Book excerpt: If I need to call in a plumber to come and fix my toilet, I expect to have my toilet fixed. I don't think that is asking too much. One thing I would not expect a plumber to do when fixing my toilet is to leave a massive floater in my toilet bowl. That is for me to do, once it is fixed. Lawyers, when they give useless advice, are doing the plumber equivalent of leaving a floater in the toilet bowl of their client's life. So much of what lawyers say and do is not what people want or need. People want real answers to legal questions, so their problem can be fixed or they can feel safe and protected. One day, not that long ago, I decided that I did not want to be a floater-leaving lawyer any more. I wanted to stop providing a form of legal 'service' that was great for my billable hours, but absolutely terrible for my clients. I wanted to see what would happen if I stopped giving legal advice and started giving proper, useful answers to people's legal questions and concerns. The result was my very first book, which I call 'The Following Does Not Constitute Legal Advice'. The book is made up of a collection of common legal questions, with straightforward legal answers. I cover how to get out of a speeding ticket, whether prostitution is legal, how it is legally possible to start a new country, whether dogs or cats are the better animal (legally speaking) and over 40 other topics. No answer is more than a few pages long, most feature one or two bits of course language, and all are intended to be helpful and useful.

Book excerpt: This book provides original, diverse, and timely insights into the nature, scope, and implications of Artificial Intelligence (AI), especially machine learning and natural language processing, in relation to contracting practices and contract law. The chapters feature unique, critical, and in-depth analysis of a range of topical issues, including how the use of AI in contracting affects key principles of contract law (from formation to remedies), the implications for autonomy, consent, and information asymmetries in contracting, and how AI is shaping contracting practices and the laws relating to specific types of contracts and sectors. The contributors represent an interdisciplinary team of lawyers, computer scientists, economists, political scientists, and linguists from academia, legal practice, policy, and the technology sector. The chapters not only engage with salient theories from different disciplines, but also examine current and potential real-world applications and implications of AI in contracting and explore feasible legal, policy, and technological responses to address the challenges presented by AI in this field. The book covers major common and civil law jurisdictions, including the EU, Italy, Germany, UK, US, and China. It should be read by anyone interested in the complex and fast-evolving relationship between AI, contract law, and related areas of law such as business, commercial, consumer, competition, and data protection laws.

Available in PDF, EPUB and Kindle. Book excerpt: This book discusses the law and practice of the European Union's new chemical regulatory programmes known under the acronym ''REACH'. REACH is intended to ensure the safe management of risks associated with chemical substances throughout the supply chain. Its scope is very broad; subject to limited exceptions, REACH applies to all bulk chemicals used in industrial processes and to chemicals present in products such as cleaning products, paints, clothing, furniture, and electrical appliances. The newly established European Chemicals Agency (ECHA), the Commission, and member state authorities are in charge of administering the various parts of the REACH Regulation, creating a complex patchwork of government powers, procedures, and oversight. The volume is written by experienced REACH practitioners. It addresses both the key legal regulatory issues associated with REACH and the key management and practical challenges. In addition to analysing the scope, the processes, and the obligations of the industry under REACH, the book covers the strategy and management of REACH compliance from the perspective of the regulated entities. The focus is on the strategic and practical decisions facing companies subject to REACH's various regimes. Significant attention is paid to REACH consortia, which are a key instrument in compliance management, and to the competition law issues arising in connection with REACH consortia. It also covers legal remedies, enforcement, intellectual property rights, and civil liability for damages arising from chemical substances as well as how companies can shape their REACH compliance programme to reduce their liability exposure.

