Book excerpt: Whether as an insurance consultant or a witness on the stand in a civil trial, I rely to a great extent on my 27-year career in the property and casualty industry. More importantly, the variety of experiences encountered during those 27 years, in various positions and levels of responsibility, provided a unique perspective on the extent to which attorneys and claim representatives/adjusters effectively carry out their respective obligations to their clients and customers. Successful organizations are those that are characterized by an ongoing search for a better way to conduct the business in which they are engaged. A "better way" does not come about by chance. The failure to constantly assess the changing factors in the environment in which they conduct their business will surely lead to stagnation, minimal success rates and even worse - failure! Having served in a wide variety of capacities in the property and casualty claim arena, I've been in a position to observe the effect that rapidly changing factors have had in this business environment. It has been increasingly difficult for attorneys and adjusters to find that common ground necessary to bring about time-efficient and mutually agreeable resolutions of their cases. The adjuster you interacted and negotiated with five, ten or fifteen years ago is not the same adjuster you deal with today. Their training and the technical resources at their disposal today make them a more formidable adversary. On the other hand, insurance companies expect a great deal more from these individuals as a result of the investment the companies have made in these training and technical resources. The companies appear to be operating from a perspective that these new resources they have provided to their claim staffs should allow them to be more efficient, i.e. handle more cases more expeditiously. The reality is that despite these advances in the resources at the adjuster's disposal, they must still operate in a one-on-one adversarial, give and take setting in order to successfully resolve their cases. By way of first hand observations throughout my career and the feedback received from numerous attorneys in the plaintiffs' bar, it is becoming exceeding more difficult to interact and amicably resolve their cases with today's claim staff. What I hope to achieve in this writing is to give you a better insight into today's claims adjuster, to include the nature and extent of their training, the new technical resources available to them, how they are evaluated, how their cases are evaluated today, and a number of suggestions as to how to achieve a win-win resolution of your clients' cases. You will also be taken on an insider's tour of today's claim organization and structure and the unique world of insurance company financials. Today's difficult claim/legal environment came about as a result of the failure of both camps to understand and keep pace with the rapid rate of change that has occurred. Take this opportunity to analyze the inner workings of today's claim organization from a new perspective. Leverage some or all of these concepts to enhance your effectiveness. Ask yourself if there is indeed a "better way".

Book excerpt: Because of its importance to both policyholders and insurers, the duty to defend has been - and continues to be - extensively litigated. This book analyzes key aspects of the duty to defend in a practical fashion. It is a day-to-day resource for lawyers for both insurers and policyholders, as well as for courts. The book begins in Chapter One with a discussion of fundamental aspects of the duty to defend and concludes in Chapter Eleven with an examination of nonexecution agreements and consent judgments. The chapters in between cover insurers' defenses under reservations of rights and nonwaiver agreements; conflicts of interest in insurance defense; insurers' occasional duty to defend offensively, that is, to prosecute counterclaims, crossclaims, and third-party claims on insureds' behalf; insurers' duty to defend post-judgment proceedings in trial courts and their duties to defend and prosecute appeals; the termination of the duty to defend; the often controversial subject of insurers' right to recoup defense costs incurred in connection with uncovered claims or causes of action; the allocation of defense costs; the consequences of an insurer's breach of the duty to defend; and defenses under defense-cost-indemnification polices. The authors of these chapters are gifted lawyers and scholars with deep experience in the issues on which this book trains a lens.

