Book excerpt: This article argues that Article XXIV and special and differential treatment (SDT) provisions of the WTO present a number of constraints and opportunities to the design and scope of the proposed economic partnership agreements between the European Union (EU) and African, Caribbean and Pacific (ACP) countries. It examines the negotiating positions of both sides to argue that were the EU's position to prevail, ACP and other developing countries would likely suffer an erosion of the development principles embedded within the WTO. It is shown that the differences between the two groups over the desirability and/or applicability of negotiating free trade agreements between developed and developing countries under the strict jurisdiction of Article XXIV, and of negotiating agreements on services and the Singapore Issues , amount to a contestation over the principles of reciprocity and SDT within the WTO, and of the scope of the WTO.

Lomé was concerned to be an agreement providing ACP countries better access to European markets in order to push economic development and build up domestic production. The emergence of WTO in 1995 changed the regulatory framework for regional trade agreements in such a way, that Lomé IV could not pass into a fifth version. In order to be compliant with WTO measures, a new agreement was worked out 2000 in Cotonou. It came into power in 2002. The complete establishment of that treaty it is still far from becoming reality, as a considerable number of ACP countries have still not negotiated EPAs. A crucial issue in these negotiations is the division of ACP countries in six groups for regional EPAs. This division does not merge with other regional trade and political networks in Sub-Saharan Africa and does not include all ACP countries. With 'good governance' having emerged as a 'vital' issue in international politics and especially in EU's agenda, a relevant number of non-economic issues found their way into Cotonou agreement. By linking trade agreements and development aid with the spread of European or Western democracy 'standards' those different fields were brought into contact. The major question of the following research shall be, whether EU trade policy towards ACP countries is supposed to be an instrument serving the diffusion of human rights and democracy or rather a 'smoke screen

Further on, the research chapter will discuss characteristic matters of EU-ACP relations and put into focus chances and perils of conditional economic cooperation and development aid.

Book excerpt: This paper deals with the Economic Partnership Agreements (EPAs) between the European Union (EU) and the group of African, Caribbean and Pacific (ACP) countries. It addresses the question why the EU firmly insisted on upholding the negotiating deadline for these new trade agreements, despite the very damaging consequences; these hastily initialed trade deals entailed. Regional integration in the South was hampered; the development of the friendly image of the EU got a serious blow; the EU did not manage to include the WTO plus issues, and the prospect of full EPAs at later stage is not guaranteed. We first qualify the Union's argument to the expiry of a waiver by the World Trade Organization (WTO), which legitimized the former trade regime, and placed an external and insurmountable pressure on the negotiations. There is no rational explanation for Europe's harsh attitude on the EPA deadline, since neither legal, nor economic interests would have been harmed, if the deadline had been postponed. The main argument advanced in this article addresses whether the EU had to push through these trade deals, because it had entrapped itself through its own 'rhetorical action'. In its negotiation discourse, the European Commission (EC) had so often emphasized the deadline together with the fact that there were no alternatives to EPAs, that it could not change its mind overnight, when at the end of the 2007 negotiations they were still going nowhere. The Union was forced to keep up with the deadline it had imposed upon itself with the risk of losing all its credibility.

Book excerpt: The proliferation of regional trade agreements (RTAs) which share similar ideals with the World Trade Organization (WTO) has added to claims of disintegration within international trade law. Notwithstanding the ambiguity surrounding the reading of General Agreement on Tariffs and Trade (GATT) Article XXIV on RTAs, WTO Members are continuously negotiating RTAs with objectives which have so far not received universal acceptance under the WTO treaty system. In the context of European Union (EU)-Africa trade relations, the December 2007 EU-Africa summit was expected to be an appropriate venue for leaders from both sides to resolve the controversy surrounding the idea of development-friendly free trade agreements between the contracting parties. But, the summit was wrapped up without achieving any clear answer to this issue. Similarly, at the multilateral level, i.e. the WTO Doha Development Round negotiations, which the EU and the African, Caribbean and Pacific Group of States have sponsored, numerous development-friendly proposals on RTAs stalled since July 2006. Consequently, in view of this controversy, if development concerns can be factored into economic partnership agreements (EPAs), what would be an acceptable threshold for such RTAs to conform to GATT Article XXIV requirements of “substantially all trade” and “reasonable period of time”? This paper discusses the idea of development and WTO compatibility in the context of the EU-Africa Economic Partnership negotiations. In view of the flawed dispute settlement provisions under the Cotonou Partnership Agreement (CPA), the paper further tries to answer the question of whether the CPA contains rights and obligations that need protection by individual EU member courts and may necessarily be enforced before the European Court of Justice. The paper ends with some thoughts on the post-EPAs adjustment programme.

All these initiatives have a potentially detrimental impact on regional integration.
