Book excerpt: Excerpt from Readings on the Relation of Government to Property and Industry This volume has been prepared, primarily, for use in a class studying the relations of government to industry, a subject just now in that eager ferment through which all important issues pass before reaching even a temporary equilibrium. We are in the midst of swift changes affecting business and property, changes that touch the daily activities of everyone at the bread-and-butter point. We cannot be said to have reached a fixed policy. Even the courts, those sanctuaries of stability, are groping their way along the new paths of "police power" and are attempting the difficult task of reconciling our constitutional traditions with new administrative functions. There can be, therefore, very little permanent literature upon so shifting a subject. But there is a vast amount of current literature, and this volume attempts to bring together some of the most significant of these current discussions. Inasmuch as the question of the relation of government to business and property is principally one of constitutional and legal relations, the articles here reprinted are largely of a legal nature, and most of them have been taken from a source heretofore almost entirely neglected by the lay student, the law journals, repositories of much careful research and concise thinking on this subject. While attempting to avoid controversial material, it has been necessary to present various phases of issues still in the propagandist stage. The arrangement of the material has followed a seemingly natural sequence. One necessarily begins with the presentation of the changing conceptions of property obligations and of governmental functions; this leads to a discussion of the expanding police power, as sanctioned by state and federal courts. The problem of the control of corporations, the financial enginery of all our important industries to-day, directs one's attention to the organization, functions, and powers of commissions - the device we have adopted for making governmental regulation of public utilities effective. The development of labor laws further affects profoundly our ideas of property obligations and the functions of government. Perhaps we should expect that all these tendencies lead to the centralization of federal control over state business. The new amendments to the Anti-trust Law and the new Federal Trade Commission Act are at present the apex of this centralization. The writer tried to convey his conviction that the question of Government ownership of public utilities and especially railroads in the United States is essentially one not of railroad management and operation itself, but of general economics and politics. To his mind, Government ownership of public utilities means absolute Government control not only of the industries but also of the politics in the various States and in the Union generally. It means practically, if not formally, abolition of our democratic institutions and of the very spirit of democracy, and substitutes for the rule of the people, for the people, and by the people, an autocracy of the central government. It means abolition of the present division of the country into forty-eight sovereign and independent States, and reduction of the States to simple electral districts, as well as loss by the States of their rights to tax railroad properties within their boundaries as an exercise of their right of sovereignty. It means also forcing into politics our great corporations, and introducing a spirit of corruption and political subserviency at a time when the spirit of militant democracy is awakened in the land by the events of the past four years. It means also giving one of the most potent arguments into the hands of the extreme socialist groups and thus reinforcing the sinister cohorts of enemy and Bolshevist propaganda. The writer desires to make it perfectly clear that at no time does he wish to imply that advocates of Government ownership are harboring such intentions as abolishing the democratic institutions of this country or assisting the enemy in his vicious endeavor to disorganize and destroy our nation. In a matter of national life, however, it is not the intentions that count but the facts, and it is with facts and not intentions that the author of the present book has tried to deal. We prepared by studying industrial government in books, papers and pamphlets from Russia to Australia. We selected as large variety of types that had successful experience as we could find. America has examples of every kind, from industrial autocracy to the farthest left wing of revolutionary democracy. We specialized somewhat and had different points of view, which accounts for differences noticeable in the "Inferences." One of us took constitutional government in industry; another took the employer's scheme of management; another the wage-earner's scheme of democracy; another the procedure in settling grievances; another shop representation of employees. We spent from one to five days together in each establishment, with the managers and with the employees. Individuals followed up with separate inquiries, in one case spending two months at one place. The four Wisconsin manufacturers, Messrs. F. J. Sensenbrenner, M. O. Wertheimer, D. E. Everest, and Judson Rosebush, who financed the bulk of our traveling expenses, and Maj. E. A. Fitzpatrick, of the State Board of Education, who aided us greatly, wished to know the best practice in dealings with labor that the country affords.
