Book excerpt: Written c. 1567 (though unpublished until 1603), this is the work of an extraordinary scholar, a radical and polemicist, rival of many of the leading intellectual and political figures of his day. According to François Hotman’s distinguished biographer Donald Kelley the Antitribonian ‘is, or should be, a landmark in the history of social and historical thought’. It is also a landmark in the history of legal thought. The present edition is the first to evaluate Hotman’s text in the context of the history of Roman law from the time of the sixth-century Byzantine Emperor Justinian I to the Germany of the Enlightenment.

Available in PDF, EPUB and Kindle. Book excerpt: The lifetime of Francois Hotman (1524-1590) was one of the most tumultuous periods in European history. Donald R. Kelley shows how this protégé of Calvin and agent of many of the great Protestant princes became involved in ecclesiastical politics, Huguenot diplomacy, and conspiracy. One of the first modern revolutionaries, Hotman rebelled not only against his family and its faith, but against the laws and eventually the government of his country. As an embittered exile lie produced a voluminous body of propaganda aimed at recovering a lost political and religious innocence on which to found a new community. At the same time he was one of the greatest and most versatile scholars of his age, achieving distinction as a jurist, teacher, classical scholar, dialectician, theologian, and historian. His Franco-Giallia and Anti-Tribonian have fascinated generations of political theorists, and his letters, reports, and anonymous works are of inestimable value to historians. Originally published in 1973. The Princeton Legacy Library uses the latest print-on-demand technology to again make available previously out-of-print books from the distinguished backlist of Princeton University Press. These editions preserve the original texts of these important books while presenting them in durable paperback and hardcover editions. The goal of the Princeton Legacy Library is to vastly increase access to the rich scholarly heritage found in the thousands of books published by Princeton University Press since its founding in 1905.

Book excerpt: Franco-Gallia Or, An Account of the Ancient Free State of France: Large Print By Francois Hotman We are therefore to understand, that the State of Gaul was such at that time, that neither was the whole under the Government of a single Person: Nor were the particular [Footnote: Civitas, a Commonwealth.] Commonwealths under the Dominion of the Populace, or the Nobles only; but all Gaul was so divided into Commonwealths, that the most Part were govern'd by the Advice of the Nobles; and these were called Free; the rest had Kings. But every one of them agreed in this Institute, that at a certain Time of the Year a publick Council of the whole Nation should be held; in which Council, whatever seem'd to relate to the whole Body of the Commonwealth was appointed and establish'd. Cornelius Tacitus, in his 3d Book, reckons Sixty-four Croitates; by which is meant (as Cæsar explains it) so many Regions or Districts; in each of which, not only the same Language, Manners and Laws, but also the same Magistrates were made use of. Such, in many Places of his History, he principally mentions the Cities of the Ædui, the Rhemi and Arverni to have been. And therefore Dumnorix the Æduan, when Cæsar sent to have him slain, began to resist, and to defend himself, and to implore the Assistance of his Fellow Citizens; often crying out, That he was a Freeman, and Member of a Free Commonwealth, lib. 5. cap. 3 We are delighted to publish this classic book as part of our extensive Classic Library collection. Available in PDF, EPUB and Kindle. Book excerpt: Pierre Bayle was one of the most important sceptical thinkers of the seventeenth century. His work was a major influence on the development of the ideas of Voltaire (who acclaimed it for its candour on such subjects as atheism, obscenity and sexual conduct), Hume, Montesquieu and Rousseau. Banned in France on first publication in 1697, Bayle's Dictionnaire Historique et Critique became a bestseller and ran into several editions and translations. Sally L. Jenkinson's masterly edition presents the reader with a coherent path through Bayle's monumental work (which ran to seven million words). This is volume selects political writings from Bayle's work and presents its author as a specifically political thinker. Sally L. Jenkinson's authoritative translation, careful selection of texts, and lucid introduction will be welcomed by scholars and students of the history of ideas, political theory, cultural history and French studies.

Available in PDF, EPUB and Kindle. Book excerpt: Through the examination of the concept of freedom in the writings of St Francis de Sales the author concludes that, in contradistinction to a contemporary understanding of freedom perceived as self-determination, a Salesian understanding privileges freedom's relationship to 'the good'. This situates St Francis de Sales in the classical Thomistic tradition of freedom's necessary relationship to the good, but involves a methodological shift as he employs the Renaissance starting point of 'the turn to the subject'. This study demonstrates how St Francis arrives inductively at what St Thomas demonstrated deductively, namely, the essential relationship of freedom to the good. Along with this Thomistic influence, the author analyses the Salesian indebtedness to Augustinian anthropology which explains the primacy St Francis gives to the will, and consequently, to love. Love, understood as the heart's movement towards the good, allows the Salesian approach to move beyond the confines of a traditional faculty psychology to embrace a more biblical understanding of the human person. This examination of love's relationship to freedom reveals their teleological and archaeological natures, coming back to our origins wherein we discover the source of our freedom bestowed on us as a gift from God.

Available in PDF, EPUB and Kindle. Book excerpt: This second volume of essays by Professor Kelley takes the study of history as its starting point, then extends explorations into adjacent fields of legal, political, and social thought to confront some of the larger questions of the modern human sciences. The first group of papers examine the historiography of the Protestant Reformation and then of the Romantic and Victorian periods; the last section focuses on the legal tradition and its interpretation in relation to social and cultural, as well as historical thought, in the period from the Renaissance to the French Revolution. Throughout, the author’s interest is to analyse how people at different times have viewed their past - and reconstructed and utilised it in the service of their present concerns.