Book excerpt: Insurance Fraud Is Epidemic Insurance fraud continually takes more money each year than it did the last from the insurance buying public. There is no certain number. Most attempts at insurance fraud succeed. Estimates of the extent of insurance fraud in the United States range from $87 billion to more than $300 billion every year.Insurers and government backed pseudo-insurers can only estimate the extent they lose to fraudulent claims. Lack of sufficient investigation and prosecution of insurance criminals is endemic. Most insurance fraud criminals are not detected. Those that are detected do so because they became greedy, sloppy and unprofessional so that the attempted fraud becomes so obvious it cannot be ignored. The National Insurance Crime Bureau (NICB) estimates that almost 25% of the bodily injury claims related to auto crashes are bogus. Property and casualty claims against auto insurance are not much better, coming in at around a 10% fraud rate.A person commits the offense of insurance fraud by knowingly and with the intent to defraud any insurer presents or causes to be presented to any insurer any statement forming a part of, or in support of, a claim that contains any false, incomplete or misleading information concerning any fact or thing material to the claim. [18 Pa.C.S.A. § 4117(a)(2).] A person acts "knowingly" when he or she is aware that it is practically certain that his or her conduct will cause such a result. Likewise, a person acts "intentionally" when "it is his or her conscious object to engage in conduct of that nature or to cause such a result. As the industry attempts to keep pace with fraudsters' varied, ever-shifting tactics, it must deploy more innovative, effective anti-fraud technologies or risk dire losses. Vendors and organizations include the Coalition Against Insurance Fraud (CAIF), CSC, Detica NetReveal, Equifax, Experian, FICO, IBM, Innovation Group, Insurance Bureau of Canada (IBC), ISO/Verisk, KPMG, LexisNexis, Mattersight, Mitchell, the National Insurance Crime Bureau (NICB), SAP, SAS, and TransUnion.Insurers must also generate a close relationship with the state insurance department's fraud division or fraud bureau, local police agencies, the FBI, the ATF, the Postal Investigation Service, the local fire department's arson unit, local prosecutors, and the local U.S. Attorneys if they are to have any chance to reduce the effect of insurance fraud. Insurers should also work to make the general public, state legislators, state governors, congress members and U.S. Senators, and the Attorney General of the United States aware of the effect insurance fraud has on the public at large and the insurance industry.Wherever insurance is written insurance fraud exists. It is an equal opportunity fraud committed by people of every race, religion or national origin. Insurers who do not exercise serious anti-fraud efforts often complain that the local district attorneys and police agencies give a low priority to the crime of insurance fraud. No matter how seriously the insurers work to prove fraud the authorities often ignore them. In response, police and prosecutors complain that the insurers do nothing that police and prosecutors can use to prosecute the crime of insurance fraud while insurers complain that prosecutors ignore them when they present evidence of a fraud. There is truth in both complaints. Insurers, although compelled by statute to investigate potential insurance fraud and to present the results of their investigations to prosecutors, they are not trained as police officers. This book is written to make it clear to insurers, police and prosecutors that it is necessary to stop complaining and start working together to reduce the extent of insurance fraud. If they do not work together the crime will continue to metastasize until it will be impossible to write insurance at a profit or for a price anyone can afford.

Book excerpt: Fundamentals of Insurance Coverage in All 50 States is a unique compendium and overview of all aspects of insurance coverage law in every state, with a special emphasis on some of the unique aspects of insurance coverage involving environmental claims. The treatise utilizes and cites state and federal statutes, insurance regulations, and case law from every state, as a framework for a unique and unprecedented treatment of this complicated subject. The book is designed specifically for insurance claims handlers and supervisors who have responsibility for or occasion to deal with coverage issues relating to third-party defense litigation, first-party claims litigation, and reservation of rights scenarios. In addition to being an excellent and easy to understand primer on coverage issues and the basic insurance contract, this book is suitable for both the inexperienced claims professional and the seasoned veteran. It is also the perfect "starting point" for any research or litigation briefing by trial lawyers, defense counsel, or in-house insurance counsel. It is a must for anyone with multi-state responsibilities. Fundamentals of Insurance Coverage in All 50 States compile all of the relevant law, regulations and case decisions from all 50 states into one easy to understand and easy to use reference book, the first place a lawyer or claims handler should turn when coverage matters rear their ugly heads. The book intentionally omits references to federal law, which plays a very limited role in insurance regulation, except insofar as it may be necessary to clarify issues of state law. The book is a comprehensive treatment of all coverage issues that the average insurance lawyer, claims handler or supervisor might be expected to run across in any given situation. This one of a kind treatise covers the following issues in all 50 jurisdictions: • Understanding Contracts of Insurance • Law Governing Insurance Policies • Tackling Ambiguity and Interpretation of Policies • General Contract Rules for Interpretation • Rights and Obligations of Contracting Parties • Limitations of the "Construed against Drafter" Rule • The Extent of Risks and Coverages • Good Faith and Fair Dealing; Bad Faith • Basic Policy Defenses • Cooperation of the Insured • Failure to Pay Premiums • Environmental Issues and Related Insurance Law
