Book excerpt: Excerpt from The First Year of Roman Law I have made in this summary work no claim to erudition, but I have applied to it great solicitude for exactness and modernness of doctrine. If I have thought it proper to indicate authorities almost paragraph by paragraph, it is because I had need of preserving myself from any involuntary error. It is also because I have provided for the case where some student should make use of my little book as an index, or as a bibliography easy to consult. New York: Oxford University Press, 1906. xiii, 326 pp. Reprinted 2010 by The Lawbook Exchange, Ltd. ISBN-13: 9781616190224. ISBN-10: 1616190221. Paperback. New. $21.95. * This is a useful introduction to Roman law with a level of detail that falls midway between an outline and a textbook. Carefully organized, it is also an excellent reference guide. "To begin with, it is quite comprehensive, for there is not a single principle of Roman law, sufficiently important to be included in first-year study, which the author has omitted.... [L]egal principles and definitions are very concisely stated, and a lecturer on the subject will be glad to find an important rule given in such brief, almost epigrammatic form, that it can be readily committed to memory. (...) Another good feature is the practice of frequently citing the original Latin phrases and sentences.... Lastly, the translator has provided a good index, which is a valuable addition to the original work. We are sure that many teachers of Roman law will welcome this book as a manual to be placed in the hands of their students.": Columbia Law Review 7 (1907) 377-378.

Book excerpt: Excerpt from Historical Introduction to the Roman Law In a general course upon the Roman Law, I do not find it profitable to devote any large proportion of the lectures to its history. There are two methods of teaching the Roman Law, both of which have dis tinguished supporters. One is to present it as a thing apart, without reference to the present. The student is left to make any applications which he may see fit. The other method is to Show the way in which the Roman Law has grown into the modern Civil Law. In a country like England the former method is the more natural, because the Roman Law and the English Law are essentially different systems. In a country of the Civil Law, like the Province of Quebec, the latter method is, I think, the more useful. Between the ancient and the modern law, there is no breach of continuity; the one has grown out of the other. Whichever method we adopt, the law cannot be made intelligible to the student. Available in PDF, EPUB and Kindle. Book excerpt: Roman Law, since its earliest days of the XII Tables, to the Justinian code over one thousand years later, is arguably the most influential body of law ever developed, remaining at the core of European legal systems until the end of the eighteenth century and informing the civil law and (to a lesser extent) the common law to this day. The first edition of Peter Buckland's classic textbook on the subject was published in 1921. Professor Peter Stein's revised third edition published in 1963 updated the original so that it reflected Professor Buckland's own later thoughts on the subject until his death in 1945. This revised edition examines the law of the Empire (or classical law) and also tracks later developments, including the legislation of Justinian. It is primarily concerned with the law but historical developments are also kept in view, so as to give the student the broadest perspective on the subject.

They arranged law in three groups - (i) law concerning per sons; (2) law concerning things; and (3) law concerning actions. Practically they sub divided 'things' into - (i) property; (2) obligation (3) inheritance. Inheritance' is discussed in the Institutes after property, ' and before 'obligation'; but it is more convenient to take it after obligation.' As the present work is intended to serve as a companion to the Institutes of Justinian, the arrangement of justinian has been, with that exception, substantially followed. In this Edition a Supplementary Glossary explaining the technical terms and phrases employed in the Institutes will, it is hoped, prove convenient and useful to students. Vergil for Virgil or Quid for Ovid seem to me as bad as Livorn would be for Leghorn or Firence for Florence. Bu t where a word has been taken unchanged, except in the symbol for vowel or spirant, the matter is not so simple. I must here plead guilty to the weakness of retaining our English form of very familiar words such as N erva, Juno, Servius, Flavius, decemvir, &c. Book excerpt: Excerpt from A History of Roman Law: With a Commentary on the Institutes of Gaius and Justinian In the early ages of the Christian era the Roman empire embraced all the countries around the Mediterranean Sea, together with vast tracts north of the Alps, and stretching in an unbroken line eastward along the Danube to its mouth, and westward and northward to the Atlantic Ocean, St. George's Channel, the Solway Frith, and the North Sea. Or, as Gibbon has it, The empire was about two thousand miles in breadth, from the wall of Antoninus and the north ern limits Of Dacia to Mt. Atlas and the tropic of Cancer; it extended in length more than three thousand miles, from the western ocean to the Euphrates; it was situated in the finest part of the temperate zone, between the twenty-fourth and fifty-sixth degrees of northern latitude; it was supposed to contain about square miles, for the most part of fertile and well cultivated land. Book excerpt: Excerpt from Historical Introduction to the Private Law of Rome IN preparing a new edition of this book my principal Object has been to supplement the author's notes by references to the most recent authorities, viz. To such works of importance dealing with the history of Roman Law as have been published since the date of the first edition, and have come within my reach. NO alteration has been made in the text, except by way of correcting a few verbal inaccuracies. Neither has any attempt been made to critically examine certain theories propounded by the author regarding primitive Roman institutions, such as the origin and effects of mancipation and nexum, even where I might not be disposed to accept all his conclusions. To have done so in detail would have swollen the notes and increased the size of the book to an inconvenient extent. It must always be kept in view that our knowledge of early Roman customs, at least till after the XII. Tables, cannot be based upon historical evidence it is almost entirely conjectural, and different writers will take different views according to the value they attach to this or that piece of presumptive evidence. Book excerpt: Excerpt from Introduction to Roman Law: In Twelve Academical Lectures The author of this preface was intrusted with the office of carrying these lectures through the press. They were so completely ready, that hardly an expres sion or even a word needed correction, and so plainly written that the printer could have no excuse for mis taking a letter. As calculated to initiate young stu dents into the mysteries of Roman law, to diffuse a just idea of its preciseness of definition, and to broaden the foundation of legal study, they seem to me to pos sess peculiar merit.
