Book excerpt: The Food Safety Modernization Act, passed in early 2011, is the most significant overhaul of the Food and Drug Administration's food-safety authority since 1938. It reorients FDA to a preventive rather than responsive stance toward food contamination. The Act, however, will fall short of its goal of ensuring the safety of the food supply, for several reasons. It will be ineffective in significantly reducing foodborne illness because it is underfunded, and provides for too many exemptions. The use of preventive controls and science-based standards may also make it difficult for regulation to evolve as quickly as pathogens. In addition, the uncertainty caused by the Act's attempt to incorporate flexible standards for smaller producers will inhibit market entry for small producers focused on marketing their products locally. Moreover, the Food Safety Modernization Act cements the disparate regulatory spheres of authority over food systems in the United States: on the one hand, rigid federal standards, and on the other a patchwork of state and local regulations, all of it haphazardly enforced. What is needed is a system of centralized decentralization, where states have broad flexibility to establish the structure of their food-system regulation, but are comprehensively overseen by the federal government. Such a system would improve information gathering and crisis-prevention capabilities, and would also serve a rationalizing function among the various spheres of regulatory authority over food. Furthermore, federal oversight of state food-system plans would allow for localities to incorporate other aspects of food safety beyond foodborne illness in food-system design.

For the first time in legal literature this book analyses private law initiatives relating to the food chain, often referred to as private (voluntary) standards or schemes. Private standards are used to remedy flaws in legislation, in order to reach higher levels of consumer protection than the ones chosen by the EU legislature and to manage risks and liability beyond the traditional limits of food businesses. We see that litigation is no longer solely framed by legislative requirements, but ever more by private standards such as GlobalGAP, BRC, IFS, SQF and ISO. These private standards incorporate public law requirements thus embedding them in contractual relations and exporting them beyond the jurisdiction of public legislators. Other standards focus on corporate social responsibility or sustainability. This book also addresses how private religious standards such as Kosher and Halal play a role in defining specific markets of growing importance. It is noted that organic standards have found an interesting symbioses with public law. Another development on this topic is that food businesses are inspected more often by private auditors than by public inspectors. Effects in terms of receiving or being denied certification far outweigh public law sanctions. In short private law has changed an entire legal infrastructure for the food sector. Book excerpt: While food consumption is a pre-requisite for human life, the effects of the modern diet can be dire. Modern unhealthy diets have been linked to a variety of negative health conditions. These include diabetes, ischaemic heart disease, stroke, cancer, and the obesity epidemic. Globally, an unhealthy diet is considered to be a factor in one-fifth of deaths. Alas, 69 percent of Americans are either overweight or obese. This may lead to further negative externalities, imposing significant costs on public health systems. For instance, the total annual cost of the obese population in the USA alone is estimated to be more than $315 billion. In light of this reality, regulators around the world have been striving to create markets where consumers are more informed of their nutritional choices. Front-of-package food labeling is a prime example. Such labeling is designed to simplify food choices for consumers and help them make healthier decisions.Indeed, regulators in several countries have implemented labeling systems that provide consumers with an explicit label that aspires to communicate the health-related value of foods. Nonetheless, the current regulatory efforts are underdeveloped, ununified, partial in scope and under-theorized. This study bridges some of this gap.The Article is organized as follows: Part I introduces the law and policy landscape of food health labeling, focusing on the notions of information asymmetry, credence qualities and dual reasoning. Part II then discusses the problems with, and limitations of, the Health Star Rating system. The system, currently implemented in Australia and New Zealand, is the most recent system to be introduced in a common law country. Next, Part III looks into three other key food health labeling methods employed in different parts of the world. Thereafter, Part IV provides specific legal recommendations and policy suggestions. Subsequently, Part V addresses some important critiques with respect to our proposals. A brief conclusion follows.
