Book excerpt: Excerpt from The Law and Practice of the Courts of the United Kingdom Relating to Foreign Judgments and Parties Out of the Jurisdiction: To Which Are Added Chapters on the Laws of the British Colonies, European and Asiatic Nations, and the States and Republics of America A first edition can scarcely pretend to be more than a sketch of any subject: in the second, the author may hope to arrive at more perfect and finished work. In recasting and rewriting the volume published in 1879, I have therefore attempted a deeper analysis of the subject which a more prolonged study of the cases rendered possible. In doing this I received many valuable suggestions from my friend Mr H. Duff of the Inner Temple. The volume published in 1881 reappears as chapters xii to xvi of the present work: these chapters preserve their original form, which kept convenience of reference principally in view. A considerable amount of information has been added to them, and many serious omissions have been supplied. To a member of the Reichsjustizamt at Berlin, one of the most erudite of German judges, Mr Landrichter Vierhaus, who has been my unwearying correspondent during the last eighteen months, I am indebted for much of this additional information, and for the entire chapter on German law. Without his valuable aid even an approach to completeness would have been impossible. I am also under a debt of great obligation to Mr Ernest Schuster, of the Middle Temple, who has laboured unceasingly in my behalf in the collection and translation of foreign laws. Book Synopsis Res Judicata, Estoppel, and Foreign Judgments by : Peter R. Barnett
Download or read book Res Judicata, Estoppel, and Foreign Judgments written by Peter R. Barnett and published by Oxford Private International L. This book was released on 2001 with total page 432 pages. Available in PDF, EPUB and Kindle. Book excerpt: This clear and original book provides a much-needed analysis of the doctrines of res judicata and abuse of process as applied to foreign judgments recognized in England for their preclusive effect. In particular, it examines the four preclusive pleas which are encountered in practice, namely:(i) cause of action estoppel; (ii) issue estoppel; (iii) former recovery per section 34 of the Civil Jurisdiction and Judgments Act 1982; and (iv) the rule in Henderson v Henderson. So far as foreign judgments are concerned, the book examines separately the preclusive effects of foreign judgmentsrecognized according to the English common law and related statutory rules, and foreign judgments which the English courts are obliged to recognize under the Brussels and Lugano Conventions. It also includes a discussion of the preclusive effects of judgments recognized under the proposed HagueConvention on Jurisdiction and Foreign Judgments in civil and commercial matters.Although the complex and technical doctrines of res judicata and abuse of process are well known in the context of domestic judicial decisions, little has hitherto been written analysing how these doctrines apply when the judgment emanates from a foreign court. It is not surprising, therefore, thatthis area of law has been frequently confused and mis-applied. And yet the recognition of foreign judgments for preclusive purposes is an increasingly important area for practitioners and academics - especially for those interested in international commercial litigation, and not least given theimportant treaty developments that are occurring. For these reasons, this book is a very timely work. Written with a practitioner focus, it includes extensive references to res judicata authorities in the United Kingdom, Australia and Canada.

Book excerpt: This 2007 book assists the practitioner seeking to enforce a foreign judgment in the United States or a US-rendered judgment abroad in navigating the lack of procedural uniformity that exists and in planning strategies likely to ensure effective enforcement. As a handbook, it provides the practitioner with a framework and resources with which to approach and further research the laws of the relevant state or country. In Part One, the guide takes the practitioner chronologically through the process of obtaining a US court's recognition and enforcement of judgments rendered abroad. Part Two takes the practitioner through the process of obtaining an overseas jurisdiction's recognition and enforcement of judgments rendered in the United States. Part Three assesses the current trends in the US and in the international trade environment regarding enforcement of judgments which may be made by foreign courts.
