In the event the signalling was not installed, progress was much slower than anticipated and Railtrack collapsed. Network rail took over the project and put in place a more robust strategy to deliver the upgrade in three stages between 2004 and 2008. The first two stages have already been delivered on schedule. However the total modernisation cost is likely to be around £8.6 billion and the line will still be prone to overcrowding at peak times and is thus likely to need further investment. This report looks at the project on the basis of a report by the Comptroller and Auditor General.

Book excerpt: The Department for Transport has approved expenditure of over £11 billion between 1998 and 2021 for the development of new and existing trunk roads and motorways by the Highways Agency, and just under £1.7 billion on major road schemes proposed and developed by local authorities in five year Local Transport Plans. Following on from a NAO report on this topic (HCP 321, session 2006-07; ISBN 9780102944600) published in March 2007, the Committee's report examines the steps taken by the Department for Transport and the Highways Agency to improve value for money and oversight of the roads programme and contracting methods and project management capability. By September 2006, the Agency's 36 completed schemes in the Targeted Programme of Improvement cost 40 per cent more than estimated initially, and for schemes still to be completed, latest forecasts indicate that final costs could be 27 per cent more than original estimates. The main causes for costs exceeding estimates are increases in construction costs, higher than forecast land prices and compensation to landowners, inflation and changes in the scope of the project. The report finds that the DfT has not been rigorous enough in its oversight of the Agency's delivery of major road schemes, allowing it too much latitude on delivery and cost plans, and has failed to monitor in-year expenditure against progress and delivery milestones. The Agency is overly reliant on consultants for project management expertise and needs to develop its in-house capability.

Book excerpt: In 2006-07, Her Majesty's Revenue & Customs (the Department) raised a total of £23.8 billion in Corporation Tax from large businesses. There are some 700 of these businesses, and in 2005-06, just 50 of them paid 67 per cent of the large business Corporation Tax, whilst 181 businesses paid none. Two-thirds of the tax comes from the banking, oil and gas and insurance sectors. Businesses pay little or no Corporation Tax because, for example, they have made a loss, or had losses in previous years, or they are using tax reliefs, or engaging in tax avoidance. In 2006-07, the Department's large business Corporation Tax enquiry programme raised nearly £2.7 billion. Many of these enquiries were poorly targeted, with nearly 60 per cent producing less than 1 per cent of the additional tax raised. The enquiries also take too long: in January 2008, 42 per cent of its enquiries were over two years old, and 10 per cent over four years old. In February 2007, based on initial review of tax returns from the previous 12 months, the Department estimated that the potential Corporation Tax at risk was £8.5 billion. The tax assessments are very complicated and there has been a widening gap between the skill set of large business tax staff and that of the Large Business Service. The Department is bringing in external recruits, including retired tax advisors, to help to train its staff and to deal with the more complicated technical work.

The Shareholder Executive was established in 2003, to act as an effective owner of businesses that are owned or part-owned by government. It is now an operational group within the Department of Trade and Industry, with a portfolio covering 27 businesses and a combined turnover of £21 billion. The Committee notes that the role of the Executive marries both public and private objectives, setting out to both achieve public policy objectives through the most cost effective means and provide a satisfactory return on the public money invested through the shareholder value. The Committee states that the Executive has delivered value for the taxpayer by adopting a business criteria through a framework that sets out clear priorities for the businesses, alongside performance monitoring and, with management held to account for their delivery. The Committee sets out a number of conclusions and recommendations, including: that the Department of Trade & Industry is setting up a Board to provide direction and accountability for the Executive; that there should be a presumption that all government businesses come within the Executive's portfolio; that the Executive should market its services comprehensively and seek to be more visible across government; that the Executive should be given an explicit responsibility for advising sponsor departments on the investment needs of their businesses; that the performance management of the Executive needs to include wider measures that are based on the results of individual businesses; also, that the Executive needs sufficient pay flexibility to continue to recruit high calibre staff; that the Executive's responsibility for the postal services industry extends beyond shareholder value issues, and the Committee believes the Department should identify options for relieving the Executive of responsibility for Royal Mail policy; that the Executive should set business-level dividend targets, which take into account the risks faced by the business and the Executive should systematically undertake valuations of the businesses in its portfolio.

Book excerpt: The 2004 Gershon Efficiency Review proposed procurement as one of the main sources of efficiency savings in the public sector. The Learning and Skills Council, which funds England's 384 further education colleges, estimates that from an annual procurement expenditure of £1.6 billion, colleges could make savings of £75 million by March 2008. The savings made by colleges would be available to be redeployed into front-line services for learners. Until recently, many colleges have tended to treat procurement as a low priority and have not taken advantage of modern procurement methods such as purchasing consortia and procurement cards. They now need to modernise their systems so as to maximise the resources available for learning. Colleges increasingly have staff who are capable of managing procurement, but they are too often let down by the low quality of the systems and the management information available to them. There have been recent successes in persuading colleges of the benefits of joining purchasing consortia and using procurement cards. Indeed the savings target of £75 million may prove unambitious in light of the low starting point of many colleges. March 2008, when colleges make their first reports on savings to the Learning and Skills Council, will be a good time to consider whether greater savings can be made to be re-invested into services for learners.

