Book excerpt: … Se han dictado nuevas sentencias interpretando los principios de urbanismo sostenible que se han recogido en la Ley del Suelo del año 2007 y su posterior Texto Refundido de 2008 que deben ser destacadas ya que esta ley se dictó precisamente para intentar poner coto a los excesos de la época anterior y es ahora cuando se puede apreciar el alcance exacto de estos principios, una vez que son aplicados por los tribunales a la hora de enjuiciar los casos concretos que se plantean en vía judicial, ya que no se trata de meros principios retóricos o criterios meramente inspiradores o generales, sino auténticos preceptos legales que, como tales, deben ser observados por todos, y muy especialmente por los planificadores y las administraciones públicas a la hora de redactar el planeamiento. Esto nos ha llevado a continuar con la labor de seleccionar y comentar estas sentencias y fruto de este trabajo es el segundo volumen de esta obra que el lector tiene en sus manos. Es cierto que la situación de crisis económica, que está incidiendo con especial gravedad en el campo inmobiliario, unido a la difícil situación económica de las administraciones públicas, que casi se han paralizado para reducir los abultados déficit públicos que se han alcanzado con carácter general en los últimos ejercicios, y el elevado número de viviendas construidas sin que puedan ser absorbidas por una demanda casi inexistente han motivado que no se inicien nuevos desarrollos urbanísticos dando una imagen, no sabemos si real o no, de que el problema del crecimiento alocado ya ha pasado y no se volverá a caer en los mismos errores. Aunque sólo el tiempo podrá responder a esta cuestión (pensemos cuentos interrogantes pueden surgir al amparo de la nueva Ley de Costas recientemente modificada) la verdad es que la nueva ley del suelo ha establecido unos cambios muy importantes en el derecho urbanístico español que quizás las administraciones no se han dado cuenta todavía del alcance efectivo que va a suponer en los próximos años, al menos hasta que haya una nueva modificación de la ley, cosa que suele ocurrir cada 10 o 15 años. El lector de este libro podrá apreciar la trascendencia de los principios recogidos en la Ley del Suelo de 2007 y su posterior Texto Refundido de 2008, que forman parte del nuevo concepto de urbanismo sostenible que ya se ha comenzado a aplicar en vía judicial y supone un cambio muy importante en los nuevos desarrollos urbanísticos, entre ellos la puesta en valor de todo el suelo rústico, y no sólo el protegido, también el común tiene un valor ambiental en sí mismo y por ello sólo debe urbanizarse cuando haya razones que lo justifique, razones que deben quedar debidamente acreditadas en el planeamiento y sometido al control judicial, que ya está anulando muchos planes, como se vera, por tener excesivo suelo urbanizable y no quedar justificado porqué se necesita tanto suelo en un determinado municipio… Dada la enorme cantidad de sentencias dictadas por los tribunales en estos últimos años, de las cuales se han seleccionado 200 en los dos volúmenes de esta obra (volumen primero publicado en soporte papel), contamos ya con una jurisprudencia muy consolidada en materia ambiental que debe ser tenida en cuenta por todos los operadores que trabajan en el ámbito urbanístico, …
