Book Synopsis Canada's Trial Courts by : Peter H. Russell
Download or read book Canada's Trial Courts written by Peter H. Russell and published by University of Toronto Press. This book was released on 2007-01-01 with total page 297 pages. Available in PDF, EPUB and Kindle. Book excerpt: One of the most important but least examined aspects of the Canadian judicial system is the dual structure of civil and criminal trial courts. Canada's Trial Courts examines the co-existence, in every province, of superior courts (presided over by federally appointed judges) and 'lower' courts (staffed by provincially appointed judges). Combining both political and legal analysis, this is the first book to provide an in depth study of the evolution and operation of Canada's trial courts. This collection of essays begins with an exploration of the constitutional origins of Canada's integrated court system and the failure of federal and provincial governments to cooperate in its development. Following are discussions of a number of contemporary reform projects in various jurisdictions, including Quebec, Nova Scotia, Alberta, and Nunavut, as well as examinations of competing visions of how Canada's trial courts should be organized in the future. To put the issue in a comparative perspective, the concluding section provides examples of how trial courts have been restructured in the United Kingdom and the state of California. Proposing a range of practical alternatives to the present system, the volume offers a ground-breaking legal analysis that addresses constitutional obstacles to trial court reform, and assesses the political factors that influence reform at the judicial level. Featuring distinguished contributors from a variety of disciplinary backgrounds, Canada's Trial Courts offers a comprehensive and up-to-date examination of an important but neglected issue that ultimately has a profound impact on the quality of justice that Canadians experience.

This book was released on 2011-01-01 with total page 529 pages. Available in PDF, EPUB and Kindle. Book excerpt: Essential Readings in Canadian Constitutional Politics introduces students, scholars, and practitioners to classic authors and writings on the principles of the Canadian Constitution as well as to select contemporary material. To complement rather than duplicate the state of the field, it deals with the Canadian Charter of Rights and Freedoms and with Canadian mega-constitutional politics in passing only, focusing instead on institutions, federalism, intergovernmental relations, bilingualism and binationalism, the judiciary, minority rights, and constitutional renewal. Many of the selections reverberate well beyond Canada's borders, making this volume an unrivalled resource for anyone interested in constitutional governance and democratic politics in diverse societies.

Download or read book Captive Court written by Ian Bushnell and published by McGill-Queen's Press - MQUP. This book was released on 1992-10-08 with total page 619 pages. Available in PDF, EPUB and Kindle. Book excerpt: Throughout his study, Bushnell investigates the question of the absence of an independent judicial tradition in Canada and the development of distinct legal doctrine by the Supreme Court. He analyses the nature and cause of the lack of independent thought that makes the Court "captive" to inherited traditions and legal doctrines and prevents it from achieving its true potential within the Canadian legal system. Previous studies of the Court have concentrated on the years after 1949; by expanding the coverage to include the first three-quarters of a century of the Court's existence, Bushnell has uncovered a critical aspect of Canadian legal history. Bushnell provides an analysis of more than eighty cases decided by the Court between 1876 and 1989. He examines the backgrounds and views of the sixty-seven judges who served on the Supreme Court during this period, evaluating both the role they felt they played in Canadian society and the role others expected them to play. He studies the question of the right of appeal to the Judicial Committee of the Privy Council and its effect on the Supreme Court, as well as the movement toward the abolition of appeal. In the concluding part of the study Bushnell considers the controversy over the demand for impartial justice, criticism of the judiciary, and the judges who will take the Court into the twenty-first century.

This book was released on 2003 with total page 401 pages. Available in PDF, EPUB and Kindle. Book excerpt: In recent years Canada's Senate, Parliament's chamber of sober second thought, has often been the subject of controversy and calls for reform. Protecting Canadian Democracy examines the history, role, and evolution of the Senate; places it in the context of other federal systems; and contrasts its role with that of provincial governments. Contributors analyse the Senate's use of its legislative powers, comparing it with the House of Commons, and assess the Senate's contribution to public policy development and review, showing how the upper chamber functions as a forum within Parliament for the representation of Canada's diverse regional, linguistic, cultural, and socio-economic interests. contending that the Senate should be improved by means that do not require formal amendments to the Constitution. The authors identify possibilities for reform the institution within the current constitutional framework, addressing the Senate's veto power, its appointment process, and its legislative independence. A valuable appendix of charts and statistics on the composition and operation of the Senate is also provided.

Book Synopsis Limiting Arbitrary Power by : Marc Ribeiro
Download or read book Limiting Arbitrary Power written by Marc Ribeiro and published by UBC Press. This book was released on 2004 with total page 220 pages. Available in PDF, EPUB and Kindle. Book excerpt: Under the emerging void-for-vagueness doctrine, a law lacking precision can be declared invalid. In this, the first book published on the subject, Marc Ribeiro offers a balanced analysis of this doctrine and its application in the context of the Canadian constitution. Taking as its starting point a cogent analysis of the fundamental concepts of "legality" and the "rule of law," Limiting Arbitrary Power undertakes a specific study of the contents of the vagueness doctrine. Dr. Ribeiro presents an in-depth exploration of the courts' current approach, and suggests how it may be refined in the future. In that regard, he proposes techniques for legislative drafting in which certainty could be enhanced without compromising the flexibility required in law. Acknowledging that to date, the doctrine has yet to be granted an autonomous status for invalidating legislation, he also examines in detail the possible situations in which vagueness may become applicable under the Charter. An important addition to Canadian law libraries, Limiting Arbitrary Power will be eagerly received by legal professionals, legislators, and scholars of constitutional law and legal theory.

Book Synopsis Red, White, and Kind of Blue? by : David Schneiderman
Download or read book Red, White, and Kind of Blue? written by David Schneiderman and published by University of Toronto Press. This book was released on 2015-10-06 with total page 325 pages. Available in PDF, EPUB and Kindle. Book excerpt: Situated between two different constitutional traditions, those of the United Kingdom and the United States, Canada has maintained a distinctive third way: federal, parliamentary, and flexible. Yet in recent years it seems that Canadian constitutional culture has been moving increasingly in an American direction. Through the prorogation crises of 2008 and 2009, its senate reform proposals, and the appointment process for Supreme Court judges, Stephen Harper’s Conservative government has repeatedly shown a tendency to push Canada further into the US constitutional orbit. Red, White, and Kind of Blue? is a comparative legal analysis of this creeping Americanization, as well as a probing examination of the costs and benefits that come with it. Comparing British, Canadian, and American constitutional traditions, David Schneiderman offers a critical perspective on the Americanization of Canadian constitutional practice and a timely warning about its unexamined consequences.
