Out of equilibrium, any system is assumed to depend locally on the same set of variables as when it is in eqUilibrium. This leads to a formal thermody namic structure identical to that of eqUilibrium: intensive parameters such as temperature, pressure and chemical potentials are well-defined quantities keeping their usual meaning, thermodynamic potentials are derived as Leg endre transformations and all equilibrium thermodynamic relations retain their validity. The theory based on this hypothesis has turned out to be very useful and has achieved a number of successes in many practical situations. of interest in going However, the recent decade has witnessed a surge beyond the classical formulation. There are several reasons for this. One of them is the development of experimental methods able to deal with the response of systems to high-frequency and short-wavelength perturbations, such as ultrasound propagation and light and neutron scattering. The ob served results have led to generalizations of the classical hydrodynamical theories, by including memory functions or generalized transport coefficients depending on the frequency and the wavevector. This field has generated impressive progress in non-equilibrium statistical mechanics, but for the moment it has not brought about a parallel development in non-equilibrium thermodynamics. An extension of thermodynamics compatible with gener alized hydrodynamics therefore appears to be a natural subject of research.

Originally, thermodynamics has been a purely phenomenological science. Early s- entists (Galileo, Santorio, Celsius, Fahrenheit) tried to give de?nitions for quantities which were intuitively obvious to the observer, like pressure or temperature, and studied their interconnections. The idea that these phenomena might be linked to other ?elds of physics, like classical mechanics, e.g., was not common in those days. Such a connection was basically introduced when Joule calculated the heat equ- alent in 1840 showing that heat was a form of energy, just like kinetic or potential energy in the theory of mechanics. At the end of the 19th century, when the atomic theory became popular, researchers began to think of a gas as a huge amount of bouncing balls inside a box.

The United Kingdom experienced a substantial nuclear accident in the 1950s in the form of the Windscale Pile fire. This in itself had both good and bad consequences; the setting up of a licensing authority to ensure nuclear safety was one, the understandable public sentiment concerning nuclear power (despite the fire occurring in a weapons pile) the other. Windscale today is subsumed in the reprocessing plant at Sellafield operated by British Nuclear Fuels plc and it was inevitable perhaps that when an excess cluster of childhood leukaemia was observed in the nearby village of Seascale that public concern should be promoted by the media, leading to the hearing of a claim of compensation brought on behalf of two of the families of BNFLs workers who had suffered that loss. The review article demonstrates the complexity of und- standing such a claim against the statistical fluctuations inherent and shows how the courts were persuaded of the need to propose a biological mechanism if responsibility were to be held. The Company were undoubtedly relieved by the finding.
