Book excerpt: Urbanization decreases the amount of natural habitat available to wildlife but some species are able to adapt to and even thrive in human-dominated landscapes. When humans and wildlife live in close proximity the number of conflicts increase. Natural resource and agricultural departments were not designed to handle urban problems or the number of complaints that arise in urban areas, and the nuisance wildlife control (NWC) industry has developed in response to the unmet demand for assistance. Members of the wildlife profession have expressed concerns over the impact the nuisance wildlife control industry may have on wildlife, the public, and wildlife management, but no national studies were found that examined the size, growth, and/or economic impact of the industry. The most recent national reviews of regulation and oversight took place 9́Æ10 years ago. This study examines 2 broad features of the NWC industry: 1) size and economic impact of the industry in the U.S. (e.g., number of businesses, annual sales revenue generated); and 2) the national regulatory environment. A total of 3,153 NWC businesses were identified in the U.S., and a conservative annual sales figure of $140 million was estimated for the wildlife removal services only. Changes in the regulatory environment from 1997-2007 were examined using a 10-category scoring system developed during an earlier study, and comparing the results of both studies. Changes were observed (P 9́Þ 0.05) for 9 of 10 characteristics, and the average cumulative score rose from 2.20 to 4.28 out of 10.0.

A variety of models have been constructed concerning the optimal scheduling and sequence of water-supply projects: dynamic programming for solving multi-bjective functions in water resource development; planning models for coordinating regional water-resource supply and demand, etc. Other studies have devised water-quality management models, including multi-period design of regional or municipal wastewater systems; cost-allocation methods to induce effluent dischargers to participate in regional water systems; models to predict the quality of effluent (in particular, whether it meets certain established standards); models for finding optimal waste-removal policies at each of the polluting sources, and so on.

Meeting this challenge requires the development of flexible regimes that have the potential to meet essential consumptive needs while restoring environmental flows. This book focuses on how water trading frameworks can be repurposed for environmental water recovery and aims to conceptualise the most appropriate role for law in supporting recovery through these frameworks. The author presents a comprehensive study of the legal frameworks in four jurisdictions: the States of Oregon and Colorado in the western United States; the province of Alberta in Canada; and the Murray-Darling Basin in Australia/Basin State of New South Wales. A close comparative analysis of these four jurisdictions reveals a variety of distinctive regulatory arrangements and collaborations between public and private actors. In all cases, the law has been deployed to steer and coordinate these water governance activities. The book argues that each regime is based on a particular regulatory strategy, with different conceptions of the appropriate roles for, and relationships between, various actors and institutions. Legal frameworks do not have the capacity to rationalise and provide an overarching and absolute solution to the complex environmental and governance issues that arise in the context of environmental water transactions. Rather, the role of law in this context needs to be reconceptualised within the paradigm of regulatory capitalism as establishing and maintaining the limits within which regulatory participants can operate, innovate and collaborate.
