Chin Peng’s objective was, to create a Communist Dictatorship in Malaya, after the cessation of hostilities. Then take over from the British Government in Malaya, The Malaya Communist Party, began to cause unrest creating strikes and acts of murder amongst the law-abiding Malayan people, whose population was mainly of Chinese origin. In February 1947. Under a Treaty arranged by the British Government. The Federated and Unfederated States of Malaya became one. Much against the Malayan Communist Party’s wishes. Retaliating, they creating more havoc and unrest amongst the civilians, until finally decided to. ‘Take up Arms’ against the British Government. The murders of the three Planters, had the British High Commissioner Sir. Edward Gent forced to take action. Initiated a State of Emergency in Perak, quickly followed throughout other States. Chin Peng ‘Declared War’ against the British. Subsequently, the atrocities spread throughout Malaya. The Civil Police were unable to control the speeding violence and mayhem. Necessitating, the existing British and Gurkha Troops to take control. Nevertheless, the Communist had taken their fight into the jungles of Malaya. Where for the next 12 years, a Bloody War took place. It was called ‘THE EMERGENCY’ by the British Government, due to the possible Insurance claims from both the Rubber Plantation and Tin Mines Owners. It cost the lives of 1,818. Commonwealth Forces. & 1,026 Federation of Malaya Police. Over the following 12 years, it is estimated that in excess of 22,000, lost their lives consisting of, Commonwealth Forces of the three Service’s, Federation of Malaya Police. Civilians, including the Chinese Communist Terrorist. Chin Peng survived, escaped with the remains of his beaten Army, numbering less than 400 across the Malay border into Thailand to remain an exile.

Book excerpt: This book examines the extraordinary nature of the power of preventive detention, which permits executive dispensation of the personal liberty of an individual on the mere apprehension that, if free and unfettered, he may commit acts prejudicial to national security or public order. In light of the extraordinary scope of this power, it, therefore, contends that the scope of the power should be confined to genuine emergencies threatening the life of the nation. Against the above background, this book sheds light on the fact that Article 149 of the Federal Constitution of Malaysia empowers the Parliament to enact preventive detention laws authorizing the executive branch of government to preventively detain individuals without the precondition of an emergency. Furthermore, the Constitution does not stipulate adequate safeguards for mitigating the harshness of preventive detention laws. This book makes it manifestly evident that the weaknesses of the constitutional provisions concerning preventive detention have enabled succeeding generations of executives in Malaysia to not only enact a series of preventive detention statues for arrogating to themselves wide powers concerning preventive detention but also to rely on them for arbitrarily detaining their political adversaries. Consequently, on the basis of this analysis, this book puts forward concrete recommendations for insertion in the Constitution detailed norms providing for legal limits on the wide power of the executive concerning preventive detention. The insertion of such norms would ensure the maintenance of a delicate balance between protecting national interests and, simultaneously, observing respect for an individual’s right to protection from arbitrary deprivation of liberty.This book is useful for academics and students of comparative constitutional law, human rights and Asian law. The extensive law reform analysis undertaken in this book also greatly benefits the policy makers in Malaysia and the policy makers of constitutional polities facing similar problems with the issue of circumscribing the scope of the powers concerning preventive detention.

Their father, Arthur, was a renowned Cheshire Regiment officer and had served as a Brigade Major in Gallipoli and on the Western Front during the First World War. Napier followed in his father’s footsteps - becoming an officer in the Cheshire Regiment - and saw action during the Arab Revolt in Palestine in 1936. On the outbreak of the Second World War, Napier’s brothers followed him into the army for war service: Henry in the Queen’s Westminster Rifles and the King’s Royal Rifle Corps and Spencer in the Royal Engineers. Spencer and Henry’s wartime service took a different course to their brother. While Napier languished in a succession of unrewarding posts in Great Britain, his brothers fought across North Africa and into Italy. Napier - desperate to see action - joined the new airborne arm and, as a Brigade Major, arrived in Normandy by glider on D-Day. Promotion followed rapidly and he took over a parachute battalion before returning to England. As the pace of the war increased, Napier found himself continually in the front line. His battalion fought in the Battle of the Bulge and he parachuted at its head during the Rhine crossing operation. Napier pursued the German Army across its homeland - reaching the Baltic, where he finished the war facing down the Russian Army in Wismar on VE Day. With the war over, the brothers’ fortunes once again took different paths. Henry and Spencer left with the effects of wounds and illness sustained during the war, and returned to civilian life to pursue full careers and lives. Napier stayed with the army and saw operational service in Palestine once again and Malaya. He retired in 1972 as a three-star General. Ever Glorious is written through the letters exchanged between Henry, Napier, Spencer and their father, Arthur. The book takes the reader from Gallipoli to the Baltic; North Africa to the Ardennes; Normandy to Palestine; and from Italy to Malaya.
