Tuttavia, le numerose e significative novità intervenute sia sul piano costituzionale che legislativo e giurisprudenziale nei quasi tre anni trascorsi dalla precedente edizione ci hanno spinto a dare alle stampe questo nuovo testo. Si tratta di novità che attengono sia alla forma di governo che alla forma di Stato. Sotto il primo profilo vanno ricordate soprattutto le modifiche che hanno riguardato il numero dei parlamentari e la parificazione dell’elettorato attivo per Camera e Senato. Modifiche che sono appena divenute operative e che già hanno prodotto i loro effetti sul terreno dei regolamenti parlamentari. Modifiche che sono intervenute in un quadro generale, sempre in ordine alla forma di governo, caratterizzato da sviluppi singolari: dalla formazione del Governo Draghi, alla vicenda relativa alla rielezione di Mattarella alla Presidenza della Repubblica, alla conclusione anticipata della legislatura. Tutto ciò mentre risulta ulteriormente accentuata l’atrofizzazione della legge parlamentare. Sotto il secondo profilo, quello della forma di Stato, al di là degli sviluppi legislativi e giurisprudenziali (specie della giurisprudenza costituzionale) in tema di diritti di libertà, va sottolineata la ripresa del dibattito sull’assetto dell’autonomia regionale. Più in particolare, accantonata la prospettiva di rimettere mano al testo del Titolo V della seconda parte della Costituzione, così come riformato nel 2001, sta prendendo corpo l’ipotesi dare attuazione del regionalismo differenziato, previsto dall’art. 116, co. 3, Cost. Tale ipotesi fa oggi parte ufficialmente del programma dell’attuale Governo ma ha suscitato e suscita numerose perplessità in ordine alla sua compatibilità col disegno costituzionale complessivo nonché all’impatto che questo istituto è in grado di produrre sull’impianto generale del nostro regionalismo. Quelli segnalati non sono che alcuni dei profili presi in considerazione per rendere il testo il più possibile aggiornato e avvertito degli sviluppi che si registrano nel nostro contesto poilitico-istituzionale. Book excerpt: This second volume of ReConFort, published open access, addresses the decisive role of constitutional normativity, and focuses on discourses concerning the legal role of constitutional norms. Taken together with ReConFort I (National Sovereignty), it calls for an innovative reassessment of constitutional history drawing on key categories to convey the legal nature of the constitution itself (national sovereignty, precedence, justiciability of power, judiciary as constituted power). In the late 18th and early 19th centuries, constitutional normativity began to complete the legal fixation of the entire political order. This juridification in one constitutional text resulted in a conceptual differentiation from ordinary law, which extends to alterability and justiciability. The early expressions of this ‘new order of the ages’ suggest an unprecedented and irremediable break with European legal tradition, be it with British colonial governance or the French ancien régime. In fact, while the shift to constitutions as a hierarchically ‘higher’ form of positive law was a revolutionary change, it also drew upon old liberties. The American constitutional discourse, which was itself heavily influenced by British common law, in turn served as an inspiration for a variety of constitutional experiments – from the French Revolution to Napoleon’s downfall, in the halls of the Frankfurt Assembly, on the road to a unified Italy, and in the later theoretical discourse of twentieth-century Austria. If the constitution states the legal rules for the law-making process, then its Kelsian primacy is mandatory. Also included in this volume are the French originals and English translations of two vital documents. The first – Emmanuel Joseph Sieyès’ Du Jury Constitutionnaire (1795) – highlights an early attempt to reconcile the democratic values of the French Revolution with the pragmatic need to legally protect the Revolution. The second – the 1812 draft of the Constitution of the Kingdom of Poland – presents the ‘constitutional propaganda’ of the Russian Tsar Alexander I to bargain for the support of the Lithuanian and Polish nobility. These documents open new avenues of research into Europe’s constitutional history: one replete with diverse contexts and national experiences, but above all an overarching motif of constitutional decisiveness that served to complete the juridification of sovereignty. There is a need to adopt a transdisciplinary approach to multifunctional agriculture in order to integrate the agroecological paradigm in legal regulation. This does not require a super-law that hierarchically purports to incorporate and supplant the existing legal fields; rather, it calls for the creation of a trans-law that progressively works to coordinate interlegalities between different legal fields, respecting their autonomy but emphasizing their common historical roots in rus in the process. Rus, the rural phenomenon as a whole, reflects the plurality and interdependence of different complex systems based jointly on the land as a central point of reference. “Rural” is more than “agricultural”: if agriculture is understood traditionally as an activity aimed at exploiting the land for the production of material goods for use, consumption and private exchange, rurality marks the reintegration of agriculture into a broader sphere, one that is not only economic, but also social and cultural; not only material, but also ideal, relational, historical, and symbolic; and not only private, but also public. In approaching rus, the natural and social sciences first became specialized, multiplied, and compartmentalized in a plurality of first-order disciplines; later, they began a process of integration into Agroecology as a second-order, multi-perspective and shared research platform. Today, Agroecology is a transdiscipline that integrates other fields of knowledge into the concept of agroecosystems viewed as socio-ecological systems. However, the law seems to still be stuck in the first stage. Following a reductionist approach, law has deconstructed and shattered the universe of rus into countless, disjointed legal elementary particles, multiplying the planes of analysis and, in particular, keeping Agricultural Law and Environmental Law two separate fields.
