Focusing on the LoDagaa of northern Ghana and their relationship with British colonialism, Hawkins describes colonialism as an encounter between a world of experience – a world of knowledge, practice, and speech – and "the world on paper" – a world of writing, rules, and a linear concept of history. The various ways in which "the world on paper" affected the LoDagaa are examined thematically. The first four chapters explore how writing imposed a form of historical consciousness on different aspects of LoDagaa culture – identity, politics, and religion – that was alien to them. The second half of the book examines how both the British colonial state and its postcolonial successor, the Ghanian state, attempted to regulate indigenous forms of knowledge, gender relations, and social reckoning through courts. The question central to this book is how to co-operate with people, the various categories of residents as well as non-residents, in the rural areas: in a top-down, a participatory or a contractual (co-management) way. On the basis of a comparative analysis of 12 case studies in the book, these three approaches are thoroughly discussed and their internal and external constraints examined. The book starts with an editorial chapter, discussing the recent administrative and political developments in Africa as well as the new opportunities, which they offer for policies in the field of environment, and development. The question is brought up whether the recent processes of decentralization, democratization, and empowerment of local organizations have indeed created new opportunities or that they have only superficially changed the political culture of the countries concerned. In the concluding chapter of the book, the approaches are contrasted to each other as logical models, each with its own potentiality and limitations. Conclusions are formulated why the top down approach must result in improvization to escape from failure, and why the participatory approach risks to end up into a mixed balance. Special attention is given to the conditions and the prospects for the contractual or co-management approach, which has been introduced into Africa only recently. Under certain conditions, this approach seems rather promising.

Freely translated, this proverb of the Ovakwanyama of northern Namibia means: "New leaves produce a good shade; the laws of a king are always as good as new". The proverb paints a picture of wisdom to express the dialectical relationship between continuity and change in customary law. Since royal orders are supposed not to change from one king to the next, they are always as good as new, reads the explanatory note to the proverb by the anthropologist Loeb, who recorded the proverb. Traditional authority is like a tree standing on its roots, rooted in the tradition created by the ancestors of the ruler and the community. These roots remain firm, stable and unchanged, not so the concrete manifestation of authority that changes and responds to changes of the environment. This makes that new leaves are produced by the rooted tree. The new leaves are new and old. They are old, because in structure, colour and their capacity to protect by giving shade, they are more or less like the leaves of last year and the year before; they are new because they react to the challenge of seasons. The Shade of New Leaves emerged out of an international conference on the living reality of customary law and traditional governance held in Windhoek in 2004. The conference was organised by the Centre for Applied Social Sciences and the Human Rights and Documentation Centre, both affiliated to the Faculty of Law of the University of Namibia, in co-operation with the Law Departments of the Universities of Bremen, Germany, and the School of Oriental and African Studies, University of London.
