Book excerpt: Constituting 'Quick Clearance Laws', three types of general legislation Move Over, Driver Removal, and Authority Removal laws - support concurrent Quick Clearance operations intended to enhance motorist and responder safety, as well as reduce congestion and delay. Although a number of States currently have one or more of these laws in place, observed variability in the existence, wording, and coverage of Quick Clearance Laws challenges further implementation. The intent of this investigation was to better support Quick Clearance Law implementation efforts by better preparing States to respond to questions regarding the necessity of Quick Clearance legislation and identifying examples from existing State Move Over, Driver Removal, and Authority Removal legislation that serve to both support and challenge successful incident management operations. Through this investigation, carefully crafted statutory content and language that best support Quick Clearance objectives, and agency/industry partnerships that provide demonstrated, united support for safe, Quick Clearance objectives and related legislation were observed to be key factors supporting implementation of Quick Clearance Laws. This report includes: (1) a description of the role and relevance of Quick Clearance Laws in the broader traffic incident management context; (2) a detailed review of the purpose and intent, model language, observed content trends and anomalies, and implementation challenges and resolutions for Move Over, Driver Removal, and Authority Removal laws including specific examples from State legislation; and (3) concluding remarks and proposed strategies for implementation, including beneficial synergy resulting from combined Quick Clearance Law implementation.

Book excerpt: Improving traffic incident management is one means to help reduce congestion, as traffic incidents account for approximately 25 percent of total congestion on U.S. highways. Between July and September 2012, 330 collisions were recorded for the I-66 corridor in Northern Virginia alone, of which 82 required more than 1 hour to clear. To improve its incident management efforts, the Virginia Department of Transportation’s (VDOT) Northern Region Operations recently piloted a quick clearance policy called Operation Instant Tow. With an instant tow concept, a tow truck and a Virginia State Police trooper are dispatched simultaneously to the site of specific incident types (e.g., lane blocking events), thus reducing clearance time. VDOT’s Operations Division is interested in the potential expansion of this initiative to other operations regions and the employment of other quick clearance initiatives currently not executed in Virginia. The purpose of this study was (1) to investigate traffic incident management initiatives including quick clearance practices and policies used by other state departments of transportation; (2) to assess the feasibility of adopting strategies that are not currently implemented in Virginia; and (3) to provide emergency responders and VDOT staff with a tool to estimate the benefits of clearing an incident quickly, individualized for a particular incident, location, and time. The tool would provide an incident commander with real-time information on the costs to the traveler from extended lane closures. The guidance and data tool developed in this study will provide VDOT with additional mechanisms to broaden and strengthen its outreach to the responder community and improve real-time awareness of incident lane closure costs. The guidance on quick clearance is intended to support statewide implementation of strategies to improve incident response and clearance times. Implementing this guidance will provide strengthened interagency coordination and cooperation resulting in measurable benefits for traffic incident management.

The project TMP should consist of a collection of administrative, procedural, and operational strategies for managing and mitigating the impacts of work zones. It is important for planners, operations personnel, and incident responders to understand why the transportation operation elements are vital in the process of developing the TMP. This document addresses the special needs and concerns when managing traffic incidents within a work zone and focuses on incident management as a strategy to be considered in the transportation operations component of the TMP. A description of techniques and strategies that can be used to handle incidents in work zones is presented. Some trend-setting approaches used on high-profile construction projects are also showcased as examples of good incident response planning incorporated at the design level. The contractor's role in dealing with incidents within the work zone is addressed as well as the description of processes, procedures, and practices related to the detection, response, and clearance of incidents. The importance of including incident management procedures as an element of the transportation operations component of these plans is emphasized. The goals, objectives, and reasons for incident management as well as the issues and concerns that work zone planners, incident responders, and traffic operators need to consider in the planning phases of a work zone project are presented. Common work zone incident management strategies are described.
