Book excerpt: Excerpt from Historical Introduction to the Roman Law In a general course upon the Roman Law, I do not find it profitable to devote any large proportion of the lectures to its history. There are two methods of teaching the Roman Law, both of which have dis tinguished supporters. One is to present it as a thing apart, without reference to the present. The student is left to make any applications which he may see fit. The other method is to show the way in which the Roman Law has grown into the modern Civil Law. In a country like England the former method is the more natural, because the Roman Law and the English Law are essentially different systems. In a country of the Civil Law, like the Province of Quebec, the latter method is, I think, the more useful. Between the ancient and the modern law, there is no breach of continuity; the one has grown out of the other. Whichever method we adopt, the law cannot be made intelligible to the student. Book excerpt: Excerpt from Selections From the Public and Private Law of the Romans: With a Commentary to Serve as an Introduction to the Subject The purpose of this book is to introduce the student to some of the more interesting and instructive principles of Roman law by selected passages from the original Latin sources. It is intended to offer to students of Latin a selection of texts gathered from a field well worthy of study by those who would broaden their view of Roman life and institutions, as well as by those who would extend their acquaintance with the Latin language beyond the Latinity of the authors usually read in a college course. It is scarcely necessary to repeat what is acknowledged on all Sides - that Rome's legal and political institutions are the imperishable monument to the real genius and civilization of her people, and that they constitute her most important contribution to the modern world. Book excerpt: Excerpt from Roman Private Law: Founded on the Institutes of Gaius and Justinian This is an attempt to meet a want which I have felt in teaching Roman Law at Oxford, viz. sonic book which is content to give, as simply as possible, the subject-matter of the Institutes of Gaius and Justinian, following, in the main, the original order of treatment. It has proved impossible to keep strictly within these limits, and while I have sometimes judged it expedient to omit minor details of little practical importance, such as some of the degrees of cognatic relationship, I have also found it necessary, in order to make a coherent statement, to add information not contained in the Institutes, but derived from the Digest, Code, Novels, or from modern Civilians. In some cases, where the evidence is weak or controversy rages, I have ventured to state dogmatically what in a more pretentious work would require qualification. The Historical Introduction presupposes a knowledge of the elements of Roman Constitutional History. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Originally the law of a small rural community, then of a powerful city-state, it became the law of an empire which embraced almost all of the known civilized world. The influence of Roman law extends into modern times and is reflected in the great codifications of private law that have come into existence in Europe, America, and Asia. Even now, Roman law in modified form is the law of the land in Scotland, and the civil code of Louisiana is directly based on Roman law. Forming an important part in the historical and intellectual background of understanding and a basis for further development of the principles of international jurisprudence. In this book an international authority on Roman legal history sets forth in clear, understandable English the institutions of Roman law and traces their development through the Byzantine Empire into medieval and modern Europe. It is an indispensable study for every American lawyer and for anyone interesting in legal and political history.

They arranged law in three groups - (i) law concerning per sons; (2) law concerning things; and (3) law concerning actions. Practically they sub divided 'things' into - (i) property; (2) obligation (3) inheritance. Inheritance' is discussed in the Institutes after property, ' and before 'obligation'; but it is more convenient to take it after obligation.' As the present work is intended to serve as a companion to the Institutes of Justinian, the arrangement of justinian has been, with that exception, substantially followed. In this Edition a Supplementary Glossary explaining the technical terms and phrases employed in the Institutes will, it is hoped, prove convenient and useful to students.
