke of a European constitutional order already in 1964, when the primacy of Community law was asserted in the areas conferred from the States to the European jurisdiction. We also know that in the pre- ous year the Court had read in the Treaty the justiciable right of any European citizen to challenge her own national State for omitted or distorted compliance with European rules.

Book excerpt: The Draft European Constitution was arguably both an attempt to constitutionalise the Union, re-framing that project in the language of the state, and an attempt to stretch the boundaries of constitutionalism itself, re-imagining that concept to accommodate the sui generis European Union. The (partial) failure of this project is the subject of this collection of essays. The collection brings together leading EU constitutional scholars to consider, with the benefit of hindsight, the purportedly constitutional character of the proposed Constitutional Treaty, the reasons for its rejection by voters in France and the Netherlands, the ongoing implications of this episode for the European project, and the lessons it teaches us about what constitutionalism really means.

Available in PDF, EPUB and Kindle. Book excerpt: The European Union faces a crossroads in the twenty-first century. While there is evidence of declining enthusiasm for European integration, the EU plays an increasingly vital role in tackling problems that can no longer be dealt with at member state level. In recent years, the EU has developed a stronger foreign, security and defence policy, and has had to face up to the challenges of tackling organised crime, human trafficking and drug smuggling. In this fully updated new edition, Alasdair Blair examines the economic, political, social and personal factors that have shaped the process of European integration from the end of the Second World War until the Lisbon Treaty in 2009. Written in a clear and jargon-free style, the book explores: The context of European integration and expansion The relations between the European Union and its member states The institutional evolution of the European Union Methods of decision-making Key policies of the European Union The future direction of the European Union Comprehensive and accessible, this book is an essential guide to understanding the relevance of the European Union in the twenty-first century.
