There are two methods of teaching the Roman Law, both of which have dis tinguished supporters. One is to present it as a thing apart, without reference to the present. The student is left to make any applications which he may see fit. The other method is to Show the way in which the Roman Law has grown into the modern Civil Law. In a country like England the former method is the more natural, because the Roman Law and the English Law are essentially different systems. In a country of the Civil Law, like the Province of Quebec, the latter method is, I think, the more useful. Between the ancient and the modern law, there is no breach of continuity; the one has grown out of the other. Whichever method we adopt, the law cannot be made intelligible to the student. Book excerpt: Roman Law, since its earliest days of the XII Tables, to the Justinian code over one thousand years later, is arguably the most influential body of law ever developed, remaining at the core of European legal systems until the end of the eighteenth century and informing the civil law and (to a lesser extent) the common law to this day. The first edition of Peter Buckland's classic textbook on the subject was published in 1921. Professor Peter Stein's revised third edition published in 1963 updated the original so that it reflected Professor Buckland's own later thoughts on the subject until his death in 1945. This revised edition examines the law of the Empire (or classical law) and also tracks later developments, including the legislation of Justinian. It is primarily concerned with the law but historical developments are also kept in view, so as to give the student the broadest perspective on the subject.

To such works of importance dealing with the history of Roman Law as have been published since the date of the first edition, and have come within my reach. NO alteration has been made in the text, except by way of correcting a few verbal inaccuracies. Neither has any attempt been made to critically examine certain theories propounded by the author regarding primitive Roman institutions, such as the origin and effects of mancipation and nexum, even where I might not be disposed to accept all his conclusions. To have done so in detail would have swollen the notes and increased the size of the book to an inconvenient extent. It must always be kept in view that our knowledge of early Roman customs, at least till after the XII.
