Book excerpt: The pardon is an act of mercy, tied to the divine right of kings. Why did New York retain this mode of discretionary justice after the Revolution? And how did governors’ use of this prerogative change with the advent of the penitentiary and the introduction of parole? This book answers these questions by mining previously unexplored evidence held in official pardon registers, clemency files, prisoner aid association reports and parole records. This is the first book to analyze the histories of mercy and parole through the same lens, as related but distinct forms of discretionary decision-making. It draws on governors’ public papers and private correspondence to probe their approach to clemency, and it uses qualitative and quantitative methods to profile petitions for mercy, highlighting controversial cases that stirred public debate. Political pressure to render the use of discretion more certain and less personal grew stronger over the nineteenth century, peaking during constitutional conventionsand reaching its height in the Progressive Era. Yet, New York’s legislators left the power to pardon in the governor’s hands, where it remains today. Unlike previous works that portray parole as the successor to the pardon, this book shows that reliance upon and faith in discretion has proven remarkably resilient, even in the state that led the world toward penal modernity.

And while there have been a fair number of institutional studies-studies of individual district courts or courts of appeal--there have been very few studies of the judiciary that emphasize the judges themselves. Federal Judges Revealed considers approximately one hundred oral histories of Article Three judges, extracting the most important information, and organizing it around a series of presented topics such as "How judges write their opinions" and "What judges believe make a good lawyer."

Book excerpt: The Discretionary Economy argues that we do in fact control our own political and economic destinies. As a community, we have discretion over policies that determine whether an economic process adequately provides for the necessities of life. We also determine who participates in normative public judgments and whether decisions distinguish between what is and what ought to be. Tool argues that we must continuously organize the institutional structures through which economic and political functions in the social process are carried on. We must exercise discretion by creating and modifying institutions that coordinate our behavior. To exercise discretion effectively requires that we employ distinctively American economic, political, and philosophical theory. In this volume, the pivotal twentieth-century contributors to this encompassing theory of political economy are Thorstein Veblen, John Dewey, Clarence Ayres, and R. Fagg Foster. This volume presents, in detail, their analytical and philosophical perspective on social change. A major purpose of this volume is to compare and contrast the American tradition with the traditions of capitalism, Marxism, and fascism, demonstrating that the former can resolve compelling economic and political problems and the latter two cannot. This book explains how to identify and analyze social, economic, and political problems confronted in all communities, and how to go about framing and implementing structural adjustments in the political economy. It will be of interest to students in non-traditional courses in political economy including institutional economics, contemporary social problems, economics and social policy, methodology, and contemporary economic thought.

Book excerpt: This handbook details an EU case law approach to the concept of discretionary eligibility within the context of public procurement. It provides examples from the jurisprudence of the Court of Justice of the European Union (CJEU) in order to provide insights into applicable discretionary power on the part of the contracting authority. The measurement of its tolerable range, as shown here, is directly related to the entire range of European law, and in particular to the general principles guiding its very own European spirit. Both EU and WTO grammatical interpretations are highlighted here as legitimized limits to the discretionary power exercised by public authorities.

Book excerpt: This prize-winning account of the pre-Reformation church recreates lay people's experience of religion, showing that late-medieval Catholicism was neither decadent nor decayed, but a strong and vigorous tradition. For this edition, Duffy has written a new introduction reflecting on recent developments in our understanding of the period. Book excerpt: Handbook on the Consequences of Sentencing and Punishment Decisions, the third volume in the Routledge ASC Division on Corrections & Sentencing Series, includes contemporary essays on the consequences of punishment during an era of mass incarceration. The Handbook Series offers state-of-the-art volumes on seminal and topical issues that span the fields of sentencing and corrections. In that spirit, the editors gathered contributions that summarize what is known in each topical area and also identify emerging theoretical, empirical, and policy work. The book is grounded in the current knowledge about the specific topics, but also includes new, synthesizing material that reflects the knowledge of the leading minds in the field. Following an editors’ introduction, the volume is divided into four sections. First, two contributions situate and contextualize the volume by providing insight into the growth of mass punishment over the past three decades and an overview of the broad consequences of punishment decisions. The overviews are then followed by a section exploring the broader societal impacts of punishment on housing, employment, family relationships, and health and well-being. The third section centers on special populations and examines the unique effects of punishment for juveniles, immigrants, and individuals convicted of sexual or drug-related offenses. The fourth section focuses on institutional implications with contributions on jails, community corrections, and institutional corrections.