Lorraine del Prado, Vice President, Principal Gifts & Philanthropic Initiatives at Seattle Children’s In this remarkable book, Virginia, a deeply caring and professionally accomplished person, brings what she shares with family, friends, and clients in her everyday life: compassion, wisdom, expertise, and a profound commitment to making our world a better place through the wellbeing of children and families. Parents who fail to act leave their child’s guardian unprepared and may leave their child’s future, routines, and traditions up to strangers to decide. If you could spend a few moments now that would make it possible to dramatically help your child navigate a profoundly difficult time later, would you? Letters to My Child’s Guardian offers: • Many parent-attorney insights about child guardianship decisions • Identifies critical legal issues and practical choices to consider in wills and trusts • Demystifies this process for each family and provides great insight Letters creates a unique “catastrophe” resource, jumpstarts vital discussions, and guides parents to share an enduring family legacy that will captivate future generations. Through Letters parents can supplement their estate plans in a non-legally binding fashion and reveal and preserve profoundly meaningful advice. Families can use this inspirational resource to create powerful letters of encouragement, advice, and wisdom for their children. For over thirty years attorney Virginia Antipolo-Utt has provided sophisticated and compassionate estate planning counsel to her clients about wills, trusts, and guardianships. Corporate Governance contrasts schools of thought, explaining the conflicts between such theories as contractarianism and communitarianism, and such emerging academic approaches as empiricism and behavioral economics. The text includes excerpts from only the most important sections of judicial decisions along with their relevant factual and procedural context. Extensive notes address the reactions to decisions from other courts, commentators, counsel, and executives. Dozens of examples ripped from the headlines, excerpted from actual corporate documents, and drawn from popular culture illustrate key principles and spark class discussions. More than one hundred suggestions for paper topics are especially useful for participants in research and writing seminars. An appendix categorizes and details more than eighty separate initiatives that shareholder activists and commentators have proposed. A wide range of excerpts from corporate documents and court decisions interpreting these materials help students translate the caselaw and learn drafting techniques. The Second Edition reflects legislative, regulatory, judicial, and Fortune 500 developments since mid-2009 as well as new examples from corporate documents, the Great Books, and popular culture. Detailed coverage of new and emerging topics includes discussion of the governance of nonprofit corporations the emerging types of social enterprises such as benefit corporations, B corporations, and flexible purpose corporations; the board s responsibility to rein in the cyber-risks raised by hackers, e-mails, Web sites, and social media; and the implications for directors, officers, and counsel of new research on avoiding common cognitive traps that compromise decision-making in situations of risk and uncertainty. The Second Edition explores governance changes wrought by the financial crisis and reform legislation; the responsible corporate officer doctrine, the honest services doctrine, and other theories of executive liability; issues raised by crowdfunding ; and the consequences of the Citizens United decision removing limits on companies independent political expenditures. New appendices give detailed advice on identifying, developing, refining, and researching topics for articles and on using the publishing process to invigorate one s professional network and career.

Available in PDF, EPUB and Kindle. Book excerpt: This book highlights minimum standards relating to the management of different conditions in the practice of Obstetrics and Gynaecology. The editors explore clinical governance issues, common causes of as well as ways to avoid litigation. The UK is experiencing a dramatic increase in medico-legal claims. The 4 main reasons for litigation are: accountability, the need for an explanation, concern with standards of care and compensation. However the decision to take legal action is determined not only by the original injury, but failure to provide information, an explanation and an apology. Insensitive handling of an injury and poor communication after the original incident increases the risk of litigation and erodes the patient-doctor relationship. Doctors almost never deliberately cause harm to patients, however increasingly claims are being defended successfully. This book is invaluable to clinicians and lawyers alike and raises awareness of how to avoid facing clinical negligence claims in our day to day practice.

Available in PDF, EPUB and Kindle. Book excerpt: This book investigates the role of law in confronting major societal transformations embodied by the emergence of nanotechnologies. Taking the case of the European Union, it explores who the key decision-makers in the regulation of nanotechnologies are and how they take decisions. The questions are explored through two distinct case studies: the food and chemicals sectors. The book charts an incremental retreat of the European Union to its executive powers, including 'soft law' measures such as agencies' guidelines or implementing measures. This, the author argues, results in the Union's fundamental democratic control mechanisms, the EU legislature and the Court of Justice of the EU, being circumvented. The book recommends several immediate proposals to reform EU risk regulation, advocating a greater reliance on the European Parliament and outlining measures to increase the transparency of guidance drafting by EU agencies. This important work provides a timely examination of how emerging technologies pose both regulatory and democratic challenges.
