Book excerpt: In September 2018 the criminal law section of the 72nd Deutscher Juristentag (DJT, “German Assembly of Jurists”) debated the question “Sentencing Guidelines vs. Free Judicial Discretion – Is German Sentencing Law in Need of Reform?” Despite the expert opinion provided by Johannes Kaspar and the accompanying scholarly commentaries, ensuing proposals for fundamental reform met with rejection. The comparative perspective was limited to the US Federal sentencing guidelines. The intention of this volume is therefore, on the one hand, to draw a more nuanced picture of Anglo-American sentencing law focusing on three legal systems (England/Wales, USA and Canada) accompanied by commentaries from a German perspective; on the other hand, we want to make the German perspective (better) known within the Anglo-American legal world by reproducing important DJT documents in English language. To ensure the widest possible distribution we opted for a bilingual open access publication.

Book excerpt: All modern sentencing systems, in the US and beyond, consider the offender's prior record to be an important determinant of the form and severity of punishment for subsequent offences. Repeat offenders receive harsher punishments than first offenders, and offenders with longer criminal records are punished more severely than those with shorter records. Yet the vast literature on sentencing policy, law, and practice has generally overlooked the issue of prior convictions, even though this is the most important sentencing factor after the seriousness of the crime. In Paying for the Past, Richard S. Frase and Julian V. Roberts provide a critical and systematic examination of current prior record enhancements under sentencing guidelines across the US. Drawing on empirical data and analyses of guidelines from a number of jurisdictions, they illustrate different approaches to prior record enhancements and the differing outcomes of those approaches. Roberts and Frase demonstrate that most prior record enhancements generate a range of adverse outcomes at sentencing. Further, the pervasive justifications for prior record enhancement, such as the repeat offender's assumed higher risk of reoffending or greater culpability, are uncertain and have rarely been subjected to critical appraisal. The punitive sentencing premiums for repeat offenders prescribed by US guidelines cannot be justified on grounds of prevention or retribution. Shining a light on a neglected but critically important topic, Paying for the Past examines the costs of prior record enhancements for repeat offenders and offers model guidelines to help reduce racial disparities and reallocate criminal justice resources for jurisdictions who use sentence enhancements.

Book excerpt: The question of how ordinary people related to totalitarian regimes is still far from being answered. The tension between repression and consensus makes analysis difficult; where one ends and the other begins is never easy to determine. In the case of fascist Italy, recent scholarship has tended to tilt the balance in favour of popular consensus for the regime, identifying in the novel ideological and cultural aspects of Mussolini's rule a 'political religion' which bound the population to the fascist leader. The Party and the People presents a different picture. While not underestimating the force of ideological factors, Paul Corner argues that 'real existing Fascism', as lived by a large part of the population, was in fact an increasingly negative experience and reflected few of those colourful and attractive features of fascist propaganda which have induced more favourable interpretations of the regime. Distinguishing clearly between the fascist project and its realisation, Corner examines the ways in which the fascist party asserted itself at the local level in the widely-differing areas of Italy, at its corruption and malfunctioning, and at the mounting wave of popular resentment against it during the course of the 1930s - resentment and hostility which, in effect, signalled the failure of the project. The Party and the People, based largely on unpublished archival material, concludes by suggesting that the abuse of power by fascists mirrors much wider problems in Italy related to the relationship between the public and the private and to the modes of utilisation of power, both in the past and in the present.
