Book excerpt: This document presents testimony from a congressional hearing examining the Child Abuse Prevention, Adoption, and Family Services Act. In response to the General Accounting Office's (GAO's) concerns about the ability of the National Center on Child Abuse and Neglect (NCCAN) to perform its leadership role in identifying, preventing, and treating child abuse and neglect, this hearing was called to determine the progress made by NCCAN in the 9 months since the GAO concerns were raised and to make a recommendation on the length of the reauthorization for NCCAN. Testimonies focus on the NCCAN role; the role of the U.S. Advisory Board on Child Abuse and Neglect; expansion of child abuse, adoption, and family services programs; and child abuse fatalities. Opening statements are included from Representatives Major R. Owens and Donald M. Payne. A statement from Lesley Wimberly, president, National Association of State Vocal Organizations is presented by Representative William F. Goodling. Witnesses providing testimonies include: (1) Wade Horn, commissioner, Administration for Children, Youth, and Families, Department of Health and Human Services; (2) Joseph Delfico, director, Income Security Issues, GAO; (3) Howard Davidson, U.S. Advisory Board on Child Abuse and Neglect; (4) Tom Birch, Legislative Counsel, National Child Abuse Coalition; (5) Michael Durfee, Child Abuse Prevention Unit, Department of Health Services, Los Angeles, California; (6) Mary Margaret Oliver, State Representative, Georgia State Legislature; and (7) Susan Wells, director, Child Maltreatment Fatalities Project, American Bar Association's Center on Children and the Law, Chapel Hill, North Carolina. Book excerpt: The Preventing Sex Trafficking and Strengthening Families Act (H.R. 4980), an omnibus bill that includes both child welfare and child support provisions, was signed into law on September 29, 2014, as P.L. 113-183. The bill received broad congressional support, passing the House by voice vote (under suspension of the rules) on July 23, 2014, and the Senate by unanimous consent on September 18, 2014. P.L. 113-183 amends the federal foster care program to require state child welfare agencies to develop and implement procedures for identifying, documenting in agency records, and determining appropriate services for certain children or youth who are victims of sex trafficking, or at risk of victimization. State child welfare agencies must also report to law enforcement and the U.S Department of Health and Human Services (HHS), which administers child welfare programs, about such victims. In addition, HHS must establish a national advisory committee on child sex trafficking that must, among other responsibilities, develop policies on improving the nation's response to domestic sex trafficking. P.L. 113-183 also includes provisions to direct child welfare agencies to develop protocols on locating children missing from care. The law also seeks to ensure children in foster care have the opportunity to participate in activities that are appropriate to their age and stage of development. It requires changes in state foster home licensing law to enable foster caregivers to apply a "reasonable and prudent parenting" standard when determining whether a child in foster care may participate in activities; and directs state child welfare agencies to provide training to caregivers on using this standard. Other provisions in the law seek to ensure permanent adult connections for older children and better aid their transition to successful adulthood. Under the new law, states are not permitted to assign a permanency plan of "another planned permanent living arrangement" (APPLA) to any child under the age of 16, and must take additional steps to support permanency for children age 16 or older who are assigned that permanency plan. Further, children in foster care who are age 14 or older must be consulted in the development of, and about any revisions to, their case and permanency plans. They must also be made aware of their rights while in care, including the right to receive critical documents (e.g., birth certificate, Social Security card) when they "age out" of care. P.L. 113-183 separately extends funding authority for Adoption Incentive Payments for three years (FY2014-FY2016). It phases in a revised incentive structure that allows states to earn incentive payments for both adoptions and exits from foster care to legal guardianship, places additional focus on finding permanent homes for older children, and strengthens the way state performance is gauged under the program. The law requires 30% of any state savings (resulting from broadening federal eligibility for adoption assistance) to be used for family strengthening services, including post-adoption services. It also includes provisions to ensure continued federal assistance under the Title IV-E program for eligible children who, following the death or incapacitation of their legal guardian, are placed with previously named successor guardians. Separately, the law appropriates $15 million to continue Family Connection Grants for one year. These grants are intended to strengthen children's connections to their parents and other relatives.

Available in PDF, EPUB and Kindle. Book excerpt: This book examines the role of the federal courts in policymaking for children. Believing that the federal courts are uniquely situated to provide relief to the less powerful in society, Mezey assesses the judiciary's response to the demands for children's rights and benefits across a number of policy areas and a range of statutory and constitutional issues. Through analysis of Supreme Court and lower court opinions over the last several decades, she determines the extent to which federal court decisionmaking has affected the legal, political, economic, and social status of children in the United States.

Book excerpt: Ireland has shown a strong commitment to addressing child poverty and improving outcomes for children and young people. Responding to the needs of children and young people, particularly those most vulnerable, requires integrated policies and services. This report is part of a joint project between the OECD and the European Commission to strengthen policy and governance arrangements for tackling child poverty and improving outcomes for children and young people based on a whole-of-government approach. The report assesses recent policy, institutional and legislative developments in Ireland and compares outcomes for children and young people with those in other EU and OECD countries. It finds that despite progress, Ireland still has room for improvement on child poverty reduction, and more can be done to address the trust gap between young people in Ireland and their government. The report recommends Ireland to adopt measures to enhance inter-departmental and inter-agency co-operation, strengthen evidence-informed approaches, reinforce policy monitoring tools, and improve accountability mechanisms. It also recommends measures to support the effective implementation of Young Ireland, the National Policy Framework for Children and Young People (2023-28), and to ensure policy coherence.

Available in PDF, EPUB and Kindle. Book excerpt: With the adoption of the United Nations Convention on the Rights of the Child (1989), commentators began to situate the evolution of the status of children within the context of the “property to persons” trajectory that other human rights stories had followed. In the first edition of A Question of Commitment, editors R. Brian Howe and Katherine Covell provided a template of analysis for understanding this evolution. They identified three overlapping stages of development as children transitioned from being regarded as objects to subjects in their own right: social laissez-faire, paternalistic protection, and children’s rights. In the social laissez-faire stage, children are regarded as objects, and largely as the property of parents. In the paternalistic protection stage, children are seen as vulnerable and in need of protection. The children’s rights stage lays emphasis on children as rights-bearers, as individuals in their own right with entitlements. In this second edition, new essays assess the extent to which children’s rights have been incorporated into their respective areas of policy and law. The authors draw conclusions about what the situation reveals about the status of children in Canada. Overall, many challenges remain on the pathway to full recognition and citizenship.

Available in PDF, EPUB and Kindle. Book excerpt: Child well-being, which covers everything from family relationships to their material well-being, is now increasingly being talked about in policy and practice nationally and internationally. However, a lack of clarity remains about what the idea really means and how it can help children. This book brings together contributions from international experts in order to define child well-being and to further understand how it can improve children's lives. Issues covered include how the idea is being used in government policy and practice in the UK and USA, how children can contribute to the understanding of child well-being, recent advances in the exploration of indicators and measures of well-being, and the importance of context in making comparisons. A concluding chapter explores whether child well-being is a useful concept in understanding children's lives, whether it positively contributes to policy and practice, and the value of international comparisons. This edited collection is essential reading for all those involved in understanding children's lives and who have responsibility for improving them, including practitioners, policymakers, students and academics.
