For example, a person suffers from an illness that cannot be cured, and in order to be healed he performs a ritual involving prosecution and defense, a judge and witnesses. Divine beings give evidence through human oracles, spirits possess their human victims and are exorcized, and local gods intervene to provide healing and justice. Such practices seem to be the very antithesis of modernity and many modern, secular states have systematically attempted to eliminate them. Why are such rituals largely absent from modern societies, and what happens to them when the state attempts to expunge them from their health and justice systems, or even to criminalize them? Despite the prevalence of rituals involving some or all of these elements, The Law of Possession represents the first attempt to compare and analyze them systematically. An interdisciplinary circle of authors demonstrates how squatters have articulated their demands for participation in the housing market and public space in a whole range of contexts, and how this has brought them into conflict and/or cooperation with the authorities. The volume examines housing struggles and the occupation of buildings in the Global "North," but it is equally concerned with land acquisition and informal settlements in the Global "South." In the context of the former, squatting tends to be conceived as social practice and collective protest, whereas self-help strategies of the marginalized are more commonly associated with the southern hemisphere. This volume’s historical perspective, however, helps to overcome the north-south dualism in research on squatting.

Book excerpt: The concept of customary international law, although differently formulated, is already present in early modern European debates on natural law and the law of nations. However, no scholarly monograph has, until now, addressed the relationship between custom and the European natural law and ius gentium tradition. This book tells that neglected story, and offers a solid conceptual framework to contextualize and understand the 'problematic of custom', namely how to identify its normative content. Natural law doctrines, and the different ways in which they help construct human reason, provided custom with such normative content. This normative content consists of a set of fundamental moral values that help identify the status of custom as either a fundamental feature or an original source of ius gentium. This book explores what cultural values and practices facilitated the emergence of custom and rendered it into as a source of the law of nations, and how they did so. Two crucial issues form the core of the book's analysis. Firstly, it qualifies the nature of the interrelation between natural law and ius gentium, explaining why it matters in relation to our understanding of the idea of custom. Second, the book claims that the process of custom formation as a source of law calls into question the role of the authority of history. The interpretation of the past through this approach can thus be described as one of 'invention'.

Fadel's intellectual concerns focus primarily on the compatibility of the Islamic legal tradition with modern liberal political arrangements, but in his research and writing he also delves into the realm of premodern Islamic legal thought and institutions. His Rawlsian approach leads him to a political reading of the Islamic legal tradition, which he accomplishes by teasing out jurists' assumptions about politics, economics, and the domestic sphere. Fadel's readings of Islamic legal sources suggest that Islamic law remains relevant to a society in which legitimate disagreements over law and morality seem intractable. At the same time, from the Rawlsian perspective he adopts, Fadel reminds us that premodern Muslim jurists formulated Islamic law also under conditions of substantial controversy over matters of law and morality, as well as over questions of religion, politics, theology, and metaphysics. The studies gathered together in this volume adroitly illustrate Fadel's interest in Islamic law as a domain of Islamic political thought and as a framework that might be deployed in today's pluralistic and secularized societies.
