Book excerpt: The Constitution of Kenya: Contemporary Reading, provides an in-depth assessment of the interface between constitutionalism and Kenyas new Constitution. Focusing on the historical trajectory on the search for a new Constitution, Chapter One lays the groundwork upon which the fault line between constitutionalism and the issue areas are articulated in the other chapters in relation to the new Constitution. The superb chapters on the carefully selected issue areas, make this edited volume an essential reading. The book makes an important contribution to the evolving constitutionalism and policy clarification on Kenyas new Constitution. It is a welcome and timely intervention by legal scholars and practitioners on the new constitution and the challenges facing Kenya in its implementation. The book is an excellent teaching and reading manual for students in law, history, politics, diplomacy, and international relations as well as for the practitioners.

Available in PDF, EPUB and Kindle. Book excerpt: Kenya, like the rest of Africa, has gone through three sets of constitutional crises. The first related to the trauma of colonialism and struggle for independence. The second a period of constitutional dictatorship and the clamor for reform. The third, most recent crisis, being one of identity, legitimacy and the inability of the state to discharge its functions which has resulted in civil unrest, violent ethnic conflicts, poverty, social exclusion and inequality. The Making of the Constitution of Kenya examines the processes, issues and challenges of constitution making, governance and legitimacy in that country and the lessons that can be learned for others on the continent. Equipping the reader with a sound historical perspective on constitutional developments and the crisis of constitutional legitimacy in Kenya it gives an invaluable insight into the normative and political complexities involved in evolving a truly democratic and widely acceptable constitutional order in Africa.

Book excerpt: The aftermath of recent Kenyan elections has been marred by violence and an apparent crisis in democratic governance, with the negotiated settlement resulting from the 2007 election bringing into sharp focus longstanding problems of state and society. The broader reform process has involved electoral, judicial and security-sector reforms, among others, which in turn revolve around constitutional reforms. Written by a gathering of eminent specialists, this highly original volume interrogates the roots and impact of the 2010 constitution. It explains why reforms were blocked in the past but were successful this time around, and explores the scope for their implementation in the face of continued resistance by powerful groups. In doing so, the book demonstrates that the Kenyan experience carries significance well past its borders, speaking to debates surrounding social justice and national cohesion across the African continent and beyond.

Available in PDF, EPUB and Kindle. Book excerpt: A Leap into the Future is a collection of speeches, essays and articles compiled during Prof. Anyang' Nyong'o's tenure in the Kenya government and soon afterwards (2002-2006). In this provocative collection, Prof. Nyong'o examines the challenges of development, analyses how pan-African and global partnerships could facilitate development, and invokes the visionary direction pointed out by prominent personalities in Kenya's political leadership to whom he pays tribute. Through the collection, the author projects his vision for socio-political and economic transformation of the Kenyan society in a bid to formulate an economic strategy capable of leap-frogging the country from the current quagmire of underdevelopment to development. Professor Anyang' Nyong'o is a renowned reformist and political scientist in Africa and is best known for his role in Kenya's "second liberation." He holds a doctorate degree in Political Science from the University of Chicago and has taught in universities in Kenya, Mexico and Ethiopia. Upon the re-introduction of multiparty politics in Kenya in 1991, he was involved in the founding of Forum for the Restoration of Democracy (FORD), which provided the premier opposition machinery in the run-up to the 1992 general elections. He was also involved in the formation of the National Rainbow Coalition (NARC), which defeated KANU, the party that had ruled Kenya for 24 years. In the subsequent NARC government, he became the Minister of Planning and National Development. Besides teaching, he is widely published in Africa and abroad. Prof. Nyong'o has also been at the frontline in championing the reform agenda in Africa, especially through the establishment of NEPAD. At the time of publication of this book, he was Secretary General of the Orange Democratic Movement (ODM).

Available in PDF, EPUB and Kindle. Book excerpt: During the run-up to Kenyas 2013 general elections, crucial political and civic questions were raised. Could past mistakes, especially political and ethnic-related violence, be avoided this time round? Would the spectre of the 2007 post-electoral violence positively or negatively affect debates and voting? How would politicians, electoral bodies such as the IEBC, the Kenyan civil society, and the international community weigh in on the elections? More generally, would the 2013 elections bear witness to the building up of an electoral culture in Kenya, characterized by free and fair elections, or would it show that voting is still weakened by political malpractices, partisan opinions and emotional reactions? Would Kenyas past be inescapable or would it prepare the scene for a new political order? Kenyas Past as Prologue adopts a multidisciplinary perspective mainly built upon field-based ethnography and a selection of case studies to answer these questions. Under the leadership of the French Institute for Research in Africa (Institut francais de recherche en Afrique, IFRA), political scientists, historians and anthropologists explore various aspects of the electoral process to contribute in-depth analyses of the last elections. They highlight the structural factors underlying election and voting in Kenya including the political system, culture and political transition. They also interrogate the short-term trends and issues that influence the new political order. The book provides insight into specific case studies, situations and contexts, thus bringing nuances and diversity into focus to better assess Kenyas evolving electoral democracy.
