Book excerpt: This volume offers a critical historical assessment of the negotiation of the Treaty on the Non-Proliferation of Nuclear Weapons (NPT) and of the origins of the nonproliferation regime. The NPT has been signed by 190 states and was indefinitely extended in 1995, rendering it the most successful arms control treaty in history. Nevertheless, little is known about the motivations and strategic calculi of the various middle and small powers in regard to their ultimate decision to join the treaty despite its discriminatory nature. While the NPT continues to be central to current nonproliferation efforts, its underlying mechanisms remain under-researched. Based on newly declassified archival sources and using previously inaccessible evidence, the contributions in this volume examine the underlying rationales of the specific positions taken by various states during the NPT negotiations. Starting from a critical appraisal of our current knowledge of the genesis of the nonproliferation regime, contributors from diverse national and disciplinary backgrounds focus on both European and non-European states in order to enrich our understanding of how the global nuclear order came into being. This book will be of much interest to students of nuclear proliferation, Cold War history, security studies and IR.

Book excerpt: Following the acquisition of the atomic bomb by five states, the United Nations began drafting several treaties to limit nuclear proliferation. These efforts failed, as four more states also acquired nuclear weapons. In a similar vein, an attempt to limit atomic weapons - primarily within the two superpowers - was initiated. While the number of weapons has decreased, the new bombs now being manufactured are more powerful and more precise, negating any reduction in numbers. In the field of civil nuclear use, all nuclear facilities (reactors, factories, etc.) have a limited lifespan. Once a plant is permanently shut down, these facilities must be decommissioned and dismantled. These operations are difficult, time-consuming and costly. In addition, decommissioning generates large volumes of radioactive waste of various categories, including long-lived and high-activity waste. Risks to the environment and to health are not negligible during decommissioning. The International Atomic Energy Agency (IAEA) and the Nuclear Energy Agency (NEA) of the Organisation for Economic Co-operation and Development (OECD) have produced numerous publications with recommendations. Each state has its own decommissioning strategy (immediate or delayed) and final plan for the site - whether it be returning it to greenfield status or obtaining a nuclear site license with centuries-long monitoring.

Quel en est donc le sujet d'imputation : l'organisation ou ses membres ? Une théorie de l'acte doit être développée au coeur de la théorie de l'organe pour démontrer que l'organisation internationale est la personnification juridique d'une collectivité d'Etats dotée d'un système représentatif, et n'est que cela. La qualité de partie à un traité constitutif et de membre d'une organisation internationale ne prive l'Etat d'aucun des attributs de la souveraineté dans l'ordre international. Au contraire, la faculté d'investir un sujet de droit de compétences nouvelles est précisément un attribut de la souveraineté : l'organisation est tout entière une création des Etats membres. Leur souveraineté n'inhibe pas le processus de personnification de l'organisation qui, en retour, ne la confisque pas : la souveraineté et la relativité des rapports juridiques demeurent les principes régulateurs de l'ordre international.