The Government's reiteration of its commitment not to detract or resile from the rights in the European Convention on Human Rights (ECHR); and its acknowledgement that there would be scope for including in a new constitutional document a range of rights and responsibilities which go beyond those in the ECHR, are welcomed. The Committee is concerned to detect some equivocation in the Government's view about the Human Rights Act, particularly following the interview given by the Secretary of State for Justice in the Daily Mail on 10 December 2008. It also remains unclear about the relationship between rights and responsibilities envisaged by the Government in a Bill of Rights. Finally, the Committee recommends that the Government should follow Australia's example and appoint an independent committee to conduct a national consultation on the whole range of options for a Bill of Rights for the UK, ahead of parliamentary consideration of the bill itself.

The Committee was concerned that there had been insufficient scrutiny of these proposals, not least because draft texts had not been published, and that the Office for Disability Issues had not robustly challenged Government departments about their proposals. The Government laid the Convention before Parliament on 3 March, heralding the beginning of the ratification process. Four reservations and one interpretative declaration were proposed. The Committee has criticised the Government for ruling out formal consultation on these proposals and also drawn attention to the limited opportunities for parliamentary scrutiny and control of the ratification of treaties. Ratification should take priority over potentially lengthy and futile discussions about whether or not to enter reservations but the Government's approach to some of the reservations has been unduly cautious and may detract from the position role the UK has played in relation to the Convention. The Committee considers that the reservation relating to service in the armed forces is open to challenge as incompatible with the object and purpose of the Convention. The reservation relating to immigration control is felt to be too broad, its purpose has not been adequately explained and so it should be dropped. The Government should clarify matters in relation to the reservation and declaration on education and should consult on how to deal with the treatment of benefits appointees.

Book excerpt: The UN Convention on the Rights of Persons with Disabilities builds on existing human rights treaties including the International Covenant on Civil and Political Rights and the International Covenant on Economic Social and Cultural Rights. The UN Handbook for Parliamentarians on the Convention stresses that it is not intended to create new rights, but "clarifies the obligations and legal duties of States to respect and ensure the equal enjoyment of all human rights by all persons with disabilities". Its purpose is to: "Promote, protect and ensure the full enjoyment of all human rights and fundamental freedoms by all persons with disabilities, and to promote respect for their inherent dignity." The UK was among the first countries to sign the Convention on 30 March 2007. The findings of our recent inquiry on the rights of adults with learning disabilities showed that although UK law and policy on the treatment of adults with learning disabilities takes a human rights based approach, the day to day experiences of people with learning disabilities are not so positive. Ratification will send a strong signal to all people with disabilities in the UK, and abroad, that the Government takes equality and the protection of their human rights seriously. The Government first publicly stated that reservations to the Convention were being considered in its response to our Report on the treatment of adults with learning disabilities, in May 2008, more than a year after it signed the Convention. Despite the Committee's call for a full explanation of the government's views on the compatibility of domestic law with the Convention, the were then provided with little detail on the reservations being considered or the Government's approach to the process. The Committee considers that progress towards ratification of the Convention by the UK has so far lacked transparency and has unfortunately alienated disabled people and their organisations. This is unacceptable in the light of the clear Convention commitment which the Government intends to make to the involvement of disabled people in the development of policies and laws which affect them. This approach undermines the previous role that the UK Government has played in championing equality for disabled people and their leading role in negotiating the terms of the UNCRPD.

At April 2007, the overall shortfall was 5,850 personnel, or 3.2 per cent and none of the three Services were within their targets, known as 'manning balance'. Many highly specialised areas, such as nurses and linguists, have larger shortfalls. The impact of continuous downsizing, pressures and overstretch is affecting the ability of the Ministry of Defence (MoD) to retain and provide a satisfactory life for Armed Forces personnel. Numbers leaving early have risen in the last two years, and are now at a ten-year peak for Army and Royal Air Force Officers and for Royal Air Force Other Ranks. The frequency of deployments is creating pressure on some personnel, with large numbers exceeding the "harmony" guidelines on time spent away from home. The MoD has operated above the most demanding level of operations under Defence Planning Assumptions since 2001, but has not adjusted its manning requirements. Short term financial measures to improve retention have had some success, but do not address the key drivers for leaving such as servicemen and women's inability to plan ahead and the impact on their family life. The MoD also lacks basic information on the costs of its measures which would enable it to make more informed judgements on incentives to improve recruitment and retention. Past cuts in recruitment activity have had a damaging longer-term effect on manning in some areas. Such cutbacks are almost impossible to recover as budget and capacity constraints prevent the MoD from over-recruiting to make up for shortfalls in previous years.
