Book excerpt: L’une des particularités de la libéralisation des échanges et de la mondialisation de l’économie est, de manière incidente, de rendre plus difficile la réalisation de l’objectif fondamental originel de l’OIT qu’est la justice sociale. On peut donc penser que le renforcement de la protection des travailleurs par le biais de la Déclaration de 1998 constitue une réponse suffisante à la question sociale qu’ont suscitée la libéralisation des échanges et la mondialisation de l’économie. Il semble, à certains égards, qu’il n’en soit pas ainsi.En effet et s’agissant des travailleurs, l’objectif de justice sociale postule aussi l’amélioration de leurs conditions de vie. Or il est incontestable que l’amélioration des conditions de vie dépend pour une large part de la politique économique et sociale mise en œuvre par les États. Et c’est bien à ce sujet que surgissent quelques appréhensions. Car depuis la 2ème moitié des années 80, les États appliquent des politiques économiques, et budgétaires notamment, dont le moins que l’on puisse dire est qu’elles ne considèrent pas la justice sociale, telle qu’elle l’entend l’OIT, comme un objectif fondamental et prioritaire.Cette opposition entre l’objectif fondateur de l’OIT et les préconisations économiques et budgétaires du FMI et de la Banque mondiale révèlent, si ce n’est un manque de concertation, du moins une insuffisante collaboration entre l’OIT et les institutions de Bretton Woods. Pourtant c’est de l’intensification et de l’amélioration de cette collaboration que pourront venir des progrès significatifs dans le domaine social. Et l’urgence d’une meilleure prise en compte de la dimension sociale dans le contexte de l’économie mondialisée et libérale à inciter l’OIT et les institutions de Bretton Woods à remédier aux lacunes de leur collaboration. Ce qui laisse espérer une meilleure concrétisation de la raison d’être de l’OIT et la justification de son action normative : la justice sociale.

As the oldest organisation in the UN system, approaching its 100th anniversary in 2019, the ILO faces unprecedented strains and challenges. Since before the financial crisis, the global economy has tested the limits of a regulatory regime which was conceived in 1919. The organisation's founders only entrusted it with balancing social progress with the constraints of an interconnected open economy, but gambled almost entirely on tools of persuasion to ensure that this would happen. Whether that gamble is still capable of paying-off is the subject of this book, by a former ILO insider with an unrivalled knowledge of its work. The book forms part of a broader inquiry into the relevance of founding institutional principles to today's context, and strives to show that the bet made on persuasion may yet pay off. In part, the text argues that there may be little alternative anyway, showing that the pathways to more binding solutions are fraught with difficulty. The aim of this work is, first, to clarify the impact of the globalisation process on social security systems and, second, to formulate substantive and technical proposals for the adaptation of existing social security schemes to an altered socio-economic context and for the elaboration of international legal instruments aimed at an effective substantive and procedural protection of social security as a fundamental right.The report is divided into three parts. The first part is concerned with the social impact of globalisation and its consequences for social security systems in the high-income economies. The first article of this section considers the nature of globalisation as well as its social impact. It spells out some fundamental challenges facing social security systems. The following article elaborates further on one specific challenge, that is: the need for social security to adapt to the increased territorial mobility of workers.The second part looks at the effects of globalisation on social security in relation to middle- and low-income countries and examines the extent to which existing arrangements in these countries are able to provide adequate income protection to me majority of the population. For the group of middle-income countries, the relevance of globalisation for the privatisation of pension systems is analysed as well as the consequences with respect to their main social functions, i.e. the provision of old-age income security and income redistribution. This is done so through a comparative analysis of Latin American countries that have implemented pension policy reform. The following two articles consider the experience of social security systems in low-income countries. In the first article the impact and challenges of globalisation for existing formal and informal social security arrangements in low-income countries are explored and options are suggested for alternative approaches to social security provision that are better suited to the circumstances of low-income countries. The arguments have been illustrated with evidence from Cote d'Ivoire, a country with a socio-economic situation and social security framework that is typical for the majority of low-income countries. The second article discusses in greater depth the link between informal economic and social security in Sub-Saharan Africa.Finally, the third part calls for a global approach to social security. To this end, the first article in this section outlines a possible strategy for a generalised social protection at the global level based on the human damage theory while the last chapter of this work is concerned with the international legal instruments most appropriate for a better substantive and procedural protection of social security as a basic human right.

In addition, we used Policy Transfer Studies (PTS) to show how the contributions of transnational transfers on the development of national social policies are considered as the lever for the integration of developing countries. But, in other words, these countries are considered as the places of fixation where interdependencies between public and private actors are consolidated, where rules of action are negotiated thanks to the agreements, conventions, which we have analyzed throughout, through two types of partnership, namely: bilateral and multilateral, through public-public, public-private, private-private (INGO-International Institution) partnerships. Finally, we carried out an evaluation, in order to subsequently identify some perspectives encouraged by transnational contributions on the social policies of developing countries.
