Book excerpt: Excerpt from The Geneva Award Acts: With Notes, and References to Decisions of the Court of Commissioners of Alabama Claims IN the following pages I have sought to bring under review the legislation of Congress known as The Geneva. Award Acts. These are the acts approved, respectively, June 23, 1874, and June 5, 1882. Great Britain, it will be recalled, paid the United States, Sep tember 13, 1873, at Washington, the sum of gold, in conformity with the terms of the award. Our government invested this sum in five per cent registered bonds of the United States. Instead of entrusting the distribution of the fund to a mere com mission, Congress, in 1874, created a tribunal, the Court of Com missioners of Alabama Claims, composed of five judges. They were empowered to receive, examine, and give judgment for claims directly resulting from damage caused by the Alabama, the Florida (and their tenders), and by the Shenandoah after leaving Melbourne, February 18, 1865. These vessels were called inculpated cruisers, from the fact that for their presence on the ocean Great Britain had been held responsible. The privileges of the act were also extended to insurers whose losses during the rebellion from war risks exceeded what they had gained from that source. The decisions in England and America, about the necessity of a trial and condemnation in port, of a captured vessel, before the captor can in any way legally dispose of her, are very numerous. It is believed there is no dispute about that. The point of dispute is about the right to destroy. (See Note B). General Halleck, in his work on International Law, p. 278, sums up thus: "As England became more commercial, it became her settled policy to regard the property of a captured vessel as not changed without a regular sentence of condemnation pronounced by a court of competent jurisdiction, and the title from the time of capture until such condemnation, in abeyance, and not capable of being transferred. This principle is not only recognized in her prize courts, but is now firmly incorporated into her common law." "The same rule (he says, ) is adopted by the courts and incorporated into the statutes of the United States," (citing many authorities). The rule was tersely stated and defended in the Supreme Court of the United States, in the case of the Estrella, reported in 4 Wheatorts Reports, 298, and its doctrine applied to the duties of a neutral nation, in these words: "A neutral may ascertain whether a trespass has been committed on its own neutrality by the vessel which has made (a) capture. So long as a nation does not interfere in the war, but professes an exact impartiality towards both parties, it is its duty as well as right, and its safety, good faith, and honor demand it, to he vigilant in preventing its neutrality from being abused, for the purpose of hostility against either of them.
